The Uttarakhand state sports University Act, 2025
1. Short Title extent and Commencement
(1) This Act may be called the uttarakhand state sports University Act, 2025. (2) It extends to the whole of the State of Uttarthand. (3) It shall come into force at once.
2. Definitions
(1) In this Act, unless the context otherwise requires,- (a) "Academic and Activity Council" means the Academic and A6tivity Council of the University coustinted under section 25 of this Act; (b) "Act" means the Uttaralthand State Sports University Act, 2025; (c) "Affiliated college" means a college or institution affhiated by the University under section 30 of this Act; (d) "Associated Activity Schoovcollege" mealis any institution recognized by the University and authorized under the provisions of this Act including Utlarakhand Sports department's infrastructure, Uttarakhand Sports Colleges/hostels having sports facilities for at least thiree indoor and two outdoor sports facilities for games recognized by the State Government within a radius of fifteen kms from the outermost boundary of the College seeking affiliation in order to fulfill the practical sessions as per the curriculum required; (e) "Board" means de Board Of Governors of the University constituted under section 21 of this Act; (f) "Chair"n" mcans the chairman of the Board; (g) "Chancellor" means Chancellor of the Ulliversfty; (h) "College" means a college or an jnstrfufron teaching any of the courses leading to a degree or a diploma or a certificate etc. under this Act; (i) "I)eons" means the Dcaus of the University appointed under section 15 of this Act; (j) "Department" means Department of study and includes CenterofStudy; (k) "Directors" means the Directors of the University appointed under section 14 of this Act; (l) "Employee" means any person appointed by the University and includes a teacher or any other member of the staff of the University; (m) "Executive Council" mean the Executve couhcil of the Universfty; (n) "Faculty" xpearis faoulty of the university or college; (o) "Finance Committee" means the Finance Ctondttee of the University constituted under section 27 of this Act; (p) "Head Coach" means the Head Coach of the University appointed under section 16; (q) ''NAAC" means National Assessment and Accreditation Council of India for cer[ification of the higher education Institndous; (r) "Registrar" means the Registrar of the University appointed under section 17 of this Act; (s) "Regulations" means the regulations of the bniversfty made under this Act; (t) "Regulatory Body" means the Statutory bodies established by the Cenhal Government from time to time, such as; University Grants Commission, de AIL-hdia Council for Technical Education, the Bar Council of India, the Distance Education Council, the Dental Council of India, the Indian Nursing Council, the Medical Council of India, the National Council for Teacher Education, Central Council for Indian Medicine, the Pharmacy Council of India etc.; (u) "Section" means section of this Act; (v) "State" means the state of uttarakhand; (w) "Statutes" and "Ordinances" means the Sta.totes and theOrdina[icesoftheUniversitymadeunderthisAct; (x) "Student" means a student enrolled in the register of the Uhiversity or College, associated or affiliated to the Uulversity; (y) "Study Centre" means a center established, maintained or recognized by the University for the purpose of advising, counseling. coaching, training or for rendering any other assistance required by the students; (z) "Teacher of tlid University" means Professors, Associate Professors, Assistant Professors, coaches and such other persons as may be appointed for imparting instnictious,coaching,trainingorconduetingreseachin the Uhiversity, College or Institution and Stud.y Centers maintained by the Uhiversity and are designated as teachers by the Statutes; (za) "University Grants Commission'' means University Grants Commission established under section 4 of the Uhiversity Grants Commission Act, 1956; (zb) "University" means the Uttarakhand State Sports Uulversity established and incorporated under section 3 of this Act; (zc) "University Colege" means a college which the University may establish or run under this Act or a college transfened to and run by the Uulversity; (zd) "University Department" means any department established and maintained by the University for diploma, degree or post-graduate studies and research; (ze) "Vice-Chancellor" means the Vice-Chancellor of the University appointed under section 12. (2) Words denoting the singular shall include the plural & also vice versa. (3) Words denoting any gender shall include all genders.
3. Incorporation of University
(1) There shall be established a University by the naine of the Uttarakhand State Sports University. (2) The Vice-Chancellor, the Board, the Executive Council, the Academic and Activity Council, the Directors, the Deans, the Registrar and all other persons who may hereafter become such officers or members so long as they continue to hold such office or membership, shall constitute a University by the name of the Uttarakhand State Sports University. (3) The University shall be a body corporate by the name as aforesaid, having pexpetunl succession and common seal with power, subject to the provisioiLs of this Act, to acquire and hold property, to contract and shall, by the said name, sue or be sued. (4) In all suits and other legal proceedings by or against the University, the pleadings shall be signed and verified by the Registrar and all processes in such proceedings shall be issued to, and served on Registrar. (5) The University Shall function as an affiliating and teaching University and it shall affiliate a`ny college or institution of physical Education or Sports for tca`ching or coaching students leading to the confement of degrees, diplomas, or grant certificates for skill development and vocational purpose to the students admired therein. Post graduate studies and research shall also be undertaken as per norms of the UGcthegulatory Bodies, if any. (6) On and from the date of commencement of this Act:- All Physical Education or Sports Coll;ges or Institutions admitted to the privileges of or affiliated to any University established within the State shall stand affliated to or admitted to the privileges of or affihiated to the University established under this Act. (7) Distinctive Features of the university:- (i) It shall, be a State University established by and maintained and administered under the auspices of the Government of the Uttarakhand; (ii) It shall conduct academic programs similar to formal education system of the University. However, it shall multiple entry point for the sports persons, who may do the prescribed bridge courses and join the fomal education system; (iii) It shall have a comprchensive physical and academic infrastructui.e 'foi. development and research in methodology, equipment, pbysical fitness. .sports medicine etc. ; (iv) It shall have Specialized Centers of Excellence with the help of concerning Sporting federations. Jt shall be a professional Centre of excellence, an autonomous wing as an institutional framewck for grooming the talent and honouring their sporting skills for the prospective sports persons. The Centre of Excellence shall have mentor-based modules, wherein established sports person; shall be invited to join the institute for mentoring of prospective sports persons. Centre of excellence shall have different divisions such as athletics, aquatic, adventure sports, Combat Games. indigenous games divisions etc. It shall be imperative to au the divisions of Centre of excellence to maintain quality driven training facility and infrastructure. The Centre of Excellence shall make appropriate provision for multiple entry system and special induction program for persons exhibiting or possessing sporting talents for their admission in the center; (v) The Uhiversity shalibe established by the initial grant of the Uttarakhand Government; however, it shall be encouraged to evolve and develop its own revenue generation models for its recuning expenditures;
4. Headquarter of University
The Headquarters of the Uulversity Shall be in Such place as the state Government, by notification in the Official Gazette, may specify.
