The Sri Dev Suman University Act
1. Short title, commencement and extent
(1) This Act may be called the "Sri Dev Suman Uttarakhand University" Act, 2011. (2) It shall come into force at once. (3) It shall extend to such part of the State as the State Government may, by notification in the Official Gazette, appoint.
2. Definitions
In this Act, unless the context otherwise requires: (a) "Affiliated College" means an institution which is affiliated to the University in accordance with the provisions of this Act and the Statutes/Regulations made thereunder; (b) "Approved Institution" means an institution of higher education approved by the University/State Government; (c) "Autonomous College" means a college declared as such by the provisions of the University Grants Commission; (d) "College" means any college or institution affiliated to the University in accordance with the provisions of this Act and the Statutes/Regulations made thereunder; (e) "Existing College" means such college or institution, which is imparting higher/professional education and is being conducted and maintained by any University established in the State; (f) "Other Backward Classes of citizens" means the backward classes of citizens specified in Schedule 1 of the Uttarakhand (Uttar Pradesh Public Services for Scheduled Castes, Scheduled Tribes and Other Backward Classes Reservation) Act, 1994 (Adaptation and Modification) Order, 2001; (g) "Academic Council" means the Academic Council of the University; (h) "Chancellor" means the Chancellor of the University; (i) "Court" means the Court of the University; (j) "Director" means the head of the institution established by the University for the organization and conduct of teaching and research of any subject; (k) "Executive Council" means the Executive Council of the University; (l) "Finance Committee" means the Finance Committee of the University; (m) "Government" means the Government of Uttarakhand; (n) "Registrar" means the Registrar of the University; (o) "State" means the State of Uttarakhand; (p) "Statutes", "Ordinance" and "Regulation" means respectively the Statutes, Ordinance and Regulation of the University; (q) "University Grants Commission" means the University Grants Commission established under the University Grants Commission Act, 1956; (r) "Prescribed" means prescribed by the Regulations; (s) "Principal" means the head of a college, by whatever name called and includes, where there is no Principal, any person duly appointed to act as Principal and in the absence of the Principal or Acting Principal, the Vice-Principal duly appointed as such; (t) "Regulation" means the Regulations of the University made under this Act; (u) "University" means the University established under section 3 of this Act; (v) "Constituent College" means such institution, which is maintained by the University or the State Government and which has been declared as such under the Regulations; (w) "Maintenance Grant" means the grant-in-aid received by a college from time to time by the State Government through general or special order; (x) "Management" in relation to an affiliated or constituent college or self-financed institution means such committee of management or other body which is charged with the burden of management of the affairs of that college or institution and which is recognized as such by the University; (y) "Officers of the University" means the officers mentioned in section 8 of the Act; (z) "Property" in relation to an affiliated or associated college, means all such movable or immovable property, which is owned by the college or is granted fully or partially for the benefit of the college, including land, buildings (including hostels), workshops, libraries, laboratories, equipment, tools, furniture, stationery, stores, auto-mobiles or other vehicles, if any, and all such things related to the college such as cash in hand, bank deposits, investments and recorded loans and rights and interests obtained from such property, which are under the ownership, possession, rights or control of the college and accounts books and all other records, of whatever nature, and all existing liabilities, obligations and legal encumbrances of the college shall also be considered included therein, regardless of their category; (aa) "Registered Graduate" means a graduate of the University registered under the provisions of this Act and any Act repealed or superseded by it; (bb) "Self-financed Institution" means such college or institutions, which have been granted affiliation by the University in accordance with this Act, and Ordinances and Statutes made thereunder; (cc) "Teacher" means a person employed in an affiliated or associated college for imparting teaching and/or conduct and guidance of research and extension work and includes the Principal.
3. Establishment and incorporation of the University
(1) A University shall be established by the name of "Sri Dev Suman Uttarakhand University". (2) The University shall be a body corporate with the name specified in sub-section (1) and shall have perpetual succession and a common seal and shall sue and be sued by the said name. (3) The headquarters of the University shall be situated at Badshahithaul, District-Tehri Garhwal and it may establish its additional campuses at such other places as it deems necessary with the prior approval of the State Government.
