ANDWHEREAS,itisdeemednecessarytoestablishan InternationalInstitutioninManipurtoimpartquality educationtothemassesasManipurInternational UniversitybythisAct,toprovideeducationandtrainingat ‘alllevelsinallsubjects.TheUniversityshallbe establishedthroughauniquepublic-pxjvatepammship modelwithoutexertinganyeconomicburdenontheState orpublic;

Governing Board of the University shall be aecotmtable to theStateofManipur; AND WHEREAS, it is” expedient to thh and incorporate a quality teaching, training, researching and affiliating multi-model UniverSity and an international Institution for pursuit of intellectual, philosophical, historical, spiritual, professional and vocational studies at all subjects and in all levels and for matters connected therewith or incidental thereto 1n the State of Manipur. V BE it enactéd by the Legislatuie of Manip‘m' the Sixty- ninth Year of the Republic of India as follows - V l. (1) This Act may be called the Manipur hitemational University Act, 2018. (2) It extends to the whole of the State of Manipur; (3) It shall come into force and shall haVe a permanent value from the day of its publication in «the Official Gazette of Government of Manipur (4) It is applicable to the “Manipur International UniverSity” which IS established and incorporated by this » Act and any matter relating and/or incidental thereb- 2. In this Act, and all Statutes, Ordinances, tules and regulations made her¢unde1 11111ess the context otherwise requires: - ,, (11) “Academic Council” means the Academic C0un¢il of theUniversity; I (b) “Agenda Matters” means the matters and business . to be designated in the Statutes or in the Ordinances (each. of which can be eithet included 1n the Agenda or be taken up for discussion and decision at a meeting of the Governing Board 01' the Academic Shontitle. extentand commencement.

(e) “Central Govemme ”means Gevemmentoflndia; (d) “College” and “School“ ' means; respectively, a College and- the Schooi maintained or affiliated or recognized by the University; - (e) “Employee” means any person appointed by the 1: University and includes teachers and other staff of the University; (1): “Faculty” means P1ofessors, Additional Professors, Associate Professors, AsSistant Professors and such other persons as may be appointed for imparting ' education, teaching and instruction or . conducting ' research in the University or. in? any College or Instimtion maintained by the University and also means a person ' giving instructions / teaching on behalf of the University, in the teaching department / SchoOl of the University, constitiient or affiliated college / school / institute, and includes a Principal, Reader, Lecturer, Demonstrator, Director, Teacher, and. such member of staff 0f 11“ University Library and all those who may be declared and designated as Faculty by the Academic Council ef the University or - by the Chancellor of theUniversity; (g) “Founder”, “Additional Founder” and “Co-Founder” “ mean, respectively, the Founder, Additional Founder - and Co-Founder of the University as appointed under this Act; ' (h) “Governing Board” means the Governing Board of the University; (i) "Hall” means a unit of residence or of corporate life for ' the students of the University, or of-a College or an institution, maintained bythe~Uniyersity; ' (i) “Institution” meansah wademic institution, not being a‘ College, maintained or affiliated or recognized by the University; ‘ ' (k) “Manipur” means the Indian State of Manipur and all the areas under the administrative central of State Government of Manipur unless specified otherWise; (l) ‘Dffieer” 'meam any “person appointed by the University and includes all the administrative staff of the University; ' » ' » - (m) “Ordinance” means Manipur International Uhiversity

