The Maharashtra State Services (Medical Attendance) Rules 1961
1. Short title and extent
These rules may be called the Maharashtra State Services (Medical Attendance) Rules, 1961.

4. Medical Attendance for Government servants
(1) A Government servant shall be entitled free of charge to medical attendance and treatment at the hospital or at the residence of the Government servant in the event of illness requiring such attendance or treatment. (2) The medical attendance shall be provided by the Medical Officer in charge of the dispensary or hospital as the case may be. (3) (a) A Government servant shall also be entitled to such special medical facilities as may be prescribed by the Government from time to time. (b) The medical attendance shall include such pathological, bacteriological, radiological or other methods of examination as are considered necessary by the Medical Officer in charge. (4) Definitions. For the purposes of these rules: (i) "Hospital" means any hospital controlled by the Government or any other hospital recognised by the Government for the purposes of these rules. (ii) In the event of a medical condition requiring immediate attention that cannot be provided by the local Medical Officer, the Government servant may be referred for treatment at a specialist facility as certified by the Medical Officer.
5. Reimbursement of medical expenses
A Government servant shall be entitled to reimbursement of expenses incurred on medical attendance subject to the following conditions: (1) The treatment must be at a Government hospital or a hospital specifically recognised for such treatment. (2) Claims for reimbursement must be submitted with valid vouchers and prescriptions as required under the prevailing government resolutions. (3) Claims for treatment outside the State or in private institutions shall be governed by specific instructions issued by the Finance Department from time to time. (4) (a) Expenses for inpatient treatment shall be reimbursed as per the actuals or the rates prescribed for the relevant grade of the Government servant. (b) Any claim for items not included in the approved list shall be subject to specific sanction by the competent authority.
6. Grant of medical certificates
The Medical Officer shall, upon examination of the Government servant, issue the necessary medical certificate regarding the illness as required for the purpose of leave or other service-related benefits.
7. Treatment at residence
(1) Treatment at the residence of the Government servant shall be permissible in cases where the patient is unable to move to the hospital due to the nature of the illness. (2) The Medical Officer shall visit the residence of the Government servant when so requested, provided the conditions of medical urgency are fulfilled as per the regulations.
8. Medical facilities for indoor patients
(i) A Government servant admitted as an indoor patient in a government hospital shall be entitled to facilities as prescribed by the Government from time to time including ward accommodation and medication. (ii) If a government hospital is not available or the condition is serious, referral for treatment at a recognised institution may be allowed with proper authorization.
9. Procedure for submission of claims
(1) Claims for medical expenses shall be made in the prescribed form. (2) Vouchers for medicines and other costs must be attached to the claim application. (3) The head of the department shall scrutinize the claims before granting approval for reimbursement as per the guidelines laid down by the Government. (1) The Government servant shall submit the medical bill in the prescribed form along with the medical attendance certificate and vouchers for the cost of medicines purchased, to the controlling officer for countersignature. (2) The controlling officer after scrutiny of the bill and after satisfying himself that the claim is in accordance with the rules, shall countersign and forward the same to the Treasury Officer for payment. (3) The Treasury Officer shall verify the claim as per rules and arrange for payment. (4) The Government servant shall maintain the record of the bills submitted. (5) The controlling officer shall ensure that the bill is submitted within the prescribed period.
10. Medical Attendance Rules interpretation
Any ambiguity in the interpretation of these rules shall be referred to the Finance Department, whose decision shall be final and binding. Subject to the sanction of the Government, a Government servant may be reimbursed for the cost of special medical treatment not available in the state-run hospitals. The application for such reimbursement shall be accompanied by the medical board's recommendation and the detailed bills of the hospital where the patient was treated.
11. Reimbursement of expenses incurred on medical attendance
(1) In case of emergency when a Government servant is unable to get the services of an authorised medical attendant, expenses incurred on medical treatment in a private hospital may be reimbursed to the extent allowed by the rules. (2) The claim for such reimbursement must be supported by a certificate from the doctor attending the patient regarding the emergency and the necessity of such treatment. A Government servant and his family shall be entitled to receive medical attendance, treatment, and such expenses from the State Government as may be permitted under these rules. The Government servant shall be required to maintain records of such medical attendance as per the stipulated guidelines.
12. Treatment at private recognized hospitals
Government servants and their families may avail treatment at hospitals recognized by the Government for the purpose of medical attendance at rates prescribed by the Government from time to time. Where a Government servant incurs expenses on medical treatment as permitted by these rules, the State Government shall reimburse the said expenses subject to the rules prescribed in the schedule or orders issued from time to time. This includes consultation fees, hospitalization charges, and medicine costs as specified in the relevant appendices.
13. Procedure for claiming medical expenses for treatment in specialized hospitals
The claim for reimbursement of medical expenses incurred in specialized hospitals shall be submitted in the prescribed form through the head of the office to the controlling authority for approval and subsequent payment. Every Government officer or servant shall maintain their medical files and the history of their dependents as prescribed in the forms. The production of these documents is mandatory for the processing of any claim for medical reimbursement or medical leave.
14. Guidelines for issuance of medical certificate
The medical officer shall issue the medical certificate in the prescribed format only after thorough examination of the patient and verifying the necessity of the treatment or rest. The claims for medical reimbursement must be submitted in the prescribed format through the head of the office. The sanctioning authority must verify the necessity of the medical treatment and the conformity with the medical facilities provided under the state services rules before approving the expenditure.
15. Clarification on medical attendance rules
(1) The Government reserves the right to issue clarifications on any aspect of these rules. (2) All such clarifications shall be binding on all Government servants. In cases of specialized medical treatment not available in general government hospitals, the Government servant may be permitted to avail services from recognized specialized private centers, subject to prior approval from the Chief Medical Officer or the authorized medical authority.
16. Conditions for reimbursement of cost of medicines
The cost of medicines purchased from the open market is reimbursable if the medicine was not available in the hospital store and a 'non-availability' certificate is obtained from the hospital authorities. The Government may from time to time issue orders regarding the scale of medical attendance, the list of recognized hospitals, and the conditions under which medical attendance is provided to Government servants. All such orders shall be read as part of these rules.
17. Facility for medical examination of Government servants
Government servants are entitled to medical examination at intervals or as required by the nature of their duties at government hospitals. Medical leave shall be granted only upon production of a medical certificate issued by a recognized medical practitioner in the form specified by the Government. The Government reserves the right to verify such certificates through the Chief Medical Administrator.
18. Exemption from medical provisions
The Government may, by order, exempt any class of Government servants or any specific case from the operation of these rules if it considers it necessary in the public interest.
19. Interpretation of Rules
If any question arises regarding the interpretation of these rules, the decision of the Government shall be final.