5. Objectives of University
The objectives of the Uhiversity shall be as follows, namely :- (i) to provide an academic and professional development career pathway for young persons with physical aptitude and persons who are desirous pusuing sports as a profession and devote their entire career to an Olympic recognized sports to reach national and international standnds and win medals for India and continue in the profession by becoming a coach, manager or sports professional; (ii) to develop sportspersous meeting physical and sports Skill standards by inculcating an attitude of continuous perfomance enhancement as per national and international standards by providing especially designed sports skills development and academic inputs in various areas of sports education, sports sciences and also incorporating advanced sports technologies for sports in sportspersons and coaches; (iii) to assist sportspersons to acquire a Bachelor, Master Degree/ Diploma and certificate along with their career in aports; (iv) to establish Specialized Centers and Institutions of Excellence; focusing on specific sports discipline, for inparting the art educational training and research in the fields sports and sports sciences, sports technology and hick-perfomance sports training, for Olympic sports, especially focusing on priority games as defined in Uttarakhand Sports Poliey 2021 especially in: Athletics, Badminton, Boxing, Judo, Taekwondo, Shooting, Football, Karate, Wrestling, Volleyball etc. ; (v) to jrovide the knowledge of advanced physical education and spots coaching, providing specially designed academic training progranmers in various areas of physical education, sports sciences and also advanced technologies of sports training which includes theoretical inputs and practical activity training to generate expense and strengthening physical education and sports training programmer to promote sports perfomances; (vi) to popularize sports through community outrcach and extension programs in sports.; (vii) to generate interdisciplinary capabilities and collaborations for the development of knowledge, skills and competencies at various levels in the field of physical education and sports sciences, spons medicine. biomechanics, sports nutrition, sports technology, sports communication and journalism, disability sports, yoga, exercise and fitness therapy, tourism and adventure sports, water sports, spor(s management, sports Psychology and high-perfomance training for hick priority sports and games; (viii) to generate capabilities to provide infrastmcture of international standard for education, haining and research in the areas related to physical education and sports sciences, sports technology, and .high-performance training for all sports and games; (ix) to prepare hichly qualified professionals in sports related specialized fields such as counseling, testing data analytics, fitness and wellness, sports injury management, virtual reality/artificial int`elligence applications, life-gund etc. (x) to sot up a aystem for talent scouting and mentoring at the grassroot level.; (xi) to function as a leading resource center for knowledge and development in the area of physical education and sports soiences, sports tcohaology, sports event management, sports miss communication and high-perfomance training for all sports and games; (xii) to provide international collaboration. in the fields of physical edulcation and sports sciences, spods technology, bio mechanics, nutrition and high-perfomance training for all sports and games; (xiii) to establish close linkage with schools, colleges, Universities, sports and recreation clubs, Societies, sports associations boards and international sports federations, Academies and Institutes for the purpose of teaching, training .'and research in physical education and sports sciences, sports technology, sports medicines and high-performance training for all sports and games; (xiv) to provide vocational guidance and placement services in physical education, sports sciences, sports nledicine, sports technology and other related fields; (xv) such other objectives, not iLcousistent with the provisions of this Act which the State Government may, on an application by the University, by notification in the Gazette, specify in this behalf.
6. The University Shall be open to all
The University shall be open to persons of any sex and of whatever caste, creed, race or religion, class, place of birth, religious belief or profession or political or other opinion, in order to entitle himther to be admitted as a teacher of the University or to hold any other office therein or to be admitted as a student in the University or to graduate there at or to enjoy or exercise any privilege thereof: Provided that nothing in this section shall be deemed to prevent the University from making special provisions for the employment oi. admission of women, persons with disabilities or of persons 'belonging to the weaker sections of the society and, in particular, of the Scheduled Castes, tlie Scheduled Tribes, Other Backward Classes and the other economically and educationally backward classes of citizens.
7. Power and Functions of the University
Subject to the provisions of this Act, the powers and functions of the University shall be, (I) Administrative powers and functions: (i) to administer and iiianage the University and the associated colleges and to establish such institutes and center \ for research, education and instructions as are necessary, foi. the furtherance of the objectives of the University: (ii) . to hold exaninatious and confer degrees, diplomas, or grant certi.ficates and other academic distinctions or titles on persons subject to such conditions as the University may determine, and to withdraw or cancel any such degL.ees, diplomas, certificates or other academic distinctions ot. titles in the manner as may be prescribed; (iii) to confer honorary degrees or other distinctions in (he manner as may be prescribed; (iv) to establish such specialized study centers or other units for research and development as are, in the op.inion of the University, necessary for the furtherance of its objectives; (v) to collaborate or associate with any educationav Research institution with like or similar objectives for the design and introduction of specialized standalone courses; (vi) to develop and maintain tinkages with educational or other institutions in, any part of the world having objectives wholly or partially sigilar to those of the University, through exchange of tcachers, students and scholars and generally in such manner as may be conducive to their common objectives; (vii) to develop and maintain relationships with teachers, coaches. researchers, experts, sports associations and federations in any part of the world for achieving the objectives of the University; (vifi) to establish, maintain and manage sports idfiustructure, halls and hostels for the residence of students and accommodation for faculties, officers and employees of the University; (Ix) to supervise and control the residence and to +egulate the discipline among the students of the University and to make an'angement for promoting their health and general welfare and cultural activities; (x) to institute and award fellowships, scholarships. Prizes, medals and other awards;
8. Powers of delegation
Subject to the provisions of this Act and the regulations made thereunder, any officer or authority of the University may, by order, delegate his or its powers (except the power to make regulations) to any other officer or authority under his or its control subject to the condition that the ultimate responsibility for the exercise of the powers so delegated shall continue to rest in the officer or authority delegating them.
9. Power of inspection and inquiry of State Government
(1) The State Government shall have the power to cause an inspection to be made by such person or persons as it may direct of the University, its buildings, sports facilities infrastructure, libraries, laboratories, museum, workshop, and equipment of any college, institution or center maintained or affiliated to the University, and also of the teaching and other works conducted by the University and of the conduct of examination held by the University, and to cause an inquiry to be made in like manner in respect of any matter connected with the administration, academic affairs and finances of the University or Colleges/Institutes. (2) The State Government shall in every matter referred to in sub-section (1) give notice to the University of its intention to cause an inspection or an inquiry to be made and the University shall be entitled to be represented thereat. (3) The State Government shall communicate to the University its views with reference to results of such inspection or inquiry and advise the University for the action to be taken in the matter. (4) Where the University does not, within the reasonable time, take action to the satisfaction of the State Government, the State Government may issue such directions to the University as it thinks fit and the University shall comply with such directions.
