Powers and functions of the Commission
The Kerala Fishermen Debt Relief Commission Act 2008(1) The Commission shall have the power to recommend the debt relief measures to be provided to the fishermen. (2) The Commission may, either suo motu or on an application made by a fisherman or a creditor, take cognizance of the case of indebtedness of a fisherman, and pass such orders as it deems fit. (3) The Commission shall, while exercising its powers under sub-section (2), follow such procedure as may be prescribed: Provided that, the Commission shall, before passing any order, give a reasonable opportunity of being heard to the fisherman and the creditor. (4) The Commission shall have the following powers, namely: (i) to summon and enforce the attendance of any person and examine him on oath; (ii) to require the discovery and production of any document; (iii) to receive evidence on affidavits; (iv) to issue commissions for the examination of witnesses or documents; (5) The Commission shall have such other powers as may be prescribed.
