The Himachal Pradesh Legislative Assembly Members (Removal of Disqualifications) (Amendment) Act, 1979
This Act is a specific legislative amendment designed to protect the membership status of elected representatives in the Himachal Pradesh Legislative Assembly. Under the Indian Constitution, holding an "office of profit" under the government can disqualify a person from being an MLA. However, the legislature has the power to exempt certain offices from this rule. This Act amends the 1971 parent legislation to explicitly add the "office of member of the Commission for Scheduled Castes and Scheduled Tribes" to the list of exempted positions. Consequently, an MLA can now serve on this Commission without facing disqualification from the Assembly.
