The Tamil Nadu Legislature (Prohibition of Simultaneous Membership) Act, 1950 prevents individuals from holding seats concurrently in both houses of the state legislature, namely the Legislative Assembly and the Legislative Council. It applies to all legislators elected or nominated to these bodies in Tamil Nadu. Under this law, an existing member of one house who is elected to the other automatically forfeits their original seat upon being chosen. If a person is elected to both houses simultaneously, they must decide within fifteen days which house to join; otherwise, their seat in the Legislative Assembly automatically becomes vacant. This ensures clear legislative representation and prevents political conflict of interest.
