4. The administrative jurisdiction for the laws specified in the schedule
- (1) The administrative jurisdiction for the laws specified in the schedule to this Act shall continue to vest in the respective departments as earlier. The concerned departments shall, within their administrative domain, make necessary amendments to the applicable rules and issue appropriate guidelines for the effective implementation of the provisions of this Act. Further, the relevant department shall appoint adjudicating officers, appellate authorities and recovery mechanism for the purposes specified in the schedule, in such manner and subject to such terms and conditions as may be prescribed. 2. Savings Savings.
- (2) Nothing in this Act shall be construed to invalidate any legal proceedings instituted or concluded prior to its commencement, nor shall it be deemed to confer validity upon any illegal proceedings.
Schedule. Schedule
(See Section 2) 1. In the Chhattisgarh Nagar Tatha Gram Nivesh Act, 1973 (No. 23 of 1973), (1) In sub-section (2) of Section 69-B, for the words “shall be punishable with simple imprisonment for a term which may extend to three months or with fine which may extend to fifty thousand rupees, or with both” the words “shall be punishable with penalty which may extend to fifty thousand rupees” shall be substituted. (2) In sub-section (4) of Section 69-B, for the words “with imprisonment for a term which may extend to three Months or with fine which may extend to five thousand rupees or with both”, the words “with penalty which may extend to Twenty-five thousand rupees” shall be substituted. (3) In sub-section (5) of Section 69-B, for the words “a fine” and “one”, the words “penalty” and “five” shall be substituted, respectively. (4) In sub-section (6) of Section 69-B, for the words “a fine”, the word “penalty” shall be substituted. (5) In sub-section (2) of Section 77, for the words “on conviction, be punished with simple imprisonment for a term which may extend to three months, or with a fine which may extend to five hundred rupees or with both”, the words “be liable to a penalty not exceeding fifty thousand rupees” shall be substituted. 1. In the Chhattisgarh Nagar Tatha Gram Nivesh Act, 1973 (No. 23 of 1973) In the Chhattisgarh Nagar Tatha Gram Nivesh Act, 1973 (No. 23 of 1973), (1) In sub-section (2) of Section 69-B, for the words “shall be punishable with simple imprisonment for a term which may extend to three months or with fine which may extend to fifty thousand rupees, or with both” the words “shall be punishable with penalty which may extend to fifty thousand rupees” shall be substituted. (2) In sub-section (4) of Section 69-B, for the words “with imprisonment for a term which may extend to three Months or with fine which may extend to five thousand rupees or with both”, the words “with penalty which may extend to Twenty-five thousand rupees” shall be substituted. (3) In sub-section (5) of Section 69-B, for the words “a fine” and “one”, the words “penalty” and “five” shall be substituted, respectively. (4) In sub-section (6) of Section 69-B, for the words “a fine”, the word “penalty” shall be substituted. (5) In sub-section (2) of Section 77, for the words “on conviction, be punished with simple imprisonment for a term which may extend to three months, or with a fine which may extend to five hundred rupees or with both”, the words “be liable to a penalty not exceeding fifty thousand rupees” shall be substituted. 2. In the Chhattisgarh Society Registrikaran Adhiniyam, 1973 (No. 44 of 1973) In the Chhattisgarh Society Registrikaran Adhiniyam, 1973 (No. 44 of 1973), (1) In sub-section (4) of Section 16, for the words “five hundred”, the words “one thousand” shall be substituted. (2) In sub-section (4) of Section 16, the following Proviso shall be added, namely: - " Provided that, the limit specified in this sub-section shall remain five hundred rupees for women's self-help groups." (3) For Section 31-A, the following shall be substituted, namely: - “31-A. Education officer as registrar.- In this chapter, the term 'Registrar' is also meant to include the Education Officer, as specified in clause (c) of Section 2 of the Chhattisgarh Non-Government Educational Institutions (Payment of Salaries to Teachers and Other Employees) Act, 1978.” (4) In sub-section (1) of Section 38, for the words “five hundred” and “fifty”, the words “two thousand” and “five hundred” shall be substituted, respectively. (5) In sub-section (2) of Section 38, for the words “two thousand”, the words “five thousand” shall be substituted. (6) In sub-section (2) of Section 38, the following Proviso shall be added, namely: - " Provided that, the limit specified in this sub-section shall remain two thousand rupees for women's self-help groups." (7) In Section 39, for the word “twenty”, the words “two hundred” shall be substituted. (8) After Section 39, the following Section shall be added, namely: - “39-A. Composition of offence.