Enquiry and award by Collector

1. (2) Where the amount of compensation assessed under sub-section
2. (1) exceeds the amount mentioned by notification, the Collector shall refer the record of the case along with the statement of the tentative assessment of compensation for approval of the Revenue Minister or an officer specially empowered by him in this behalf.
3. (3) In a case referred by sub-section
4. (2) the Revenue Minister or an Officer empowered by this behalf shall, after considering the report of the Collector and further enquiry as may be necessary, determine the value of the property to be acquired and the value so determined shall be allowed for the land.
5. (4) The Collector shall thereupon make an award under his hand of-
   • (i) the true area of the land ;
   • (ii) the compensation payable for the land, and :
   • (iii) the apportionment of the said compensation among all the persons known or believed to be interested in the land, of whom, or of whose claims, he has information, whether or not they have respectively appeared before him.
6. (5) An award made in contravention of the directions of the Revenue Minister or an officer specially empowered by him in this behalf with respect to the value of the land shall be void.
7. (6) Notwithstanding anything contained in the aforesaid sub-sections, if at any stage of the proceedings, the Collector is satisfied that all the persons interested in the land who appeared before him have agreed in writing on the matters to be included in the award of the Collector in the form prescribed by rules made by the Government he may, without making further enquiry make an award according to the terms of such agreement : Provided that no agreement shall be valid if it violates provisions of any law for the time being in force.
8. (7) The determination of compensation for any land under sub-section
9. (6) shall not in any way affect the determination of compensation in respect of other lands in the same locality or elsewhere in accordance with the other provisions of this Act.
10. (8) Notwithstanding anything contained in the Registration Act, 1977 no agreement made under sub-section
11. (6) shall be liable to registration under that Act.