4. Territorial exercise of powers
(1) The jurisdiction of the University for the exercise of its powers under this Act shall be within Garhwal Mandal. (2) On the date of commencement of this Act, every college or institution other than those imparting higher/professional education as on that date, shall be deemed to be affiliated to the University established under section 3 from such date as the State Government may notify in this behalf and shall no longer remain affiliated or associated with the Uttar Pradesh State University Act, 1973 (as applicable in Uttarakhand) or the H.N.B. Garhwal University, hereinafter referred to in this section as the 'previous university' in the present context: Provided that a student receiving education in any college or institution other than an existing college on the commencement date of this Act shall be entitled to continue and complete such education under the previous university on or after such commencement and shall also be permitted to do so, and the previous university alone shall conduct the examination of such student according to the procedure prevailing at that time in the entire university and shall grant degree or any other academic distinction.
5. Power of State Government to issue notification
The State Government may, by notification in the Gazette: (1) Reduce or increase the area or academic jurisdiction of the University; (2) In any notification under this section, make provisions for amendment of the Schedule and the Statutes, Ordinances and Regulations of the University affected by such notification, as may be necessary to give effect to the provisions of this Act, and thereafter the Schedule and relevant Statutes, Ordinances and Regulations shall be amended accordingly; (3) Without prejudice to the generality of the provisions of sub-section (2), any notification under this section may make provisions for the following subjects; namely: (a) Provisions related to the representation of persons of various interests or classes in the authorities of the University affected by the said notification; (b) Provisions for the registered graduates of any university existing at the time to continue to be registered graduates of that university or to exercise the option to get registered in a newly established university, provided that no person shall be a registered graduate of more than one university; (c) Such other supplementary, incidental and consequential provisions as the State Government may from time to time deem necessary.
6. University to be open to all classes and creeds
The University shall be open to all persons, irrespective of their class, caste, gender or creed, but nothing in this section shall prevent the University or the Government from exercising their powers to stop discrimination for persons, group of persons, caste or class of a particular background, as approved by the Legislature: Provided that nothing in this section shall be deemed to prevent the University from making special provisions for the admission of students belonging to Scheduled Castes, Scheduled Tribes, Other Backward Classes and other persons, as may be specified by the Government.
7. Powers and duties of the University
The University shall have the following powers and duties; namely: (a) To make arrangements for teaching in such subjects as the University deems proper and to make arrangements for the advancement and dissemination of knowledge in research and extension work including consultancy services: Provided that the fields of research and extension work shall be encouraged in such a manner that the teaching acts are not encroached upon due to higher education/knowledge being first; (b) To reorient teaching, research and extension work and consultation and cooperation with other universities and institutions and entrepreneurship extension in such manner as the University deems proper, so as to accelerate academic advancement and scientific research and to include the establishment of inter/multidisciplinary centers/departments to keep pace with new social demands; (c) To affiliate and associate with the University to other universities, institutions and authorities for the expansion of possibilities of education; (d) To work towards character and capacity building of students with the objective of equipping them to enter the job market and to become competitive, to encourage entrepreneurship in them and to play a positive role as responsible citizens; (e) To institute chairs, degrees, diplomas and other academic distinctions; (f) To grant the special right of affiliation or recognition to any college or self-financed institutions of various names or to increase the special rights of any college already affiliated or recognized as the case may be, or to withdraw or reduce any such special right, and to guide and control the work of affiliated and associated colleges and self-financed institutions; (g) To conduct examinations for such persons (without discrimination of any gender, caste, creed or otherwise disability) who have studied any course according to the conditions determined in the Statutes and Ordinances, in the university campus, constituent or affiliated or associated college or self-financed institution or have done research work under the University or an institution recognized by the University for this purpose or a distance education program or who have attained excellence in any field, and to grant degrees, diplomas and other academic distinctions; (h) To grant honorary degrees or other academic distinctions in the manner and conditions prescribed in the Statutes; (i) To [text truncated in original image]

