1. Short title
Short title, extent and commencement.—(1) This Act may be called the Madhya Pradesh Vidhan Sabha Sadasya Vetan Tatha Bhatta Adhiniyam, 1972.
2. Definitions
In this Act, unless the context otherwise requires,—
- (a) "Committee" means a Select Committee of the Legislative Assembly or a Committee constituted under the rules of procedure of the Legislative Assembly or a Committee appointed by the Speaker or the State Government and includes the statutory Boards and the Boards appointed by the State Government ;
- (b) "Member" means a member of the Madhya Pradesh Legislative Assembly, but does not include—
- (i) a Minister;
- (ii) a Minister of State;
- (iii) a Deputy Minister;
- (iv) [the Speaker or the Deputy Speaker]
3. Salaries of members
Salaries of members. — There shall be paid to each member a salary at the rate of rupees twenty thousand per mensem during the whole of his term of office:
4. Provided that the said salary shall be drawn by a member only from the date on which he takes his oath or makes an affirmation as a member of the Legislative Assembly.
Constituency allowance to members Constituency allowance to members. — There shall be paid to each member a constituency allowance at the rate of rupees fifty-five thousand per mensem.

6. Travelling and daily allowance
Every member shall be entitled, while travelling on public business, to travelling and daily allowances at such rates and upon such conditions as may be determined by rules made by the State Government.
7. Medical attendance and treatment etc., to members
- (1) Subject to any rules made in this behalf by the State Government, every member shall himself be entitled free of charge, to accommodation in hospitals maintained by the State Government and also to medical treatment available in such hospitals as admissible to a Government servant under the rule making control of the State Government drawing a pay of Rs. 225 per month or above personally for himself.
- (2) Until rules are made under sub-section (1), rules relating to medical attendance and treatment made by the Governor under the proviso to article 309 of the Constitution of India shall apply to a member as they apply to aforesaid Government servant personally for himself, Subject to modification that controlling authority for the purpose of any claim of reimbursement shall be Secretary, Madhya Pradesh Vidhan Sabha.
8. Provision for residence, telephone and staff for Leader of opposition
- (1) The member who is the Leader of opposition shall, in addition to whatever he is entitled to as such member under sections 3, 4, 5, 6 and 7, be entitled,—
- (a) without payment of rent, to the use of a furnished residence at Bhopal for the period he is Leader of opposition and for the period of one month immediately thereafter and no charge shall fall upon the Leader of the opposition in respect of the maintenance of such residence;
- (b) at the cost of the Government, to the provision of a telephone at the residence provided to him under clause (a): Provided that such charges as the telephone shall be borne by the Leader of opposition;
- (c) at the cost of the Government, to the service of a typist and a peon.
- (2) The expenditure to be incurred in respect of furnishing of the residence provided under sub-section
- (1) and the annual expenditure to be incurred in respect of upkeep, annual repairs and maintenance of such residence shall be subject to the same monetary limits as one fixed by section 8 of the Madhya Pradesh Mantri (Vetan Tatha Bhatta) Adhiniyam, 1972 (No. 25 of 1972) and the rules made thereunder in respect of a residence provided to a Minister under the said Adhiniyam.
- (3) The date on which a member becomes or ceased to be the Leader of the Opposition shall be published in the Gazette and any such notification shall be conclusive evidence of the fact that he became or ceased to be the Leader of Opposition on that date for the purposes of this section.
- (4) For the purpose of this section—
- (a) "Leader of opposition" means that member who is for the time being the leader in the State Legislative Assembly of the party in opposition to the State Government having the greatest numerical strength in that Assembly and if any doubt arises as to which is or was at any material time the leader in that Assembly of such a party, the question, shall be decided, for the purposes of this section, by the Speaker of the said Assembly and his decision, certified in writing under his hand, shall be final and conclusive;

- (1) The State Government may make rules for carrying out the purposes of this Act.
- (2) In particular and without prejudice to the generality of the foregoing power, such rules may provide for all or any of the following matters, namely:—
- (a) travelling and daily allowances to members under section 6;
- (b) medical attendance and treatment to members under section 7;
- (c) the period allowed for the purpose of residence under section 8;
- (d) any other matter which is to be or may be prescribed.
- (3) All rules made under this section shall be laid on the table of the Legislative Assembly. 10. Repeal Repeal. — The Madhya Pradesh Vidhan Sabha Sadasya Vetan Tatha Bhatta Adhiniyam, 1972, is hereby repealed.

9. Power to make rules ("Power to make rules")
- (1) The State Government may, by notification in the Official Gazette, make rules for carrying out the purposes of this Act.
- (2) Every rule made under this Act shall be laid, as soon as may be after it is made, before the Legislative Assembly. 10. Repeal Repeal. — The Madhya Pradesh Vidhan Sabha Sadasya Vetan Tatha Bhatta Adhiniyam, 1972, is hereby repealed.