-(1) In the event of a contravention of sub- section (4) of Section 16, Section 38, and Section 39 of this Act, the Registrar may, upon payment of a sum of five thousand rupees by the defaulting society/office bearer/ person, permit the compounding of the said contravention under the aforementioned Sections. Provided that, the limit specified in this sub-section shall remain two thousand rupees for women's self-help groups. (2) On payment of the compounding amount as specified under sub-section (1) , the defaulting society/office bearer/ person shall be absolved of the said contravention under the aforementioned sections and shall not be liable for prosecution.” 3. In the Chhattisgarh Industrial Relations Act, 1960 (No. 27 of 1960) In the Chhattisgarh Industrial Relations Act, 1960 (No. 27 of 1960), (1) After Section 93, the following Section shall be added, namely:- "93-A. Composition of offence.- (1) On application by the accused, either before or after prosecution, a Gazetted Officer may compound offences punishable under Section 86,87,88,89,90,91,92 and 93, as specified by the State Government via notification, for an amount up to 50% of the maximum prescribed fine. (2) The provision contained in sub-section (1) shall not apply to- (a) the commission of an offence of a similar nature which has previously been compounded; (b) the commission of an offence of a similar nature for which the person has previously been convicted; if the person commits such offence for the second time or thereafter within a period of five years from the date of the previous compounding or conviction. (3) Officers authorized under sub-section (1) shall exercise their powers of compounding of such offence under the direction, control, and supervision of the State Government. (4) Every application for compounding of an offence shall be made in such form and manner as may be prescribed. (5) Where an offence has been compounded before the institution of prosecution, no prosecution shall be instituted against the offender in respect of such offence which has been so compounded. (6) Where an offence is compounded after the institution of prosecution, such compounding shall be brought to the notice of the court, where the prosecution is pending, in writing by the officer specified under sub-section (1). Upon such intimation of compounding of the offence, the person against whom the offence has been so compounded shall be discharged. (7) Any person who fails to comply with the order issued by the officer specified under sub-section (1) shall, in addition to any other penalty, be liable to pay an amount equivalent to twenty percent of the maximum fine prescribed for the said offence. (8) No offence punishable under the provisions of this Act shall be compounded except in accordance with and subject to the provisions of this Section." 4. In the Chhattisgarh Excise Act, 1915 (No. 02 of 1915) In the Chhattisgarh Excise Act, 1915 (No. 02 of 1915), (1) In Section 36-A, for the words “imprisonment for a term which may extend to one year or with fine which shall not be less than five thousand rupees but which may extend to twenty five thousand rupees, or with both”, the words “penalty for the first offence which shall not be less than five thousand rupees” shall be substituted. (2) For sub-section (1) of Section 36-F, the following sub-section shall be substituted, namely:- “(1) Except at the premises licensed for consumption of alcohol, if anyone is found consuming alcohol or in intoxicated condition at public places like-educational institutions, hospitals, temples of worship, bus stand, railway station and public road etc., shall be punished with penalty for the first offence of two thousand rupees and in case of repeated offence with a penalty of five thousand.” (3) In sub-section (2) of Section 36-F, for the words “fine which shall not be less than ten thousand rupees but which may extend to twenty five thousand rupees and three months imprisonment”, the words “penalty for the first offence of ten thousand rupees, and in case of repeated offence with a fine of twenty five thousand rupees” shall be substituted. (4) For Section 39, the following Section shall be substituted, namely:- "39. Penalty for obstruction of authorized officers etc.- Whoever - (a) when called upon by any authorized officer to produce any license or to furnish any information or to submit any register, record, or document as required under this Act, intentionally refuses to do so, or obstructs such officer or any other authorized person in the discharge of their duties, shall be liable for penalty which may extend to twenty-five thousand rupees. (b) contravenes any rule made under this Act other than those made under Section 34 or Section 62, shall be liable for penalty which may extend to one lakh rupees. (c) obstructs, prevents, or hinders any authorized officer or person acting on their behalf in lawful exercise of any power conferred under this Act or the rules made thereunder, shall be liable for penalty which may extend to one lakh rupees: Provided that, in cases involving licenses operated by the State Government or by corporations wholly owned and controlled by the State Government, the employees appointed by the authorized agency/agencies in the prescribed manner shall be held liable for any unlawful acts.” (5) In sub-section (1) of Section 40, for the words “with imprisonment for a term which may extend to one year or with fine which shall not be less than five hundred rupees but which may extends to four thousand rupees, or with both”, the words “with penalty for the first offence of five thousand rupees and in case of repeated offence with a penalty of ten thousand rupees” shall be substituted. (6) In sub-section (2) of Section 40, for the word “fine”, the word “penalty” shall be substituted. 