The Chhattisgarh Panchayat Raj (Amendment) Act, 2008

Short title, extent and commencement. 1 -

1. (1) This Act may be called the Chhattisgarh Panchayat Raj (Sansodhan) Adhiniyam, 2008.
2. (2) It extends to the whole of State of Chhattisgarh.
3. (3) It shall come into force on the date of its publication in the Official Gazette.

Amendment of section 13.

1. (1) After clause
   • (ii) of sub-section
2. (4) of section 13 of the Chhattisgarh Panchayat Raj Adhiniyam 1993 (No. 1 of 1994) (hereinafter referred to as the Principal Adhiniyam) the following shall be inserted, namely :- " Provided that the term of consecutive two general elections of panchayat shall constitute one rotation."
3. (2) In sub-section
4. (5) of section 13 of the Principal Adhiniyam, for the words "one third" the word "half" shall be substituted.
5. (3) In sub-section
6. (6) of section 13, of the Principal Adhiniyam, for the words "one third" the word "half" shall be substituted.
7. (4) After sub-section
8. (6) of section 13, of the Principal Adhiniyam, the following shall be inserted, namely :- " Provided that the term of consecutive two general elections of panchayat shall constitute one rotation."

Amendment of section 17.

1. (1) In sub-section
2. (3) of section 17 of the Principal Adhiniyam, for the words "one third" the word "half" shall be substituted.
3. (2) After sub-section
4. (4) of section 17 of the Principal Adhiniyam the following shall be inserted namely :- " Provided that the, term of consecutive two general elections of panchayat, shall constitute one rotation."
5. (3) After the word "Provided" in the first proviso to sub-section
6. (4) of section 17 of the Principal Adhiniyam the word "further" shall be inserted.

Amendment of section 23. After clause

1. (ii) of sub-section

1. (3) of section 23 of the Principal Adhiniyam, the following shall be inserted, namely :- " Provided that the term of consecutive two general elections of panchayat shall constitute one rotation." In sub-section
2. (4) of section 23 of the Principal Adhiniyam, for the words "one third" the word "half" shall be substituted. In sub-section
3. (5) of section 23 of the Principal Adhiniyam, for the words "one third" the word "half" shall be substituted. After sub-section
4. (5) of section 23 of the Principal Adhiniyam, the following shall be inserted, namely :- " Provided that the term of consecutive two general elections of panchayat shall constitute one rotation."

Amendment of section 25.

1. (1) In clause
   • (b) of sub-section
2. (2) of section 25 of the Principal Adhiniyam, for the words "one third" the word "half" shall be substituted.
3. (2) After clause
   • (b) of sub-section
4. (2) of section 25 of the Principal Adhiniyam, the following shall be inserted, namely :- " Provided that the term of consecutive two general elections of panchayat shall constitute one rotation."

Amendment of section 30.

1. (1) In clause
   • (ii) of sub-section
2. (3) of section 30 of the Principal Adhiniyam, the following shall be inserted, namely :- " Provided that the term of consecutive two general elections of panchayat shall constitute one rotation."
3. (2) After the word "provided" in the first proviso to clause
   • (ii) of sub-section
4. (3) of section 30 of the Principal Adhiniyam, the word "further" shall be inserted.
5. (3) In sub-section
6. (4) of section 30 of the Principal Adhiniyam, for the words "one third" the word "half" shall be substituted.
7. (4) In sub-section
8. (5) of section 30 of the Principal Adhiniyam, for the words "one third" the word "half" shall be substituted.
9. (5) After sub-section
10. (5) of section 30 of the Principal Adhiniyam, the following shall be inserted, namely :- " Provided that the term of consecutive two general elections of panchayat shall constitute one rotation."

Amendment of section 32.

1. (1) In clause
   • (i) of sub-section
2. (2) of section 32 of the Principal Adhiniyam, for the words "one third" the word "half" shall be substituted.
3. (2) After sub-clause
   • (i) of clause
   • (i) of sub-section
4. (2) of section 32 of the Principal Adhiniyam, the following shall be inserted, namely :- " Provided that the term of consecutive two general elections of panchayat shall constitute one rotation."

Amendment of section 36.

1. (1) Clauses
   • (k) and
   • (m) of sub-section
2. (1) of section 36 of the Principal Adhiniyam shall be omitted.

Amendment of section 61-A.

1. (1) After section 61-A of the Principal Adhiniyam, the following proviso shall be inserted, namely :- " Provided that provisions of this Chapter shall not apply to the area falling under the jurisdiction of Maya Raipur Development Authority notified under section 64 of the Chhattisgarh Nagar Tatha Gram Nivesh Adhiniyam, 1973 (No. 23 of 1973)."

Amendment of section 65.

1. (1) In sub-section
2. (1) of section 65 of the Principal Adhiniyam, for the words "five years" the words "seven years" shall be substituted.