Establishment and Incorporation ofManipur International University. "(x) “University” Lameans 11m “Mam'pur; Wow University" established and incorporated by this
3. Act.
(1) There shall be established and incorporated a University by the name and style of "Manipur International University", as an autonomous body corporate which shall enjoy full legal competence to pursue its activities and objectives, financial, academic and administrative independence and autonomy; to discharge its business in the State of Manipur. (2) The main campus, headquarters and administrative Campus of the University shall be, in the State of Manipur and shall not be shifted outside the State Whatsoever. (3) The University shall establish a minimum of seven campuses Of the University offering quality education in different streams across the State of Manipur and there shall have at least one campus which shall offer free/ near-free/ fee-ship/ subsidized education. (4) The University may establish, affiliate, recognize or maintain campus, off-campus, administrative campus, constituent college, training centre, regional centre, school, college, study centre, learning centre, research stations, extension centres, finishing schools anywhere in the State of India and elsewhere/anywhere in India as it may deem fit; Provided that the University may, with the approval of Governing Board, establish such centres anywhere outside of India or overseas as may be permissible under relevant laws of the land. (5) The University shall be a body corporate and body politic by the name and style as "Manipur International University" and shall have perpetual succession and a common seal with the power to acquire, alienate, assign, bequest, demise, devise, gift, grant, hold, hypothecate, lease, mortgage, rent, sell or to take and dispose of any property, movable and immovable, including Trust property and endowments, which may be or may have become or deemed to be vested in or acquired by the University for the purpose of the University and to contract, and to do all things and acts necessary for the purpose of its constitution and may sue or be sued by its corporate name as aforesaid. It shall also have the power to assume armorial bearings. (6) The first Chancellor, the first Vice-Chancellor, the first Registrar and the first members of the Governing Board and the Academic Council, and all persons who may hereafter become such officers or members, so long as they continue to hold such office or membership, shall constitute the University. (7) The University established and incorporated by this Act shall be deemed to have been established, created and incorporated for the purpose, among others, of making provisions for imparting quality education and training, for research and for the advancement and dissemination of knowledge and wisdom in such subjects and branches as the University may deem fit. (8) The University shall provide quality education for the talented, needy and underprivileged students across the globe. (9) The University shall be a fully empowered/ authorized/ full-fledged accrediting, affiliating, educating, degree granting, teaching, training, researching, examining, certifying and recognizing body subject to observance of relevant guidelines of the UGC. (10) No institution affiliated to or maintained by any other University in the State of Manipur shall be affiliated with the University for any purpose, except with the prior approval of the concerned University or the State Government or both as the case maybe.
7. Chancellor.
(1) The University shall be non-profit, for charity, and self-financing University with autonomous administration/ management with full powers, which shall seek support from its donors, volunteers, scholars, philanthropists and from other sources including but not limited to consultancy and research. (2) The University shall be self-Governing, fully autonomous, and it shall be accountable to the Chancellor and to the Governing Board of the University. (3) The University shall be a not-for-profit legal entity and no part of the surplus, if any, in revenue of the University, after meeting all expenditure, in regard to its operations under this Act, shall be invested for any purpose other than for the growth and development of the University or achievement of its objectives or for conducting research therein. (4) The University shall strive to raise funds for self-sufficiency, sustainability and future development of the Institute.
14. TheUniversityandallthedegrees,diplomas,
The University and all the degrees, diplomas, certificates, courses, training, certifications. license, titles and any other academic distinctionsorewards granted or conferred or offered or 011 anyqne by "the University through all modes at all subjects and at all levels shall be and shall automatically standand deemed to be fully recognized, authorized, accredited, registered and .. approved by the State and the State Government for all the purposes including for the purpose ofemployment for post and service with the State Gavetnment and shall also be recognized for the purpose 0f further education in other Universitiesand higher learning ihStitutions; they shall also be recognized by the Stateand State Government to thesame extent and in the same mantfer and they are treated atpat With the’eorfeispondingedegrees, diplomas, certificates, courses, training, certifications, licenses, titles and any other academic distinctions or awards granted by any other 'Uni'versity/Bo‘ard/Insfitute/BodyIOI-ganization incorporated under any enactment or'State subject to grant of recognition-by appropriate authorities such as UGC, AICTE etc.
16. Menandwomenshallbeequallyeligiblefor
Men and women shall be equally eligible for admission to and as students of the University and for appointment to any Authority, ofiice or employment of or under the University.
18. Regulatory Bodies.
The University shall be deemed to be ah Autonomous Organization under the adnnmstratxveeonuol of the State GoverhmentOfManipur
22. TheUnivei'sityshallihvestormakeorbringa
The University shall invest or make or bring a minimum investment of six billion Indian rupees either directly or indirectly in or to the State of Manipur within five years of passage of this Act. This shall be a moral obligation of the University towards the State and its development.