5. In the Chhattisgarh Fire and Emergency Services Act, 2018 (No. 19 of 2018) In the Chhattisgarh Fire and Emergency Services Act, 2018 (No. 19 of 2018), (1) In Section 24, for the words “with imprisonment which may extend to three months or with fine which may extend to an amount not exceeding three months' pay of such member, or with both, in addition to any departmental administrative action he may be subject to”, the words “with penalty for the first offence not exceeding 02 months' pay of such member, and in case of second offence, fine not exceeding 05 months' pay of such member and for repeated offence imprisonment which may extend to 03 months or with fine which may extend to an amount not exceeding 06 months' pay of such member, or with both, in addition to any departmental administrative action he may be subject to” shall be substituted. (2) In Section 48, for the words “shall be punishable with imprisonment for a term which may extend to three months, or with fine which may extend to five thousand rupees, or with both”, the words “for the first offence shall be liable for a penalty of ten thousand rupees and for the second offence shall be liable to fine of twenty thousand rupees or imprisonment for three months or with both” shall be substituted. 6. In the Chhattisgarh Cooperative Societies Act, 1960 (No. 17 of 1961) In the Chhattisgarh Cooperative Societies Act, 1960 (No. 17 of 1961), (1) For sub-section (2) of Section 59-A, the following sub-section shall be substituted, namely: - "(2) If any such person refuses to produce before the Registrar or any person authorized by him under sub-section (1) of Section 59 any book or papers which it is his duty under sub-section (1) to produce or to answer any question which is put to him by the Registrar or the person authorized by the Registrar in pursuance of sub-section (1), the Registrar or the person authorised by the Registrar may certify the refusal and the Registrar may, after hearing, any statement which may be offered in defense impose a penalty which shall not be less than twenty thousand rupees but which shall may extend to fifty thousand rupees to the defaulter." (2) In sub-section (2) of Section 73, for the word "fine", "up to two hundred rupees" and “five”, the words "penalty", "two thousand rupees" and “five hundred” shall be substituted, respectively. (3) In Chapter IX, for the existing heading of the Chapter, the following heading shall be substituted, namely: - "OFFENCES, IRREGULARITIES, PUNISHMENTS AND PENALTIES". (4) For Section 74, the following Section shall be substituted, namely: - "74. Offences. - It shall be an offence under this Act, if, - (a) a Board of Directors or an officer or member thereof wilfully makes a false report or furnishes false information or dishonestly fails to maintain accounts or dishonestly maintains false accounts; or (b) any officer of a society wilfully recommends or sanctions for his own personal use or benefit or for the use or benefit of a person in whom he is interested loan in the name of any other person; or (c) an officer or any member destroys, mutilates, alters, falsifies or secretes or is privy to the destruction, mutilation, alteration, falsification or secreting of any books, papers or securities, or makes or is privy to the making of any false or fraudulent entry in any register, book of account or document belonging to the society; or (d) a member fraudulently disposes of property over which the society has a prior claim or a member or officer or employee or any person disposes of his property by sale, transfer, mortgage, gift or otherwise with the fraudulent intention of evading the dues of the society; or (e) whoever, before, during or after the election of members of the Board of Directors or office bearers adopts any corrupt practice; or (f) an officer wilfully fails to hand over custody of books, records, cash, security and other property belonging to the society of which he is an officer, to a person appointed under Section 53 or 70. Explanation-For the purposes of this section an officer or a member referred to in this Section shall include past officer or past member, as the case may be." (5) After Section 74, the following Section shall be inserted, namely: - "74-A. Irregularities.