10. Officers and authorities of university
The following shall be the officers of the university, namely: (i) the chancellor; (ii) the Vice-Chancellor; (iii) the Directors; (iv) the Deans; (v) Head Coaches; (vi) the Registrar; (vii) Finance Officer; (viii) the Controller of Examinations; (ix) the Librarian; and (x) such other persons as may be declared by regulations, to be the officers of the University.
11. Chancellor
(1) The Governor shall be the chancellor of the university. He shall be the ex-officio head of the University and shall, when present, preside at any convocation of the University. (2) Every proposal for the conferment of any honorary degree shall be subject to the confirmation by the Chancellor. (3) It shall be the duty of the Vice-Chancellor to furnish such information or record relating to the administration of the affairs of the University, as the Chancellor may call for. (4) The Chancellor shall have such other powers as may be conferred on him by or under the Statutes.
12. Vice-Chancellor
(1) The Vice-Chancellor shall be whole time salaried officer of the University and shall be appointed by the Chancellor from amongst the persons whose names are submitted to him by the committee constituted under sub-section (3) in accordance with the provision of sub-section (2). (2) The person to be appointed Vice-Chancellor shall be:- (i) A visionary person with proven leadership qualities, administrative capabilities as well as teaching and research credentials in the field of Physical Education & Sports; and (ii) Having outstanding academic record throughout with a minimum of 10 years' experience as Professor / Director of physical Education in a University system / Seniomost Sports Administrator / Seniomost Sports Manager or an Eminent Sports Person who has experience of playing at International level. (iii) The Vice-Chancellor shall be citizen of India nor below the age of forty-years and not have attained the age of sixty-five years on the date of nomination. (3) The committee referred to in sub-section (1) shall consist of the following members, namely:- (i) One renowned person, from the field of sports, to be nominated by the Chancellor; (ii) One member nominated by UGC/ Regulatory Body; (iii) The Secretary incharge of the Sports Department of the State Government - Convener. (4) The Committee appointed under sub-section (3) shall, within such time and in such manner, as directed by the State Government, select three persons who possess the qualifications mentioned in sub-section (2) and whom it considers fit for being appointed to the post of Vice-Chancellor and shall recommend to the State Government, the names of the persons so selected, together with such other particulars as it may deem necessary. The State government shall forward the panel to the Chancellor for appointment of the Vice-Chancellor : Provided that if the Chancellor does not approve any of the persons included in the panel, he may call for an extended fresh panel. (5) Where the vacancy in the office of the Vice-Chancellor occurs due to expiry of the term, resignation, illness, leave or otherwise, and where the vacancy cannot be filled under sub-section (3) and (4), the Chancellor may appoint the senior Professor of the University, as the Vice-Chancellor, for a period not exceeding Six months or till the regular Vice-Chancellor assumes/resumes office, whichever is earlier. It may be extended only once for another six months: Provided that no inquiry or disciplinary action should be pending or under consideration against such person: Provided further that if the Chancellor does not find the suitable and senior Professor in the University, he may assign the work of the Vice-Chancellor to any other Vice-Chancellor of the State University, as additional charge, for a period not exceeding one year. (6) The Vice-Chancellor shall hold office for the period of three years and shall be eligible for reappointment for a further period of three years: Provided that a person shall not hold office of the Vice-Chancellor after he attains the age of sixty-five years. (7) The emoluments and other terms and conditions of the service of the Vice-Chancellor shall be such as may be determined by the State Government. (8) The Vice-Chancellor may resign from his office by writing under his hand addressed to the Chancellor and such resignation take effect from the date of acceptance. (9) A person shall be disqualified for being appointed, or for being a Vice-Chancellor, if - (i) he is a member of the Parliament or of any State Legislature or of any local authority, or (ii) he is a member of a political party; or (iii) he is or any time has been adjudged an insolvent, or (iv) he is of unsound mind or stands so declared by the competent court; or (v) he is or has been convicted of an offence which in the opinion of the State Government, involves moral turpitude.
13. Power and functions of the Vice-Chancellor
(1) The Vice-Chancellor shall have, subject to the provisions of this Act, power to cause an inspection or review to be made by such person or persons as he may direct, of the University, its buildings, hostels, libraries, sports infrastructure facilities, equipment, systems, processes and of any institution or center maintained by the University, and also of the examinations, teaching, research and other work conducted or done by the University and to cause an inquiry to be made in like manner in respect of any matter connected with the administration, academic affairs and finances of the University. (2) Without prejudice to the generality of the foregoing provisions, the Vice-Chancellor shall- (i) be the Chief Executive and academic officer of the University. He shall preside over the meetings of the Academic and Activity Council; (ii) ensure implementation of the decisions of the authorities of the University; (iii) be responsible for imparting of instructions and maintenance of discipline in the University; and (iv) exercise such other powers and perform such other duties as may be assigned to him/her by or under this Act by Statutes or the Regulations or as may be delegated to him by the Board. (3) Where any matter is of urgent nature requiring immediate action and the same cannot be immediately dealt with by the authority or body of the University empowered under this Act to deal with it, the Vice-Chancellor may take such action as he may deem fit and shall forthwith inform the action so taken by him/her to the authority or body of the University who or which, in the ordinary course, would have dealt with the matter: Provided that if such authority or other body is of the opinion that such action ought not to have been taken by the Vice-Chancellor, it may refer the matter to the Board which may either confirm the action taken by the Vice-Chancellor or annul the same or modify it in such manner as it thinks fit, and thereupon the action shall cease to have effect or, as the case may be, shall take effect in such modified form so however that such modification or annulment shall be without prejudice to the validity of anything previously done by or under the order of the Vice-Chancellor. (4) Where the exercise of the powers by the Vice-Chancellor under sub-section (3) involves the appointment of any person, such appointment shall be confirmed by the competent authority empowered to approve such appointment in accordance with the provisions of this Act and the regulations, not later than six months from the date of order of the Vice-Chancellor, otherwise such appointment shall cease to have effect on the expiration of a period of six months from the date of order of the Vice-Chancellor.
14. Directors
(1) The Directors of the university shall be appointed by the Vice Chancellor with the approval of the Board in such manner and on such terms and conditions as may be prescribed by the Statutes.
15. Deans
(2) The Directors shall assist the Vice-Chancellor in managing the academic, physical activities, administrative, financial and other affairs of the University and shall exereise such powers and perform sueh functions as may be prescribed or entrusted to them by the Vice-Chancellor. (I) The Deans shall be appointed by the Vice-Chancellor from amongst the faculties of the University by following the due process prescribed in the Statutes. (2) The Deans shall assist the Vice-Chancellor and Director of the University ifl managing the academic and other affairs of the University and shall exercise such powers and perform such functions as may be prescribed or entrusted to them by the Vice-Chancellor and the Director.
