Cognizance of offences

Statutory text
- (1) A Magistrate may take cognizance of an offence against this Act only—
- (a) upon a complaint [made by an Officer specially empowered by the State Government in this behalf, or by an Inspector, with in each case the previous sanction [**of the Commission or of a sub-committee appointed by the Commission], and [(b) within a period of three months from the date on which the alleged commission of the offence came to the knowledge of the Inspector.]
- (2) The President or member authorized under sub-section
- (1) shall report to the Commission before its next ordinary meeting any action taken by him in the exercise of the powers under section 9A, 10 or 12.
