The Jammu and Kashmir Ladakh Buddhists Succession to Property Act, 1943
1. Short title, extent and application
(i) This Act may be called the Ladakh Budhists Succession to Propeby Act. 2000. (ii) It shall extend to the whole of Jamm and Kashmir State. but shall apply to the Budhists who have their k omicile in Ladakh.
2. Definitions
In this Act. unless there ib anything repugnant in the subject or context.- (a) "Budhist" means a person who profeises the Budhist faith or religion : (b) "Ladakh" means the District of ~adakjh.
3. Right of all sons to succeed in equal shares
On the death of a Budhist his property, wliere he leaves mork than one son, shall notwithstanding any law or custom to thg contrary but subject to any valid disposition thereof which he may have mahe during his lifetime. be inherited by all his sons in equal shares : Provided that sons. son5 of pre-deceased sbns. and sons of pre- deceased sons of predeceased sons. shall inherlit per stripes, that is to bay. the sons of a predeceased son shall t ke the share which woultl have been taken by him, and likewise th grandsons cf a pre- deceased con ~liall take the share which their fat er would have taken.
4. Saving
The provisions of this Act shall not affect any right of succession accrued or any title to property acquired before the commencement of this Act.
