Bare Act

The Jammu and Kashmir Ladakh Buddhists Succession to Property Act, 1943

Civil20004 sections

This Act governs property inheritance among Buddhist communities in Ladakh, ensuring sons similarly situated receive equal shares of their father's estate. The law applies exclusively to Buddhists domiciled in Ladakh and applies throughout the entire Jammu and Kashmir state territory. It overrides conflicting local customs while still permitting valid lifetime property dispositions. When a man dies leaving multiple sons, his assets pass equally to them, with descendants of deceased sons inheriting their father's share through representation. The legislation recognizes succession rights that had already accrued before its enactment and standardizes inheritance practices for the Ladakh Buddhist population to promote intergenerational family fairness.