16. Headcoaches
(1) The Head coaches shall be appoiiited by the vice-Chancellor from amongst the coacliing faculties of tile University by following the due process of law. (2) The Head Coaches shall assist the Vice-Chancellor and Directoi. of the University in managing'the academic and other training affairs of the University center. for high performance training and shall exercise such powers and perform such functions as may be prescribed by the Statute or entrusted to them by the Vice-Chancellor and the Director.
17. Registrar
(I) The Registrar shall be a whole-time salaried officer of the University appointed by the State Goveinent, from the Centralized services as per noms of Regulatory bodies adopted by the State Government and shall be responsible to the Vlce-Chancellor: Provided that if the post of the Registrar remains vacant, due to any reason, the State Government in-consultation with the Vice-Chancellor may appoint a suitable person, from amongst the Professors of the University or Officers Of the State Government, till the regular Registrar joins/res\unes the offlce. (2) The Registrar shall exercise the following powers and perfom the following duties, namely: (i) he shall be responsible for the custody of records, cormon seal, the funds of the University and the property of the Uulversity; (ii) he shall place before the Board and other authorities of the Uulversity; all such infomation and documents as may be necessary for transaction of its business; (iii) he shall be responsible to the Vice-Chancellor for the proper discharge of his functions ; (iv) he shall be responsible for the administration of the University and conduct the examinations and make all other arrangements necessary there of .and be responsible for the execution of all processes connected there with; (v) he shall attest and execute all documents on behalf of the Uulversity; (vi) he shall verify and Sign the pleadings in all suits and other legal proceedings by or against the University and all processes in such Suits and proceedings inall be issued to and served on the Registrar; and (vii) he shall exercise such other powers and perform such other duties as may be assigned to him by or under this Act, the regulations or as may be delegated to hin by the Board or the Vice-Chancellor.
18. Finance officer
The Finance officer shall be appointed in such manner, and shall exercise such powers and perfom such duties,. as may be prescribed dy the Statutes: Provided that if Government considers appropriate, in c-onsultation with the Vice-Chancellor, it may depute a Government Officer to work as the Finance Offroer on such terms and conditions as the Government may prescribe.
19. Other officers of the university
The appointment and powus of other officers of the Uhiversity shall be such as may be prescribed by the Statutes from time to time.
20. The aut]ioT.ities oftheUniversity
The following shall be the authorities of the Urivusity, namely: (i) the Board; (ii) the Executive Council; (iii) the Academic and Activity Council; (iv) the Finance Committee; and (v) such <`btherauthorities as may be declared by regulatiods to be the authorities of the University.
21. Board
(1) The Board of the University shall consist or the following -members, namely :- (i) the Ch`ancellor, who shall be the Chairman of the Board; (ii)'th;viice{hade;uor; (iii) one Director of the University, by rotation, to be nominated by the Vice-Chancellor; (iv) One Head Coach by rotation, to be nominated by the Vice-ClrmceJlor; (v) four persons to be nominated by the State Government. (2) The Registrar shall be the Member Secretaiv of the Board.
22. Power and functions of Board
(I) Subje;t to the provisions of this Act, the Board shall be respon§ibl6 for the general superintendeiice, dii.ectioii and control of the affairs of the University and shall exercise all the powers of the University, and shan have ``the power to review the acts of the Academic and Activity Council, the Finance Committee an-d other committees or aulilorities of the University. (2) Without prejudice to the provisions of sub-section (1), the Board shall have the following powets and functions , namely: - (i) to take decisions on question of policy relating to the administration and working of the University, to review, riom time to time, the broad policies and programs of the University, and to suggest measures for the iminv6meutanddevelopmentoftheuniversity; (ii) to cbn§ider and approve the Annual Report and the annual budget Of the University for every financial year and to consider audit report of such account; (iii) to invest money and funds of the University.and to take decision on the recommendations of the finance com!nittee; (iv) to publish or'finance the publication of studies, books, periodicals, reports and other literature from time to time and to sell or arrange for the sale as it may deem fit; (v) to create or abolish posts of teachers, officers and employees of the University with the approval. of the State Govemmerty (vi) tg appoint such committees as it considers necessary for the exercise of its powers and performance of its duties under thi? Act; (vii) to delegate any of `jt§ power to the Directors, Deans, Registrar, Head Coaches or any other officers, erpp]oyee or authority of the University or to a committee appo.tnted by it; and (viii) to exercise such other powers and perfonn such other functions as may be conferred or imposed upon it by or under thislAct or the regulations, and such other powers for achieving the object of the University. (3) Save as o,therwise provided in this section, the .temi of a member of the Board nominated under clauses(iii). (iv) and (v) of sub-section (1) of section 21 shall be three years from the date of his nomination. (4) A member nominated under clauses (iii), (iv) and (v) i of sub-section (I) of .section 21 may resign from his office by writing under his hand addressed to the chaimran and his resignation shall take effect from the date of its acceptance by the chairman.
23. Executive. Coune`il
(1) The Executive council shall be the principal executive body of the university. (2) The Executive Council shall consist of the following persons, namely- (a)Vice-Chancenor;:Chairperson(ex-officiomember); (b) Secretry to Goverrment of uttarakhand, Department of Sports (ex-offici'o member); (c)SenetarytoG;vemmentofuttaralchand,Daparfuentof Finance(ex-officio.member); (a)DireetorSports,Uttarakhand(ex-officiomember); (€) Secretry General Uttardkhand Olympic Association (ex-officio member); (D Subject to provisions of this Act, in addition to ex-.officio Members specified in this Act the Executive Council shall have following members, mmely:- (i) One Dean by rotation; (ii) three Senior Professors by rotation; (iii) three persons from anongst the sports scientists, sports administrators, eminent sports persons and distin.guished coaches nominated by the Government. (iv) one member nominated by the Chancellor amongst from the eminent sports persons / educationists . (3) The nominated members or those members, who are to be members, by rotation shall hold office for a period of two yes.