27. Accreditation Forum(IAF).

(3) The University may recognize the educational degrees/diplomas of any native or foreign Universityor of an educational institution, and may grant or fix the equivalency and standard of various degrees of the University with those degrees. (4) The University may appoint its rebresehtatiVes, resident! regie'nai Commissioners or its Ambassadors111 ‘ any region/ state or country for the purposes and objectives'1tmay deem fit. (5) The UniverSityis hereby deciar'ed ft and eiigibie to ' apply from time to time for the apprOpria’te membership category and it shaii have cooperation and active _ association / membership with the University Grants Commission (UGC), the Aasociation of Indian Universities (AIU), the Council of Beards of School._ Education in India (COBSB), et eeterd including an other such associations. councils, boards and related Chambers ' ofCo‘mmerce and Industries. (6) The University shall co-operate, coordinate and tie-up "with various national and in national educational bodies / organizations including upex professionai'bodies for :reating various course“ quality content and educational Trdgrams-et-cetera; (7) The University may sign cooperatiori agreement with all the Universities and other institutions in the State of Manipur which may include knowledge! information sharing, facility / infrastructure sharing, dual degree, faculty/ student exchange et cetera. (8) The University may start, acquire, venture, partner or own the Universitieso_r Specialized Institutions in other partsof India and theglobe subject to conforming to the mics and regulatiohs ofsuch plaee91' territory. (9) The University shall partner, tie-up 01' enter into an agreement with Indian Institute of Managementfs (IIM’s) ' and Indian institute of Technology’s (llT’s) ‘for , development of , quality content and programs. The agreement may include knowledge/infomation sharing; facility or facultysharing. dual degree programs and) consultancy for developing a world-eiass School of Studies or anything mutually beneficial. (10) The University may acquire or own any TruSt, Society, nonvgovemmentai organization or entity registered under any enactment and the properties owned - by them anywhere'111 the-country for the attainment of‘11s ' purposes and objectives. (11) The University shall establishsecured international ' seed and safety Vault in the State of Manipur with such National and International eoiiaboration as may be _ required. (12) The University shall he the founding member and host partner of the international Federationof Indian Universuies, the Intefitational Free Universities Aiiiance, and the Federatioh ofInternational Universities. (13) The University shall establisha world. class science observatory in the long term and shall offer short, term courses on astronomy and its related sciences in aesocmtion with the related professional bodies and shall ' obtain membership and guidance of the Astronomical Society of India and the international Astronomical Union. (14) The University shall offer varietis academic titles (and professorships such as Distihguished Visiting Professor, Visiting ProfeSSOr, Emeritus Scientist, seniorr- Scientist, Junior Scientist, Emeritus Prefe ihtemational Fellow National Feiiow et cetera. This shall be a speeial imtiatiVe of the University to, attract distinguished academicians/persenaiities' for short term periOd toteach 0011181: in their area of expertise, foster ‘ mutiieultura‘iism, diversity, international exposure anti ‘ academic excellence and also the development and evaluation of research, faculty development program/ seminar, conducting special course / expert workshops, developing grant projects. The University shallepublish a separate set ofmics and regulations for the sag:-
30. Governing Board.
(1) The Chancellor shall have the powers to appoint anyone as the President of the University in Consultation with the Governing Board. (2) He shall have the power to promote the University, the Free International Education for Free Movement, the Importance of Free Knowledge Society, the State, its culture et cetera in every possible way. (3) He shall also lobby for the establishment of more such Universities and institutes around the globe and he shall supervise, advise, guide and assist the University in all matters concerned and related to the University. (4) He shall hold office normally for three
34. Chanceilor.
(1) The present Secretary of the proposing body who is an eminent national level social activist, constitutional expert and the founder of the International Education for Free Movement shall be the First Founder of the University in his individual capacity. (2) The Founder shall be the principal holder of the University as an individual and he shall be the Principal Chief Supervisor of the University. (3) The Founder shall be the ex-officio invitee to all the meetings of the University. He shall also be the ex-officio member of all Boards, Councils and authorities of the University. (4) The First Founder shall be the first Chancellor of the University. (5) The Founder shall be the Chancellor-in Charge whenever the Chancellor post remains vacant or Chancellor is on approved long leave, if any. (6) He shall be the permanent invitee to the Convocations and award functions of the University. (7) The Founder may require any officer of the University to furnish him with the information and all papers or copies thereof relating to any matter concerning the University at any point of time. The Founder may also request further consideration of the matter by the authorities or officers concerned or place his views thereon before the Governing Board for their due consideration or may do both. (8) The Founder and the Additional Founder, at all times, shall be the honorary officer/s of the University and may not be entitled to any kind of salary except the customary and standard privileges, support services as may apply and as may be required for proper functioning of his powers and duties as Founder / Additional Founder or as may be decided by the Governing Board. (9) The Founder shall always be a State Subject of the State for all purposes and state laws shall apply. (10) The First Founder shall be Founder of the University in his individual capacity, for life at his pleasure. (11) The Founder shall have the right and power to nominate/appoint/change/ replace any suitable person as the Founder / Co-Founder at his absolute wish, will, discretion and with such terms and conditions at any point of time. (12) The First Founder shall appoint the next Founder and he shall continue as Founder of the university until he appoints the next one. (13) The present designated Member Trustee of the proposing body shall be the Additional Founder of the University and shall have all such powers, privileges, and honours as of the Founder and shall have the right and power to nominate any nimble person as the Additional Founder at his absolute wish, will and discretion; and he shall also exercise such other powers and perform such other duties as may be conferred on him under the provisions of this Act, its Statutes, Ordinances et cetera.
39. GoverningBoard.
The manner of appointment, terms, and conditions of service and powers and duties of the other officers of the University shall be such as may be Specified by Statutes.
46. Regulations.
The Constitution, powers, and functions of authorities of the University or such other authorities which may be declared by the Statutes to be authorities of the University shall be prescribed by the Statutes and it shall be in the manner prescribed.

