The Atal Bihari Vajpayee Hindi Vishwavidyalaya Adhiniyam, 2011

(1) This Act may be called the Atal Bihari Vajpayee Hindi Vishwavidyalaya Adhiniyam, 2011. (2) It extends to the whole of the State of Madhya Pradesh.

In this Act, unless the context otherwise requires,— (a) "Academic Council" means the Academic Council of the University; (b) "Act" means the Atal Bihari Vajpayee Hindi Vishwavidyalaya Adhiniyam, 2011; (c) "Authority" means any authority of the University as specified in this Act; (d) "Board of Studies" means the Board of Studies of the University; (e) "Chancellor" means the Chancellor of the University; (f) "College" means a college or institution maintained by or admitted to the privileges of the University; (g) "Department" means a department of studies and includes a centre of advanced study or research; (h) "Employee" means any person appointed by the University and includes a teacher or other member of the staff of the University; (i) "Faculty" means a faculty of the University; (j) "Institution" means an academic institution, not being a college, maintained or admitted to the privileges of the University; (k) "Office" means the office of the University; (l) "Officer" means an officer of the University as specified in this Act; (m) "Prescribed" means prescribed by the Statutes, Ordinances or Regulations; (n) "Principal" means the head of a college or an institution and includes, where there is no principal, the person for the time being duly appointed to act as principal, and in the absence of the acting principal, a person duly entrusted with the management of the college or institution; (o) "Statutes", "Ordinances" and "Regulations" means respectively the Statutes, Ordinances and Regulations of the University for the time being in force; (p) "Teacher" means a Professor, Reader, Lecturer and such other person as may be appointed for imparting instruction or conducting research in the University or in any college or institution maintained or admitted to the privileges of the University and designated as teacher by the Ordinances; (q) "University" means the Atal Bihari Vajpayee Hindi Vishwavidyalaya established under this Act; (r) "Vice-Chancellor" means the Vice-Chancellor of the University.

(1) There shall be established a University by the name of "Atal Bihari Vajpayee Hindi Vishwavidyalaya". (2) The Chancellor, the Vice-Chancellor and the members of the Court, the Executive Council and the Academic Council, for the time being, shall be a body corporate by the name of "Atal Bihari Vajpayee Hindi Vishwavidyalaya". (3) The University shall have perpetual succession and a common seal and may sue and be sued by the said name. (4) The headquarters of the University shall be at Bhopal. (5) The University shall be competent to acquire, hold and dispose of property, both movable and immovable, and to contract and to do all other things necessary for the purposes of this Act.

(1) The Vice-Chancellor shall be the principal academic and executive officer of the University and shall exercise general control over the affairs of the University and shall be responsible for the due maintenance of discipline in the University. (2) The Vice-Chancellor shall ensure that the provisions of this Act and the Statutes, Ordinances and Regulations are duly observed and may exercise all powers as may be necessary for that purpose. (3) The Vice-Chancellor shall have the power to convene meetings of the Court, the Executive Council, the Academic Council and the Finance Committee. (4) The Vice-Chancellor shall have the power to take such action as he may deem necessary in an emergency, which would have required the approval of any authority of the University and shall report the action taken to that authority at its next meeting. (5) The Vice-Chancellor shall give effect to the decisions of the authorities of the University taken in accordance with the provisions of this Act. (6) The Vice-Chancellor shall exercise such other powers and perform such other duties as may be prescribed by the Statutes or Ordinances. (7) Where any matter is of an urgent nature requiring immediate action and the same cannot be immediately dealt with by any officer or the authority or other body of the University empowered under this Act to deal with it, the Vice-Chancellor may take such action as he may deem fit and shall forthwith report the action taken by him to the Chancellor and to the officer, authority or body who or which, in the ordinary course, would have dealt with the matter. (8) The Vice-Chancellor shall exercise general supervision and control over the affairs of the University and shall be responsible for the implementation of the decisions of all the authorities of the University. (9) (a) The Vice-Chancellor shall exercise powers and perform duties as per the provisions of the Act. (b) The Vice-Chancellor may delegate any of his powers to any other officer of the University. (c) The Vice-Chancellor shall represent the University in all legal proceedings. (d) The Vice-Chancellor shall have the power to appoint and dismiss any employee of the University in accordance with the Statutes. (10) The Vice-Chancellor shall be the ex-officio Chairman of the Executive Council, the Academic Council and the Finance Committee.