24. Powers of executive council
(1) Subject to the provisions of this Act and the Strfutes/ Ordinances made thereunder, the Executive Council shall exercise the following powers and perfom the following[functions,namely: (a) to decide matters related to the University and to . examine and approve the recommendrtious /minutes of various authorities and committees, decided or referredbyanyofficerorauthorityoftheUniver;ity; (b) to appoint from tine to time, teachers, officers and equivalen-t staff and on other Grade-A Posts, as per regulation of the ulversity Grants Commission or Regulatory Bodies, bn the recommendations of selection committees and also to appoint other employees of the University; (c) to decide matters related to grant of afrmation to sports and physical education colleges under State Public Uhiversity; (d) to allocate /re-allocate the funds and to ensure the expenditure within thg.' annual 'budget of the University; (:) `to decide 'inout'all kind of mtters related to degrees, diplomas, awards etc; ® to acqinire / Purchase or dispose of / sell the property and assets of the University, as and when required, with prior permission of the State Government; (g) to make and amend the Statutes and Ordinances of the r Uhiversity for "various authorities, officers and functions of the University, within the frame wol.k of this Act and guidelines of the State Government;
25. Powers and functions of Academic and Activity Council
(h) to recommend creation of teaching as well as non-teaching posts at various levels to the State Government/ Centre Ggvemment; (i) to exercise such other powers and duties as may be prescribed in the Statutes/Ordirmces. (1) The Academic and Activity Council of the University shall consist of the following members namely: (i) the Vice-Chancellor: Chairperson; (ii) two academicians or professionals, to be nominated by the Board/ Executive Council; (iii) two academicians or professionals in the field of riysical education and sports sciences, who liave achieved distinction in Olympics or World championship: nominated by the Executive Counci I/Board; (iv) the Director of the University; (v) on?beanoftheUniversity,byrotatjon,tobenominated by the Vice-Chancelldf; (vj) one Head Coach, by rotation, to be nominated by the Vice-Chancellor; (vii) one professor from each faculty of University department, byJ rotation, to be nominated by the Vice-Chancellor; (viii) The Registrar : Member Secretary. (2) The term of office of the members nominated under clauses (ii), (iii), (v), (vi) and (vii) of sub-section (1) shall be ttree years. Subject to the provisions of this Act and the Statutes/Regulations made thereunder., the Academic and Activity Council Shall ?xercise the following powers and perform the following functions, namely: - (1) exercise control o;er the academic policies of the University and Pe responsible for the maintenance and improvement of standards of instruction, education and evaluation in the University. (2) consider matters of general academic intei'est either on its own. initiative or .on a reference from the faculty of the University or the Board and to take appropriate action thereon.
26. Powers and functions of Academic and Activity Council
(3) recommend to the Board, such regulations as are consistent with this Act regarding the academic functioning of the University including discipline among students, and (4) exercise such other powers and perform such other functioiis as may be corferred or imposed upon it by the regulations.
27. Finance Committee
(1) The Finance Committee shall consist of the following members naniely : (a) The Vice-Chancellor: Chairperson; (b) two members of the Board (one of them ,shall be a Goverment nominee of the Board); to be nomin;ted by the Board; (c) Finance officer: Member Secretary; (d) one expert in the field of finance, to be nominated by the Board; (e) one pi.ofessor, by rotation, to be nominated by the Executive Council; (f) one I-Iead Coach, by rotation to be nominated by.the Executive Council; (g) The Registrar. (2) The term of office of the membei.s nominated under clauses a). (d), (e) and (D shall be three years.
28. Power and functions of the Finance Committee
Subject to the other provisions of this Act, the Finance Committee shall exercise the following powers and. perform the following functions, namely: (1) to examine the annual accounts and annual budget estimates of the University and to advise the Board thereon; (2) to review from time to time the financial position of the University; (3) to make recommendations to the Board on all financial policy matters of the University; (4) to make recommendations to the Board on au proposals involving raising of funds, receipts and expenditLire; (S) to provide guidelines for investment of surplus funds; (6) to make recommendations to the Board on all proposals involving expenditure for which no provision has been made in the budget or which involves expenditure in excess of the amount provided in the budget needs to be incun.ed; (7) to examine all proposals relating to the revision of pay scales, up gradation of the scales and those iteins which are not included in the budget prior to placing before the Board, and (8) to exercise such other powers and perform su;h other functions as may be conferred or imposed upon it by the regulations.
29. Other authorities of the university
The constitution, powers and functions of other authorities, shall be such as may be declared by the Statutes.
30. Affiliation
(1) The Executive council may, with theprior sanction of the State Government, affiliate any sport college/institution of the State which fulfils such conditions of affiliation, in a manner as may be preschbed by the Statutes : Provided that unless all the prescribed conditions of affiliation are fulfilled by a college/institution, it shall not admit any student in the fist year of the course of study for which affiliation is- granted under forgoing provisions. (2) A sports college or institution applying for affiliation to the University shall submit an online application with e-Sign in the prescribed fomat, provided by the University, to the Registrar, six months prior to the proposed date of starting the college/ course. (3) Any college or institution applying for affiliation Shall apply online along with such documents, information, fees and security in such manner and shall fulfill such noms and criteria as may by prescribed by qe State Government or by the Statutes. (4) The College/Institution should have required land, Infrastructure, teaching faculty and other facilities for a sports college as per guidelines issued by respective regulatory bodies, concerned with the discipline, and the norms of the State Government/ sports University. (5) The procedure for processing the received appli9ations, inspection of the sports college for affiliation by the committees and decision on granting the affiliation by the Executive Council,.shall be as prescribed in the Statutes or guidelines issued from time to time by the State Government or by the University. (6) Notwithstanding anything to the contrary contained in any other provisions of this Act, a sports college/institution, which has already been given affiliation by a University before the commencement of this Act in specific subject for a specified period shall be entitled to continue the course of study for which admissious have already taken place but it shall not admit any Student in the first year of such course of study without obtaining affiliation under sub-section (1).
31. Extension of affiliation
Where an,affiliated sports college/institution desires to add the courses, of instruction in respect of which it is affiliated, the procedure prescribed under section 30 and by the Statues shall be followed.
32. Inspection of affiliated colleges
(1) Every affiliated college shall furnish such reports, rettrms and other infomation as the Board/ Executive Council, after consulting the Academic and .Activity Council, may require in order to assess the efficieney of such college. (2) The Board/ Executive Council shall cause every such sports college/ institution to be inspected from time to time by the inspection committee consisting of the Vice-Chancellor who shall be the Chairman and such other members, as may be appointed by the University in accordance with the Statutes. (3) The Executive Council shall consider the report of the Inspection committee while deciding the affiliation proposals.
33. Withdrawal of affiliation
(1) The privileges of affiliation of a college which fails to comply with any direction of the Executive Council or cany out any of the provisions of this Act or the Statutes, related to fulfillment of any conditions of affiliation may, after obtaining a report from the Management of the college/ institution and with the prior sanction of the State Goveniment, be withdrawn or curtailed by theo Executive Council in accordance with the provision of the Statutes made for this prpose. (2) The other conditions and procedure for the withdrarml of the affiliation of the Collegethstitution shall be as prescribed in the Statutes or the norms of the Uulversity/ State Government made in this regard.
