The Sikkim Cultivators Protection (Temporary Provisions) Act, 1975
This Act enacted in 1975 protects cultivators working under share-cropping or rent arrangements in Sikkim from arbitrary land evictions by landowners. It restricts owners from terminating cultivation except through strict enforcement orders when cultivators fail to work the land without reasonable cause. The legislation applies to all persons cultivating land under agreements—except paid servants and hired laborers—and mandates oversight by a prescribed authority for any termination proceedings. Unauthorized evictions result in land restoration and potential production forfeitures to the government. Additionally, the law caps rents at just half of any produce. These measures ensure farmers' security and equitable farming practices in Sikkim.
