Penalty for being drunk while in charge of child

If any person is found drunk on any highway or other public place whether a building or not or on any premises licensed for the sale of liquor while having the charge of a child and if such person is incapable by reasons of his drunkenness of taking due care of the child, he may be arrested and shall, if the child is under that age, be punishable with fine which may extend to fifty rupees.