34. Appeal against withdrawal of affiliation
Any cbllege aggrieved by the resolution withdrawing wholly or partly or modifying the rights conferred by armiation passed under section 33, may make an Appeal to the state Government within 60 days from the date of commiihication of the resolution and decision of the State Government on such appeal shall be fmal.
35. Reduction in grant
The BoardAlxecutive Council may, on the recomniendatl.on of the Academic and Activity Council, recommend the State Government to withhold or reduce the grant to an affiliated college which, on a report by inspection committee or otherwise, is found to be making persistent default in canying out the conditions of affiliation.
36. Post graduate teacl,ing
All the post-graduate instructions, teaching and trainng shall be conducted by the University or by the affiliated c.ollege in such subjects as may be recognized by the University.
37. Permanellt endowment fund
There shall be a "Permanent Endowment Fund" to which the State Government shall make an initial contribution of Rs. 10,00,00,000 (ten crore). The method of raising Endowment Fund.and tlie investment of the surplus shall be such as may be prescribed.
38. Payment to University by State Government
The State Government shall pay to the University from time to time such sum of money and in such manner as may be considered necessary for the exercise of powers and discharge of its functions by the University under this Act,
39. Funds of University
(1) The university shall establish a fundtobe called the 'University Fund' consisting of - (i) any contribution or grants or loans by the State Government and Central Government; (ii) the income of the University from all sources including income from affiliation fees and charges; (iii) the moneys received by the University by way of grants, loans, gifts, donations. benefactions, bequests or endowments and othei. grants, if any;
40. Account, Audit and report
(1) The University shall maintain proper accounts and other relevant Accounts, records and prepare an annual statement of accounts, including the income and expenditure accounts and the balance sheet, in such form and in such manner as may be prescribed. (2) The University shall adopt a proper system of internal checks and balances and control in the discharge of its financial, accounting and auditing functions as may be prescribed. (3) The audit of the accounts of the Uulversity shall be carried out by the Examiner State Audit department. (4) Special audit shall be carried out by tlie Comptroller and Auditor General of India or by such persons as. he may authorize in this behalf (5) The audit report of accounts referred under sub-section (3) shall be placed before the Board and the Board may issue such instructions to the Uulversity in respect thereof as it deems fit and the University shall comply with such instructions. (6) 1lie University shaH prepare for each year an annual repbil of its activities of the previous year contalningi such particulars as tlie Board/ Executive Council may specify and submit the same in the form of armunl report to the Board on or before such date as may be prescribed, for re`Jiew and approval. (7) The copy of the annual report and annual audit report along with the resolution of the Board thereon shall be submitted to the State Government.
41. Pension
All officers, teache,rs and other elnployees who are in the nature of permanent employment of the University shall be members of the New Pension Scheme of the State Government.
42. Powers and functions of the University
(xi) to purchase or to take on lease any land or building or sports complex or sports infra-structure and scientific sports research equipment or indoor stadium on works, which may be necessary or convenient for the purpose of the University, on such terms and conditions, as it may think fit and proper. and to construct, alter and maintain any such buildings or works; (xii) to sell, exchange, lease or otherwise dispose of all or any portion of the properties of the University, movable or immovable, on such terms as it may think fit, consistent with the interest, activities and objectives of the University, after taking prior permission of the State Government; (xiii) to execute conveyances regarding transfers, mortgages, leases, licenses, agreements and other conveyances in respect of the property, movable or immovable including Government securities belonging to the University or to be acquired for the purpose of the University, after taking prior permission of the State Government; (xiv) to send proposals to the State Government for creation of academic, technical, administrative, ministerial and other posts and to make appointments thereto either on permanent post or on temporary post or on contractual basis against such posts ; (xv) to institute professorships, associate professorships, assistant professorships, readerships, lectureships, endowed professorship, honorary professorships, adjunct professorships, emeritus professorships, of different sports and games and any other teaching, academic or research posts for sports sciences as per qualification prescribed by the UGC Regulatory bodies and with prior approval of the State Government; (xvi) to appoint persons as Director, Deans, Professors, Associate Professors, Assistant Professors, Readers, Lecturers, Head Coaches, Coaches, Trainers, Adjunct Professors, or otherwise as Teachers and researchers of the University against the posts sanctioned by the State government; (xvii) to regulate and enforce discipline among the employees of the University and to provide for such disciplinary measures as may be prescribed by the Statutes/Ordinances made under this Act; (xviii) to perform all such other acts as the University may consider necessary, conducive or incidental to the attainment or enlargement of all or any of the objectives of the University; (xix) to be admitted as a student of the University or in any affiliated course of the University in any college/institution. a student must have at least won a medal/prize at the District Level Sports Competition in an Olympic Sports; (xx) to appoint to the post of Vice-Chancellor of the University, a person as per the qualification prescribed under section 12 of this Act; (xxi) to have liaison or membership with various international professional organizations or bodies; (xxii) to co-operate or collaborate or associate with any other University. or authority or institution of higher leaning, including those located outside the country, in such manner and for such purposes as the University, may determine; (xxiii) to act as a technical advisory body to State Government and State/National Sports Federations on all matters related to sports; (xxiv) to admit to its privileges any College or Institution in or outside India subject to such conditions as may be laid down by the Statutes; (xxv) to recognize persons for imparting instruction in any College or Institution admitted to the privileges of the University. (2) Academic, curriculum and research related powers and functions : (i) to run a Bachelor/ Master Degree/ Diploma and Certificate courses in sports/ Physical Education and related fields; (ii) to admit sportspersons who have proven their sports talent at the district level and ready to join the university and to groom sportspersons at an early stage (e.g. age of 12 years onwards) so that they can join the University at a later stage; (iii) to provide for instruction, coaching, training and research in such branches of knowledge or learning pertaining to the physical education, sports sciences, sports technology and high-performance training for all sports and games; (iv) to conduct innovative experiments in new methods and technologies in the field of sports sciences, technology and management in order to achieve scientific sports training system for all sports and games and international standards of such physical education, sports training and research in sports sciences; (v) to prescribe courses and curriculum and provide for flexibility in the education system and delivery of methodologies including open electronic and distance learning; (vi) to provide for e-publishing, printing, reproduction and publication of research and other work and to organize exhibitions, workshops. seminars, symposia, conferences competitions; (vii) to sponsor and undertake research in all aspects of physical education and sports sciences, sports technology. allied areas and high-performance training for all sports and games; (viii) to admit the students for the courses offered by the University in the prescribed manner; (ix) to provide