Vacancy not to effect the constitution of Board or committee

(1) No act or proceeding of the Board thereof shall be called in questioned or invalidated on the ground merely of the existence of any vacancy or any defect in the constitution of the Board, as the case may be. (2) All persons discharging there functions under this Act shall be deemed to be Public servants within the meaning of Section 21 of Indian Penal Code 1860.
