Penalty for opening, etc., of common drinking house.

Whoever,-

1. (a) opens, keeps or uses any place as a common driking house; or
2. (b) has the care, management or control of, or in any manner assists in conducting the business, of any place opened, kept or used as a common driking house, 1[shall, on conviction, be punished with imprisonment for a term which shall not be less than three years but which may extend to five years or with fine which shall not be less than twenty-five thousand rupees but which may extend to fifty thousand rupees or with both.]