-It shall be an Irregularity under this Act, if,- (a) any person collecting share money for a society information does not deposit the same in the Chhattisgarh State Co-operative Bank Limited, a Central Co-operative Bank, an Urban Co-operative Bank or a Postal Savings Bank, within fourteen days of its receipt: or (b) a person collecting the share money for a society information makes use of the funds so raised for conducting any business or trading in the name of a society to be registered or otherwise; or (c) an officer or a member who is in possession of information, books and records, wilfully fails to furnish such information or produce such books and papers or does not give assistance to a person appointed or authorised by the Registrar under Section 53, 58, 59, 60, 67 and 70; or (d) any employer and other director, manager, secretary or other officer or agent acting on behalf of such employer who, without sufficient cause, fails to comply with provisions of sub-section (2) of Section 42; or (e) any person acquires or abets in the acquisition of any property which is subject to a charge under sub-section (1) of Section 40; or (f) an officer or member of a society or any person does any act in contravention of the rules; or (g) any person wilfully or without any reasonable excuse disobeying any summons, requisition or lawful written order issued under the provisions of the Act; or (h) any employer who without sufficient cause, fails to pay to a Co-operative society the amount deducted by him from its employee within a period of fourteen days from the date on which such deduction is made. Explanation-For the purposes of this section an officer or a member referred to in this section shall include past officer or past member, as the case may be." (6) For Section 75, the following Section shall be substituted, namely: - "75. Punishment for offences.-Every Board of Directors, officer or past officer or member or past member or an employee or past employee of a society or any other person shall, without prejudice to any action that may be taken against him under any law for the time being in force, be liable to be punished with fine which shall not be less than twenty thousand rupees but which may extend to fifty thousand rupees provided that he is convicted of any offence mentioned in Section 74." (7) After Section 75, the following Section shall be added, namely: - "75-A. Penalties for Irregularities.-Every Board of Directors, officer or past officer or member or past member or an employee or past employee of a society or any other person shall, without prejudice to any action that may be taken against him under any law for the time being in force, be liable to be penalized by the Registrar with a penalty not exceeding Rs. 25 thousand for any irregularity mentioned in Section 74-A.” 7. In the Chhattisgarh Municipalities Act, 1961 (No. 37 of 1961) In the Chhattisgarh Municipalities Act, 1961 (No. 37 of 1961), (1) In Section 145, for the words “fine” and “which may extend to two hundred rupees”, the words “penalty” and “of one thousand rupees” shall be substituted, respectively. (2) In sub-section (3) of Section 179, for the words “fine” and “which may extend to five hundred rupees”, the words “penalty” and “of five thousand rupees” shall be substituted, respectively. (3) In sub-section (4) of Section 182, for the words “fine” and “which may extend to five hundred rupees”, the words “penalty” and “of five thousand rupees” shall be substituted, respectively. (4) In sub-section (6) of Section 183, for the words “fine”, “which may extend to five hundred rupees” and “which may extend to ten rupees”, the words “penalty”, “of five thousand rupees” and “of five hundred rupees” shall be substituted, respectively. (5) In sub-section (3) of Section 185, for the words “fine”, “which may extend to twenty five rupees” and “which may extend to ten rupees”, the words “penalty”, “of one thousand rupees” and “of five hundred rupees” shall be substituted, respectively. (6) In sub-section (8) of Section 187, for the words “fine”, “which may extend to one thousand rupees” and “which may extend to one hundred rupees”, the words “penalty”, “of ten thousand rupees” and “of one thousand rupees” shall be substituted, respectively. (7) In clause (a) of sub-section (2) of Section 194, for the words “fine”, “which may extend to two hundred and fifty rupees” and “which may extend to five rupees”, the words “penalty”, “of two thousand rupees” and “of five hundred rupees” shall be substituted, respectively. (8) In sub-section (2) of Section 197, for the words “fine” and “which may extend to twenty five rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (9) In Section 198, for the words “fine” and “which may extend to twenty five rupees”, the words “penalty” and “of five thousand rupees” shall be substituted, respectively. (10) In sub-section (5) of Section 208, for the words “which may extend to one thousand rupees”, the words “of five thousand rupees” shall be substituted. (11) In Section 211, for the words “fine” and “which may extend to twenty five rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (12) In sub-section (1) of Section 212, for the words “fine” and “which may extend to twenty five rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (13) In sub-section (1) of Section 222, for the words “fine” and “which may extend to one hundred rupees”, the words “penalty” and “of one thousand rupees” shall be substituted, respectively. (14) In sub-section (2) of Section 222, for the words “fine” and “which may extend to fifty rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (15) In sub-section (2) of Section 224, for the words “fine”, “which may extend to fifty rupees” and “which may extend to ten rupees”, the words “penalty”, “of one thousand rupees” and “of five hundred rupees” shall be