Provision of penalties

(1) Whoever contravenes the provisions of this Act or the rules made there under for any examinations related matters or in matters relating to the admissions and award of degree or in giving mark sheets or fee related matter or matter related to appointment of Faculty, shall on conviction be punishable with fine of such amount as may be notified by the State Government from time to time; Provided that, where the University is also involved in committing the offence, the authorization letter, issued by the Government under this Act, to operate the University shall be withdrawn. (2) No Court lower than the court of a Magistrate of the first class shall try an offence punishable under this Act, nor shall cognizance of any such offence be taken except on a complaint made by the Principal Secretary/ Secretary, Department of Higher Education Government of Uttarakhand or any other person authorized, in writing by him, by general or special other order in that behalf. (3) Penalty under this Section may be imposed without prejudice to the penalty specified in any other Act.
