Bare Act
Jammu and Kashmir Egress and Internal Movement (Control) Ordinance, 2005
This law regulates geographic travel by empowering the government to restrict people from leaving or moving within the state without a written permit. It applies to anyone inside the state, including aircraft pilots and individuals harboring unauthorized travelers. This ordinance matters because it significantly curtails personal liberties by enabling warrantless arrests, denying bail, and creating special courts with highly restricted legal rights for those accused of unauthorized movement or possessing weapons. It even permits physical external deportation across the local ceasefire line based on mere suspicion. Ultimately, it grants the state extreme authority to control citizens and bypass constitutional protections.