14. Registrar
(1) The Registrar shall be a whole-time officer of the University. (2) [Deleted by Uttarakhand Act No. 21 of 2018]. (3) The Registrar shall have the power to authenticate the records on behalf of the University. (4) The Registrar shall be responsible for the proper custody of the records and the common seal of the University. He shall be the ex-officio Secretary of the Executive Council and shall be bound to present before the Executive Council all such information as is necessary for the performance of his duties. He shall also perform such other duties as may be prescribed or required by the Executive Council or the Vice-Chancellor from time to time, but he shall not be entitled to vote on the basis of this sub-section. (5) The Registrar shall be the appointing authority for all Class III and Class IV employees of the University and shall be responsible for their transfer and posting. (6) Except in matters where instructions are otherwise given by the Executive Council, the Registrar shall be responsible for confidential work related to examinations and for maintaining secrecy. (7) The Registrar shall be responsible for all matters related to the academic affiliation and institutional activities of the University. (8) The Registrar shall be responsible for the conduct of inspections and general and overall supervision of all colleges and institutions affiliated to the University, as may be prescribed. (9) The Registrar shall have all the powers of a Head of Office as mentioned in the Financial Handbook, however, the State Government may increase the limit of sanction on the recommendation of the Vice-Chancellor. (10) Except as provided in the regulations, the Registrar shall not be given any remuneration for any work in the University nor shall he accept it.
15. Centralization of services of Registrars, Deputy Registrars and Assistant Registrars
The State Government shall provide for the creation of such a separate service of Registrars, Deputy Registrars and Assistant Registrars as is common for all universities and shall regulate the allowances and the conditions of service of persons appointed to such service.
16. Controller of Examination
(1) The Controller of Examination shall be a whole-time officer of the University, who shall not be below the rank of Associate Professor. (2) The appointment of the Controller of Examination shall be made by the State Government by notification and his remuneration and allowances shall be paid by the University. (3) The Controller of Examination shall be responsible for the proper custody of records related to work. He shall be the ex-officio Secretary of the Examination Committee of the University and shall be bound to present before such committee all such information as is necessary for the performance of his duties. He shall also perform such other duties as may be prescribed by regulation or required by the Executive Council or Vice-Chancellor from time to time, but shall not be entitled to vote on the basis of this sub-section. He may require from a college the submission of such returns or such information as is necessary for the discharge of his duties. (4) Staying under the supervision of the Vice-Chancellor, the Controller of Examination shall have administrative control over the employees working under him related to examination work. (5) Staying under the supervision of the Examination Committee, the Controller of Examination shall conduct the examinations and make all other arrangements necessary for that and shall be responsible for the proper execution of all procedures related thereto. (6) Except for the order of the State Government, the Controller of Examination shall not be given any remuneration for any work in the University nor shall he accept it. (7) If the Controller of Examination is unable to perform work for any reason or the post of Controller of Examination is vacant, all the duties of his post shall be performed, as the case may be, by such person until the Controller of Examination resumes charge or the vacancy is filled, as may be appointed by the Vice-Chancellor.
17. Restrictions and conditions of powers of other officers, vacancies, duties and service
Except as provided in this Act, the manner of appointment, conditions of service and powers and duties of officers of the University other than the Chancellor, Vice-Chancellor, Finance Officer and Registrar shall be such as may be prescribed or determined by the State Government.
18. Members of the Executive Council, Officers of the University
The members of the Executive Council mentioned in clauses (p), (n), (t), (v) of sub-section (1) of section 25 shall be the officers of the University.
19. Other officers of the University
Except for the Chancellor, Vice-Chancellor, Finance Officer, Registrar, Controller of Examination and members of the Executive Council, the powers and duties of other officers of the University shall be such as are provided in this Act and/or in the statutes and ordinances.
