The Tripura Freedom Fighters Pension Rules, 1992
4. Entitlement
The Freedom Fighters who are in receipt of Freedom Fighters Pension under Freedom Fighters Pension Scheme, 1972 now called as Swatantrata Sainik Samman Pension from Central Revenues shall be entitled to State Freedom Fighters Pension at the rate of Rs. 100/- (Rupees one hundred) per month with efiect from lst January, 1992.
5. Sanctioning Authority
Pension will be sanctioned to the Freedom Fighter by the Sanctioning Authority after due approval of the competent authority irrespective of their income.
6. Nature of Pension
Pension under this Rules, will be in addition to the Central Pension.
7. Multiple Pensions
Freedom Fighters who are getting State Pension from any other State Government but residing in Tripura, shall not be entitled to the Pension at the Government of the State of Tripura under these rules.
8. Residential Requirement
Freedom Fighters and their widows or their un-married and unemployed daughters under these Rules should be permanent residents of the State of Tripura in order to be eligible for grant of State Pension under these Rules.
9. Duration of Pension
The Pension shall be payable till death in the case of freedom fighter. If the grantee is the widow of a freedom fighter, the pension will be payable till her death or re-marriage and in case of daughters until they are married or otherwise become independent.
10. Cancellation and Recovery
A pension sanctioned under these Rules shall be cancelled with retroactive effect if it is found that sanction was given on mistaken grounds or on a false claims made by the applicant. The recovery of the wrongly drawn amount of pension in regard to persons who were sanctioned on mistaken grounds will be waived by the State Government. However, the recovery of wrongly drawn amount will be made from persons who have drawn pension by means of impersonation or on production of false documents.
11. Residency outside State/Country
(a) The pension sanctioned under the Rule shall be payable also when the pensioner leaves the State after sanction of pension to reside in another State in the Country either temporarily or permanently. In such cases, the pensioner shall intimate the sanctioning authority sufficiently in advance his intention to leave the State and give the correct address of residence outside the State, but within the country. In such cases the pensioner shall submit to the sanctioning authority and the Accountant General, Tripura a life certificate once in a year. (b) The Pension is liable to be suspended if the pensioner leaves India for short or long periods. In such cases, the pension suspended may be revived on his return to his native place and arrears paid for entire period. The pensioner shall intimate his intention to leave India sufficiently early to the Political Department, Government of Tripura specifying the date on which he desires to leave India. Similarly, he shall also intimate his intention to return to his native place sufficiently early specifying the date of return.
12. Procedure-How to Apply
The persons who are entitled to State pension under these Rules should apply in the prescribed form affixing passport size photo. Form duly filled and supported by documents should be sent to the Secretary to the Government of Tripura, Political Department, Civil Secretariat, Agartala. Form may be had from Political Department, Office of the All District Magistrates/Sub-Divisional Officers free of cost. The applicants should furnish documents indicated below with the applications :— (a) Photo copy of P.P.O. drawing Freedom Fighters Pension from the Central Revenues duly attested by a Magistrate/Gazetted Officer of the Government of Tripura. (b) Copy of the order sanctioning freedom fighters Pension by the Ministry of Home Affairs, Government of India duly attested by a Magistrate/Gazetted Officer of the Government of Tripura. (c) Affidavit regarding permanent resident of Tripura accompanied by resident certificate from the concerned District Magistrate. (d) Pension drawal certificate from the Treasury or Bank authority where from pension is being drawn.
13. Issue of Sanction Letters
After applications are scrutinised and found correct, sanction will be issued and conveyed to the Accountant General, Tripura with a copy to each grantee.
14. Mode of Payment
On receipt of sanction order, the Accountant General, Tripura will issue P.P.O. authorising the concerned Treasury Officer to make payment of the pension to the grantee through Treasury or authorised Bank as may be opted by the grantee in writing on production of identification documents which will consist of:— 1) Joint photograph (4 copies duly attested by a Magistrate/Gazetted Officer). 2) Identification marks. 3) Specimen signature or left thumb impression duly attested by a Magistrate/Gazetted Officer. 4) Date of Birth. 5) Nomination. On furnishing these documents, the Treasury will commence payment of pension.
15. Payment Channels
This pension Rules permit drawal of pension through Treasury or through authorised Bank.
16. Succession/Life-time of Recipient
Except in case of un-married daughters, the pension is for the life time of the recipient. In the case of un-married daughters, pension ceases immediately after they are married or become otherwise independent. In the case of death of a pensioner, his/her spouse though otherwise eligible for pension will automatically succeeded to such pension. They shall have to apply with proof of death of the pensioner to the pension Disbursing Officer for issuing the pension to the spouse of the deceased. However, the un-married and un-employed dependent daughter of the freedom fighter will have to apply afresh to the competent Authority for sanctioning pension along with the following documents. i) Certificate from the Sub-Divisional Officer of the Revenue Sub-Division of the District in which she is resident of her relationship to the deceased freedom fighter, her age and un married status-independent, and that she has no independent income and was totally dependent upon the deceased freedom fighter. ii) Permanent Resident Certificate from the Sub-Divisional Officer/District Magistrate.

(a) These Rules may be ealled "The Tripura Freedom Fighters Pension Rules, 1992". (b)Theseshallex§tendtothewholeoftheStateolpum. (0) These Rules shall come into forée from lst January, 1992.
2. Applicability. Applicability.
Save as otherwise provided by or under these Rules. These Rules shall apply to:— (a) Freedom Fighters who are drawing pension under the Central Pension Scheme. (b) In the event of the death of such Freedom Fighter while enjoying Central Pension, his widow or tin-married tin-employed daughter.
3. Definition. Definition.
In these Rules, unless the context otherwise mm3—l (a) "Governor" means the Governor of Tripura. (b) "State" means the Government of the State of Tripura. (c) "Central Pension" means pension sanctioned by the Government of India to the Freedom Fighter from Central Government Revenues under Freedom Fighters Pension Scheme, 1972 now renamed as Swatantrata Sainik Samman Pension Scheme, 1980. (d) "Freedom Fighter" means a person who had participated in the freedom struggle against the British Government in India and who: (i) had undergone internment for not less than six months o1' (ii) had been kept under detention for not less than 6(six) months, or (iii) had been convicted and sentenced to imprisonment for not less than 6(six) months, or (iv) had been absconding from Home for not less than 6(six) months, or (v) had remained underground for more than 6(six) months consequent upon the British Government action. (e) "Freedom fighters" means a person who took part in a movement, to liberate India from the British Government in India. (f) "Sanctioning authority" means Political Department, Government of Tripura. (g) "Accountant General" means the Accountant General, Tripura. (h) "Competent Authority" means the Government of Tripura. (i) "State Pension" means pension under this Rules.
