The Sikkim Determination of Lease Act, 2014
General20144 sections
This Act governs leases between the Sikkim State Government and private entities. It empowers the government to determine lease periods, terminate, or cancel agreements if the land remains unutilized or if the project is involved in litigation. The land reverts to the government, and the lessee must surrender possession within a month after receiving a 15-day notice to show cause. Disputes are resolved by a Civil Court, which must consider that the lessee held only leasehold rights. This law ensures the government can reclaim land for public interest when it is not being used effectively.
