न्यायालय िुल्क (दिल्ली संिोिन) अविवनयि, 2026 (2026 का दिल्ली अविवनयि 01) (9 जनिरी 2026 को राष्ट्रीय राजिानी क्षेत्र दिल्ली की वििानसभा द्वारा यर्ा पाररत)

एक अविवनयि न्यायालय िुल्क अविवनयि, 1870 (1870 का 07) िें राष्ट्रीय राजिानी क्षेत्र दिल्ली िें प्रितयन के वलए आगे संिोिन करने हेतु अविवनयि।

भारत गणराज्य के सतहत्तरिां िर्य िें राष्ट्रीय राजिानी क्षेत्र दिल्ली की वििान सभा द्वारा वनम्नवलवित “रूप से अविवनयवित होैः

1. संवक्षप्त िीर्यक और प्रारंभ:- (1) इस अविवनयि को “न्यायालय िुल्क (दिल्ली संिोिन) अविवनयि, 2026” कहा जाएगा।

1. (2) यह अविवनयि दिल्ली राजपत्र िें इसके प्रकािन की वतवर् से प्रभािी होगा।

“िारा 16- िुल्क की िापसीैः- यदि दकसी िाि या अपील के पक्षकार दकसी भी अिस्र्ा िें आपसी सहिवत से अपना वििाि सुलझा लेते हैं , चाहे न्यायालय के हस्तक्षेप से या विना हस्तक्षेप के, तर्ा चाहे िीिानी प्रदिया संवहता, 1908 (1908 का अविवनयि सं. 5) की िारा 89 िें उवल्लवित दकसी भी वििाि वनपटान विवि को अपनाकर या विना अपनाए, और उक्त िाि (वजसिें प्रत्यािेिन, यदि कोई हो, सवमिवलत ह ) या अपील को न्यायालय द्वारा सुलह / सिझौते के रूप िें वनपटाया जाता ह , तो िािी/ प्रत्यािेिक को न्यायालय से एक प्रिाणपत्र प्राप्त करने का अविकार होगा, वजसके आिार पर िह कलक्टर / संिंवित अविकारी से उक्त िािपत्र/प्रत्यािेिन पर अिा दकया गया पूरा िुल्क िापस प्राप्त कर सकेगा।”

THE COURT FEES (DELHI AMENDMENT) ACT 2026 (ACT No. 02 OF 2026)

(As passed by the Legislative Assembly of the National Capital Territory of Delhi on 09th January, 2026).

[06th March, 2026] An Act to further to amend the Court Fees Act 1870 (07 of 1870), in its application to the National Territory of Delhi. BE it enacted by Legislative Assembly of Delhi in the Seventy-Seventh year of the Republic of India as follows:––

1. Short title and commencement.- (1) This Act may be called the Court Fees (Delhi Amendment) Act 2026.

1. (2) It shall come into force from the date of its publication in the Delhi Gazette. 2. Substitution of section 16.- The section 16 of the Court Fees Act 1870 (07 of 1870), in its application to National Territory of Delhi, shall be amended as under;- “Section 16 - Refund of Fee:- Where the parties to a suit or appeal, at any stage of such suit or appeal, settle their dispute amicably, with or without the intervention of the Court and with or without invoking any of the modes of settlement of dispute, referred to in section 89 of the Code of Civil Procedure, 1908 (5 of 1908) and the said suit including Counter-claim, if any, or appeal is disposed of as settled/compromised by the court, the plaintiff/Counterclaimant shall be entitled to a certificate from the Court authorizing him to receive back from the collector/competent officer, the full amount of fee, paid in respect of such plaint/counter claim.” 3. Omission of section 16A.- Section 16A inserted vide the Court Fees (Delhi Amendment) Act 2010 notified in Delhi Gazette-Extra Ordinary, vide Notification No F.14(22)/LA-2008/ASLAW/17. Dated the 11th February, 2010, shall be omitted.
