Appeal and Revision

Statutory text
- (1) The High Court may, as far as possible, consistent with the provisions of the Code, exercise all the powers of appeal and revision conferred by the Code of Criminal Procedure, 1973 (2 of 1974) as if a Special Court within the local limits of the jurisdiction of the High Court were a Court of Session trying cases within the local limits of the jurisdiction of the High Court. (2) Pending the disposal of any appeal or revision before the High Court, it may order that the execution of the sentence or order appealed against be suspended and also, if the accused is in confinement, that he be released on bail or on his own bond. (3) Every appeal under this section shall be preferred within a period of thirty days from the date of the judgment, sentence or order appealed against: Provided that the High Court may entertain an appeal after the expiry of the said period of thirty days if it is satisfied that the appellant had sufficient cause for not preferring the appeal within the period of thirty days.
