1. Short title, extent and commencement

Short title, extent and commencement
- (1) This Act may be called the Andhra Pradesh (50 Percent Reservation to Women in Works Contracts and Service Contracts given on Nomination) Act, 2019.
- (2) It extends to the whole of the State of Andhra Pradesh.
- (3) It shall come into force on such date as the Government may, by notification, appoint.
2. Definitions

Definitions In this Act, unless the context otherwise requires,—
- (a) “Administrative Department” means the Secretariat Department concerned with the subject matter of the contract;
- (b) “Engineering Departments” means the Departments of Water Resources, Roads and Buildings, Panchayat Raj, Public Health and Municipal Engineering and such other Departments as the Government may notify from time to time;
- (c) “Government” means the State Government of Andhra Pradesh;
- (d) “Nominated Works” means any works contract or service contract of the value specified by the Government from time to time, which is entrusted to a contractor without following the tender process;
- (e) “Notification” means a notification published in the Andhra Pradesh Gazette and the word ‘notified’ shall be construed accordingly;
- (f) “Prescribed” means prescribed by rules made by the Government under this Act;
- (g) “Women” means a woman or group of women or a company or a firm or a society or a proprietary concern owned/constituted by women.
3. Reservation to women in works contracts and service contracts given on nomination

Reservation to women in works contracts and service contracts given on nomination:
- (1) Notwithstanding anything contained in any law for the time being in force, all works contracts and service contracts of the State Government, and of bodies owned or controlled by the State Government, which are given on nomination basis, shall be reserved to the extent of fifty percent (50%) for women.
- (2) The works and service contracts referred to in sub-section
- (1) shall be allocated among women entrepreneurs belonging to Scheduled Castes, Scheduled Tribes, Backward Classes and Minorities in the proportion as may be prescribed by the Government from time to time.
4. Power to make rules

Power to make rules:
- (1) The Government may, by notification, make rules for carrying out all or any of the purposes of this Act.
- (2) All rules made under this Act shall, as soon as may be after they are made, be laid before the State Legislature.
5. Power to remove difficulties

- (1) If any difficulty arises in giving effect to the provisions of this Act, the Government may, by order published in the Andhra Pradesh Gazette, make such provisions not inconsistent with the provisions of this Act as appear to them to be necessary or expedient for removing the difficulty: Provided that no such order shall be made after the expiry of two years from the date of commencement of this Act.
- (2) Every order made under this section shall, as soon as may be after it is made, be laid before the State Legislature.