vocational guidance and placement services in field of sports and its allied activities; (x) to organize and to undertake extramural studies, training and extension services; (xi) to determine standards of admission to the university, which may include examination, evaluation or any other method of testing; (xii) to provide training, coaching and other backup to high level sports persons for achieving success in different national and international sports competition; (xiii) to provide for the preparation of instructional and training materials, including films, cassettes, tapes, video cassettes and other software; (xiv) to provide for semester system, continuous evaluation and choice-based credit system and to enter into agreement with other Universities and academic institutions for credit transfer and joint degree programs; (xv) to ensure active participation of students in all academic activities of the University. including evaluation of teachers. (3) Finance related powers and functions: (i) to regulate the expenditure, manage the finance, and to maintain accounts of the university; (ii) to receive grants, subventions, subscriptions, donations and gifts for the purposes of the University and consistent with the objectives for which the University is established and to enter into any agreement with the Central Government, the State Government, PSUs, the University Grants Commission, or other authorities or bodies for receiving any grants; (iii) to receive funds from the industries, associations, federations or from any other sources as gifts, donations, benefactions or bequests by transfer of movable and immovable properties for the purposes and objectives of the University; (iv) to fix, demand and receive or recover fees and such other charges as may be prescribed; (v) to draw and accept, to make and endorse, to discount and negotiate Government promissory notes and other promissory notes, acts of exchange, cheques or other negotiable instruments; (vi) to raise and borrow moneys on bonds, mortgages, promissory notes or other obligations or securities founded or based upon all or any of the properties and assets of the University or without any securities and upon such terms and conditions as it may think fit and to pay out of the funds of the University, all expenses incidental to the raising of moneys, to repay money borrowed, after taking prior permission of the State Government; (vii) to invest the funds of the University in accordance with the provisions of the Act. (4) Miscellaneous powers and functions: (i) to maintain all reports of activities, finances etc: in public domain in a web portal; (ii) to give effect to the procedures and standards provided under the Khelo India Scheme or the National Sports Talent Search and Identification Scheme: (iii) accreditation shall be obtained from the National Assessment and Accreditation Council or any other accrediting agency at the national level; and
43. Conferment of degrees and their academic distinctions
Notwithstanding anything contained in any other Stale law for the time being in force, the University shall have powers to confer degrees, diplomas and grant cerlificates and confer honorary degrees and other academic, distinctions and titles approved by the Board/ Executive Council.
44. Returns and information
The University shall furnish to the State Govemment` University Grants Commission and other statiitory authorities. such reports, returns, statements and. other infoi.nation with respect to, its properties or activities, within such period as may b`e required by them from time to time and upload the same on its website and designated portal.
45. Employees to be a public servant
Every officer, teacher and employee of the University shall be deemed to be a public servant within the meaning of section 2 (28) of Bharatiya Nyaya Sanhita 2023. Explanation:T Foi. the purpose of this section, any person, who is appointed by the University for a specified period or a specified work of the University or who receives any i-emuneratioii by way of allowances or fees for any work done from the University Fund, shall be deemed to be an officer or employee of the University while he is performing the duties and functions connected with such appointment or woi.k.
46. Conditioii§ of service of employees
(1) Every employee of the University shall be appointed under` :a wi.itten cohtract` which shah be lodged with the University and a copy of which shall be funished to the employee concerned. (2) Any dispute arising out of the.`contract between the university and any employee shall, at the reqiiest of the employee, be referred to at tribunal of Arbitratioii consisting of one member appointed by the Executive Council, one member nominated by the employee concerned and one arbitrator appointed by the State Government. (3) The decision of the Tribunal shall be final and no suit shall lie iii' any civil court in respect of the matters decided by the Tribunal: Provided that nothing in tliis sub-section shall preclude the employee from availing ofjudicial re.medics available under article 32 and 226 of the Constitution of India. (4) Every request made by the employee under sub-section (2) shall be deemed to be a submission to arbiLi.ation upon the terms of this section within tlie meaning of` the Arbitration and Conciliation Act,1996. (5) No officer or employee or member of the teaching, non-teaching and other academic staff of the University shall be dismissed or removed or I.educed in rank except after an inquiry in which he has been infomed of the cliarges against himther and after giving a reasonable opportunity of being heard in respect of those charges. (6) An appeal against an order of dismissal, removal or reduction in rank under sub-section (1) or ortermination of sei.vice shall be made to the Vice-Chancellor within ninety days from the date of communication of such order and the decision of the Vice-Chancellor in such appeal shall be fmal.
47. Power of State Government to give direction
The State Government sham have powers to issue.directions from time to time as may be required for compliance of the provisions of this Act and the regulations made thereunder and any other law for the time being in force and the University shall be bound to comply with such directions.
48. Powier to make statutes
(1) Subject to the provisions `of this Act the Statutes may provideforalloranyofthefollowingmatters: (a) the.constitution, powers and functions of authorities and other bodies of the Uulversity. the appointment and term of members of the said authorities and bodies, the filling xp of vacancies of members, conditions for conducting the meetings of authorities and all other related matters therein; (b) appointment, powers, service conditions and duties of the Vice-Chancellor, officers, teachers, academic. staff and other employees of the University and their emoluments, funds, pension and all other related matters; (c) the conditions of granting and withdrawal of the affiliatious of the colleges, holding convocation, award of degrees, diploma, fellowship, eto., recommend creation or abolition of posts, decision in the matters related to fee and affiliation etc; (d) ther management of Colleges, Institutions, Regional C?nters and Study Centers established and maintained by the University and the maintenance of discipline among the employees and students; (2) Statutes how to be made: (a) The first Statutes of the Universities establiched or incorporated under this Act Shall be made by the Executive Council and shall be submitted to the State Government for its approval within three months after the commencement of this Act; Provided that after examining the Statutes the State Government shall eiiner forward it to the Chancellor or return to the Executive Councireoard of Management for any modification, within 90 dys after receiving it from the University: Provided further that the Chancellor chall either give his assent to the Statutes or return it to the State Government for any modification, within 90 days after receiving it from the State Goverment. a) The Executive council may, from tine to time, make new or additional Statutes or may amend or repeal any Statutes referred to in sub-section (1): Provided that the Executive Council shall not make, amend or repeal any Statutes affecting the status, powers or constitution of any authority of the Univers'ity until such authon.ty has been given an opportunity of exjlressing an opinion in writing on proposed changes, and any opinion s.o expressed shall be cousidefed by the Executive Council; (b The fust Statutes mari: under this Act shall be published in the Official Gazette of the State after the approval of the Chancellor;
