THE HIMACHAL PRADESH ARMED BANDS (ARREST AND DETENTION) ACT, 1969
The Himachal Pradesh Armed Bands (Arrest and Detention) Act, 1969
This law empowers the police and magistrates in Himachal Pradesh to arrest members of armed bands without a warrant. An armed band is defined as a group of five or more people carrying weapons. The Act allows officers to use force, including deadly force, to make these arrests if resistance occurs. It also establishes detention camps where arrested individuals can be held for up to one month. The law sets penalties for being part of an armed band or resisting arrest, with maximum sentences of up to seven years. Importantly, offenses under this Act are non-bailable, meaning bail is difficult to obtain, and they can be tried summarily in some cases.
