The Sikkim Cultivators Protection Act, 1985
The Sikkim Cultivators Protection Act, 1985
The Sikkim Cultivators' Protection Act, 1985 safeguards tenant farmers and land cultivators across Sikkim from unjust eviction and exploitation by landowners. It applies to individual cultivators working another person's land for rent or a share of produce, as well as property owners. The law limits rent or crop-share payments to a maximum of fifty percent of the main harvest. It strictly restricts landowners from terminating tenancies except through designated authorities under specific conditions, such as non-payment or subletting. Additionally, the Act mandates the restoration of land to unlawfully evicted tenant cultivators and bars civil courts from interfering, ensuring fair agricultural tenancy protections.
