Offences by Companies
The Chhattisgarh Regulation, Prohibhition, Sale and Use of Acid Act, 2013(1) Where an offence under this Act has been committed by a company, every person who, at the time the offence was committed, was in charge of, and was responsible to the company for the conduct of the business of the company, as well as the company, shall be deemed to be guilty of the offence. (2) Nothing in this section shall render any such person liable to any punishment provided in this Act if he proves that the offence was committed without his knowledge or that he exercised all due diligence to prevent the commission of such offence. (1) The State Government may on an application for Revision made to it by an aggrieved person against an order in appeal or suo motu against an order of the Licensing Authority or of Appellate Authority, call for and examine the record of such case and may pass such order thereon, as it thinks fit: Provided that the State Government shall not exercise the power conferred on it by this section in respect of an order against which an appeal is pending: Provided further that the State Government shall not pass any order under this section which adversely affects any person unless such person has been given a reasonable opportunity of being heard. (2) An order passed under sub-section (1) shall be final.
