The Madhya Pradesh Kolahal Niyantran Adhiniyam, 1985
1. Short title, extent and commencement
(1) This Act may be called the Madhya Pradesh Kolahal Niyantran Adhiniyam, 1985. (2) It extends to the whole of the State of Madhya Pradesh. (3) It shall come into force on such date as the State Government may, by notification, appoint.
2. Definitions
In this Act, unless the context otherwise requires,— (a) "Amplifying device" means any loudspeaker, amplifier, microphone or any other device or instrument which creates or amplifies sound; (b) "District Magistrate" includes an Additional District Magistrate; (c) "Public place" means any place to which the public have access whether as of right or not and includes public streets, roads, squares, parks, gardens, playgrounds, bus stands and railway stations; (d) "State Government" means the Government of the State of Madhya Pradesh.
3. Restriction on the use of amplifying devices
No person shall use any amplifying device in any public place or in any situation where the sound produced by such device is capable of being heard by the public at large, without holding a licence in this behalf granted by the District Magistrate or a person authorised by him in this behalf, in such form and subject to such conditions as may be prescribed.
4. Grant of licence
The application for the grant of a licence under section 3 shall be made in such form and on payment of such fee as may be prescribed. The District Magistrate or the officer authorised by him may, for reasons to be recorded in writing, refuse to grant such a licence or cancel or suspend an existing licence if he is satisfied that the use of such device is likely to cause annoyance or disturbance to the public.
5. Penalty
Whoever violates the provisions of this Act or any of the conditions of the licence granted under this Act shall, on conviction, be punishable with imprisonment for a term which may extend to six months or with fine which may extend to Rs. 2,000 or with both.
6. Power to make rules
The State Government may, by notification, make rules for carrying out the purposes of this Act.