49. Power to make Ordinances
(d) Every new Statute or addition to the Statutes or iny amendment or repeal Of existing Statutes, proposed try the' Executive Council shall be sent to the State Government for the approval of the Government and unless so approved, they shall be invalid; (e) Not with standing anything contained in the foregoing sub-section, the State Government may make new or additional Statutes or amend or repeal the Statutes referred to in sub-section (I), during the period of three years irmediately after the commencement or this Act: Provided that the State Government may, on the expiry of the said perio,d of three years, make, within one year from the date or such expiry, such detailed Statutes, as it may cousidernecessary. (f) The power to make Statutes, Ordinances or Regulations shall include the power to give retrospective effect, from a date not earlier than the date of commencement of this Act to the Statutes, the Ordinances or. the Regulations or any of them but no retrospective effect shall be given to any Statutes, Ordinances or Regulations so as to prejudicially affect the interest of any person to whom such Statutes, Ordinances or Regulations. may be applicab,e. (1) Subject to the provisions of this Act and Statutes, the Executive Council, in consultation with the Academic and Activity Council, shall make Ordinances to provide for the administration and management of the affairs of the Uulversity. (2) In particular and without prejudice to the gen.erality of the foregoing powers, such Ordinances may provide for all or any of the following matters, namely: (i) the pro.cedure and criteria to be followed in establishing courses of study, curriculum, admission & eurolment ofstudentsandmediumofinstructionandexamination; (ii) the degrees, diplomas, certificates, and other academic distinctions and titles which may be confened or granted by the Uulversity and withdrawal or cancellation of any such degrees, diplomas, certificates and other academic distinctions and titles and the requirement thereof; (iii) the conduct of examinations, including the term of office and manner of appointment and the duties of examining bodies, examiners and moderators; (iv) the fees and other charges to be paid to the Uulversity for the courses, training, facilities, examination and services provided by it; (v) the establishment of Centres of Studies, Board of Studies,. Specialised Laboratories and other Conrfuttees; (vi) the creation, composition and functions of any other body which is considered necessary for improving the academic life of the University; (vii) the tens and conditions governing fellowships, Scholarships, stipends, medals and prizes; (viii) the terms and-conditions for association of the University with other institutions; (ix) the prepantion of budget estimates and mainteriance of accounts; (x) the mode of execution of contract or agreem;nts by or onbehalfoftheUhiversity (xi) the classification and procedure for appointment of officers, employees and other staff of the University; (xii) the tens and conditions and the tenure of appointment, salaries and allowances, contractual services, rule of discipline and other conditions of service of the Director, Head Coaches, other officers, teachers and employeesoftheUulversity; (xiii) the terms and conditions governing deputation of teachers, officers and employees of the University; (xiv) the authentication of the orders and the deofsions of the Board; (xv) the procedue to be followed for enforcing di§oipline in the Uhiversity; (xvi) thesettingupofamachineryforredressalofgrievancesofemployeesandstndents; (xvii) themanagementofthepropertiesoftheUniversity; (xviii) the matters relating to hostel for students and halls of residence and housing for faculties, officers and employees and guest house including disciplinary control therein; and (xix) any other matter which, by this Act or the Statutes, is to be or may be, provided for by the Ordinances. (3) The first Ordinance shall be made by the Vice-Chancellor with previous approval of the Executive Council and the Ordinance so made may also be amended or repealed at any time by the Executive Council in the mamer prescribed by the Statutes.
50. Regulations
The authorities of the University may make Reg`ilations consistent with this Act, the Statutes and the Ordinances, for the conduct of their own business and that of the Committees, if any, appointed by them and not provided for by this Act, the Statutes or the Ordinances, in the manner prescribed by the Statutes.
51. Transitory provisions
Notwithstanding anything contained in section 12, the fil.st Vice-Chancellor shall be appointed by the State GoverrmenL as soon as practicable after coming into force of this Act for a period not exceeding one year on such terms and cbnditions as it may tlink fit.
52. Appointmellt of first Registrar
Notwithstanding anything contained in section 17, the fust Registrar shall be appointed by the State Govei.nment as soon as practicable after the commencement of the Act, for a period not exceediiig three years and on such coiiditions as the State Government thinks fit.
53. Number of members in first Board, Executive Council and Academic and Activities
Notwithstanding anything contained in section 19:- (a) The first Board of Governors and the first Executive Council shall consist of not more than twenty one and eleven members respectively, including the ex-officio members, who shall be nominated by the Government and shall hold office for a term of thee years; and (b) the fit.§t Academic and Activity Council shall consist of not moi.e than twenty-one members, wlio shall be nominated by the Govemnent and they shall hold office for a term of three years:
54. Temporary appointment of Vice-chancellor
Notwithstanding anything contained in this Act, the Vice Chancellor may, with the prior approval of the Board and subject to availability of the funds, discharge all or any of the functions of the University for the purposes of carrying out the provisions of this Act and the regulations and. for the purpose, may exercise any power or perform any duty which by oi. under this Act and regulations is to be exercised or performed by any authority of the University until such authority comes into existence in accordance with the provisioiisof:hisActandtheregulations.
55. Protection of action taken in good faith
No suit, prosecution or other legal proceedings shall lie against and no damages shall be claimed from the Uni`Jersi[y` the Vice-Chancellor, the Chal.rman, the Director` the authorities or officers or employees of the University oi. any other person in respect of aliything which is done or puporting to be done in good faith in pursuance of the provisions of this Act or.any regulations made there under.
56. Grievance redreesa]
As per regulations of the UGC, there win be a Grievance Redressal cell in the University, constituted in the manner prescribed in the Statutes/Ordinances, for resolving the grievances of the Students and teachers.
57. Mode of proof of University records
A copy of any receipt application, notice, order proceeding or resolution of any authority or other body of the thiversity or any other document in possession of the University or any entry in any register duly maintained by the University, if certified by the Registrar, shall be received as prima facje evidence of such receipt application, notice, order, proceeding, resolution or docuinent or the existence of entry in the register and shall be admitted as evidence of the matters and transactions therein where the original thereof would, if produced, have been admissible in evidence..
58. Power to remove difficulties
(1) If any diffic`ulty arises in giving effect to the provisions of this Act, the State Government may, by order whether by way of modification, addition or omission, as it may deem necessary or expedient published in the Gazette, makesuchprovisions.iiotincousistentwith.theprovisions of this Act, as may appear to be necessary for removing difficulties: Provided that no such order shall be made under this section after the expiry of two years from the date of commencement of this Act. (2) Every order made under this section shall be laid. as soon as may.be after it is made, before the Stare legi;lature.
59. Repcal and Savings
(1) The Uttarckhand State Sports University Oidinance, 2024 (Uttarakhand Ordinance No. 6 of 2024) is hereby repeded. (2) Notwithstanding/such repel, anything done or any action taken under the said Ordinance shall be deemed to have beendoneortakenunderthecorrespondingProvjsionsOf 1 thisAct.