20. Dean of Faculty
(1) The Dean of Faculty shall be an honorary officer, who shall be appointed on rotation basis, on the basis of seniority among the professors of the faculty and shall hold office for three years: Provided that in the case of Medical, Engineering, Ayurvedic or Fine Arts colleges (including self-financed institutions), the Principal of such college shall be the ex-officio Dean of Faculty of Medical, Engineering, Ayurvedic or Fine Arts, as the case may be.

(1) Normally, the meeting of the Executive Council shall be held at least once every three months and notice of the meeting along with the agenda and enclosures shall be given by the Registrar at least 15 days before each meeting, unless otherwise provided: Provided that if in the view of the Vice-Chancellor, an extremely important matter has arisen for consideration, due to which it is necessary to call an emergency meeting of the Executive Council, then he may call the meeting on short notice of only three days. This arrangement shall be adopted in certain cases and along with the notice of the meeting, the reason for the emergency and the agenda shall be distributed to the members. (2) For quorum, at least half the number of total members shall be necessary, and in such situation, the meeting and the decisions taken therein shall not be invalid.

(1) The Academic Council shall be the main academic body of the University and subject to the provisions of the Act, Statutes and Ordinances: (a) It shall be responsible for all types of control and regulation related to teaching, education and research work conducted in the University, including consultancy, advice and entrepreneurship development studies, etc.; (b) It shall be able to advise the Executive Council on all matters related to education, including subjects related to examinations conducted by the University; and (c) It shall have such other powers and duties as may be conferred or imposed upon it by the Statutes. (2) The Academic Council shall consist of the following members, namely: (one) Vice-Chancellor, who shall be the Chairman and Convener; (two) Deans of all faculties, if any; (three) All Heads of Departments of the University and if there is no department for a subject in the University, then the senior-most teacher from the affiliated colleges or self-financed institutions representing that subject in the concerned faculty; (four) All such Professors of the University who are not Heads of Departments; (five) Three Principals of affiliated colleges, who shall be chosen by rotation in the prescribed manner; (six) Ten teachers chosen in the prescribed manner; (seven) Librarian of the University; (eight) Three persons illustrious in the field of education, who shall be co-opted in the prescribed manner; (nine) Ex-officio Controller of Examinations. (3) The tenure of members other than ex-officio members shall be such as may be prescribed. (4) The meeting of the Academic Council shall be held at least once in every academic session. (5) Other functions of the Academic Council shall be such as may be prescribed.

(1) The Finance Committee shall consist of the following, namely: (a) Vice-Chancellor; (b) Principal Secretary/Secretary of the Higher Education Department in the State Government or an officer nominated by him, who shall not be below the rank of Additional Secretary; (c) Principal Secretary/Secretary of the Finance Department in the State Government or an officer nominated by him, who shall not be below the rank of Additional Secretary; (d) Registrar; (e) A person nominated by the Executive Council to represent the Executive Council, who has deep experience in financial matters. The person to be selected shall not be a member of the management committee of the University or any affiliated college, self-financed institution or associated college, or a person serving such college; (f) A person nominated by the State Government, who is illustrious in the financial or academic field; (g) Controller of Examinations; (h) Finance Officer, who shall also be the Secretary of the Committee. (2) The Finance Committee shall advise the Executive Council on matters related to the administration of the property and funds of the University. It shall fix the total recurring and non-recurring expenditure limit for the subsequent financial year, keeping in mind the income and resources of the University, and for any special reasons, may revise such fixed expenditure limit during the financial year, and such fixed limit shall be binding on the Executive Council: Provided that the provisions of this sub-section shall not apply to the powers vested in the Vice-Chancellor under sub-section (7) of Section 12, and the additional expenses incurred shall be met by saving in other items of the budget. (3) The Finance Committee shall have such other powers and duties as may be conferred or imposed upon it by this Act or the Statutes. (4) Unless that proposal having financial implications is recommended by the Finance Committee, the Executive Council shall not take a decision on it; and if the Executive Council disagrees with the recommendations of the Finance Committee, it shall return the proposal to the Finance Committee with the reasons for disagreement, and if the Executive Council again disagrees with the recommendation of the Finance Committee, the matter shall be referred to the Government for decision, the decision of which shall be final.