The Registrar, on behalf of the University and with prior consultation and approval of the Founder and the Chancellor, shall prepare, in such form and at such time each year as may be prescribed, a budget in respect of the financial year next ensuing showing the estimated receipts and expenditure, and copies thereof shall be forwarded to the State Government after getting due approval from the Governing Board and the Chancellor;
59. EveryemployeeorstudentoftheUniversityorofa
Every employee or student of the University or of a school or centre or college or institution maintained by the University or admitted to its privileges shall, notwithstanding anything contained in this Act, have a right to appeal within such time as may be prescribed by the Statutes, to the Chancellor against the decision of any officer or authority of the University or of the Principal or the management of any Faculty, School, College or Centre or an Institution, as the case may be, and thereupon the Chancellor may confirm, modify or reverse the decision appealed against and his decision shall be final and binding.
61. No
No Faculty, Officer or Employee of University shall be offered, nor shall he accept any remuneration for any work in the University save as may be provided for in the Statutes.
62. Statutes.
Notwithstanding anything contained in the Indian Evidence Act, 1872 or in any other law for the time being in force, a copy of any receipt, application, notice, order, proceeding or resolution of any authority or committee of the University or other documents in possession of the University or any entry in any register duly maintained by the University, if certified by the Chancellor or any person/officer authorized by him, shall be received as prima facie evidence of such receipt, application, notice, order, proceeding, resolution or document or the existence of the entry in the register and shall be admitted as evidence of the matters and translation therein recorded where the original thereof would, if produced, have been admissible in evidence.
66. Notwithstanding
Notwithstanding anything in this Act, whenever the University receives funds from any Government, any authority or any endowment any other agency including industry sponsoring a research scheme, a consultancy assignment, a teaching program or a chaired professorship or a scholarship et cetera to be executed or endowed at the University; (a) the amount received shall be kept by the University separately from the fund of the University and utilized only for the purpose of the scheme; and (b) the staff required to execute the same shall be recruited in accordance with the terms and conditions stipulated by the sponsoring organization/body or individual: Provided that any money remaining unutilized under clause (a) shall be transferred to the endowment fund of the University created under this Act.
70. University.
Notwithstanding anything contained in any other law or instrument having the force of law for the time being in force, the appointments made to any post in the University in accordance with the Statutes and Regulations shall be deemed to be valid and in accordance with law.
73. Act.
The Academic Council may, by a special resolution passed by a majority of not less than two-thirds of the members present and voting, withdraw any degree, title or academic distinction conferred on, or any certificate or diploma granted to, including an honorary degree of academic distinction granted to, or conferred upon, a student or an eminent person or any person by the University for good and sufficient cause: Provided that no such resolution shall be passed until a notice in writing has been given to that person calling upon him to show cause within such time as may be specified in the notice why such resolution should not be passed and until his objections, if any and any evidence he may produce in support of them, have been considered by the Academic Council.
76. All
All the authorities of the University shall have the power to appoint committees and sub-committees and to delegate to them such of their powers as they deem fit; such committees shall, unless there be some special provision in this Act to the contrary, consist of such members of the authority concerned and of such other persons, if any, as the authority in each case may think fit.

The Governing Board shall have the authority to deal with any matter pertaining to the University and not specifically dealt with in this Act, the decision of the Governing Board on all such matter shall, subject to revision by the Chancellor, be final and shall not be liable to be challenged in any court or tribunal.
90. Agenda Matters.
No Agenda Matter shall be either included in the Agenda for or taken up for discussion and decided in the meeting of the Governing Board or the Academic Council or any Committees without obtaining the prior written approval of the Chancellor. In the event of breach, the Chancellor shall be entitled at all time to immediately take remedial action by reversing all decisions taken by any functionary or functionaries or body or bodies of the University in breach of the provisions of the Act and consequent upon the pursuit of such a remedial action all such actions taken by the functionary or functionaries or body or bodies of the University in breach of the provisions of the Act shall be deemed to be null and void, ab initio and consequently the status quo ante shall prevail in respect of the matter or decision in breach.
96. The
The Chancellor shall have the power to take any action necessary to remove any difficulty that may arise in first giving effect to the provisions of this Act.
98. Every
Every Statutes, Ordinances, Rules or Regulations made under this Act shall be published in the Official Gazette of the State and the Official of the University.
100. Savings
Anything done or any action taken under the Ordinance Manipur International University Ordinance, 2018 (No. 1 of 2018) shall be deemed to have been done or taken under the corresponding provisions of this Act.