substituted, respectively. (16) In sub-section (2) of Section 225, for the words “fine” and “which may extend to fifty rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (17) In sub-section (2) of Section 226, for the words “fine”, “which may extend to twenty five rupees” and “which may extend to ten rupees”, the words “penalty”, “of one thousand rupees” and “of five hundred rupees” shall be substituted, respectively. (18) In Section 228, for the words “fine”, “which may extend to one thousand rupees” and “which may extend to two thousand rupees”, the words “penalty”, “of five thousand rupees” and “of ten thousand rupees” shall be substituted, respectively. (19) In sub-section (4) of Section 231, for the words “fine”, “which may extend to five hundred rupees” and “which may extend to twenty rupees”, the words “penalty”, “of five thousand rupees” and “of five hundred rupees” shall be substituted, respectively. (20) In sub-section (1) of Section 236, for the words “fine” and “which may extend to fifty rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (21) In sub-section (2) of Section 236, for the words “fine” and “which may extend to fifty rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (22) In Section 239, for the words “fine” and “which may extend to twenty five rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (23) In Section 240, for the words “fine”, “which may extend to fifty rupees” and “which may extend to five rupees”, the words “penalty”, “of one thousand rupees” and “of five hundred rupees” shall be substituted, respectively. (24) In sub-section (2) of Section 241, for the words “fine” and “which may extend to twenty five rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (25) In sub-section (1) of Section 242, for the words “fine”, “which may extend to twenty five rupees” and “which may extend to five rupees”, the words “penalty”, “of one thousand rupees” and “of five hundred rupees” shall be substituted, respectively. (26) In of Section 246, for the words “fine” and “which may extend to twenty five rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (27) In Section 250, for the words “fine” and “which may extend to fifty rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (28) In sub-section (2) of Section 253, for the words “fine” and “which may extend to fifty rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (29) In clause (a) of Section 254, for the words “fine” and “which may extend to twenty five rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (30) In clause (b) of Section 254, for the words “fine” and “which may extend to fifty rupees”, the words “penalty” and “of one thousand rupees” shall be substituted, respectively. (31) In sub-section (2) of Section 255, for the words “fine”, “which may extend to fifty rupees” and “which may extend to five hundred rupees”, the words “penalty”, “of five hundred rupees” and “of two thousand rupees” shall be substituted, respectively. (32) In Section 256, for the words “fine” and “which may extend to fifty rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (33) In Section 257, for the words “fine” and “which may extend to twenty five rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (34) In Section 258, for the words “fine” and “which may extend to twenty five rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (35) In sub-section (2) of Section 260, for the words “fine” and “which may extend to fifty rupees”, the words “penalty” and “of one thousand rupees” shall be substituted, respectively. (36) For sub-section (3) of Section 260, the following sub-section shall be substituted, namely: - “(3) Upon establishment of an offense under sub-section (2) in relation to any premises, the Chief Municipal Officer or any officer duly authorized by him (but not otherwise) shall issue an order to close such premises. Subsequently, the said premises shall be regulated in such a manner that persons may be appointed to prevent its use, or other appropriate measures may be taken. Any person who, after the issuance of an order to close such premises, uses the premises in such a manner or permits its use shall be liable to a penalty which may extend to five hundred rupees per day, for each day following the issuance of the closure order during which the premises continue to be used in such a manner or permission for such use is granted.” (37) In sub-section (2) of Section 262, for the words “fine” and “which may extend to twenty-five rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (38) In sub-section (4) of Section 264, for the words “fine” and the word “which may extend to fifty rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (39) In sub-section (5) of Section 268, for the words “fine” and “which may extend to fifty rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (40) For sub-section (6) of Section 268, the following sub-section shall be substituted, namely:- “(6) Upon the establishment of an offense under sub-section (5) in relation to any premises, the Chief Municipal Officer or any officer duly authorized by him (but not otherwise) shall issue an order to close such premises. Thereafter, the said premises shall be regulated in such a manner that persons may be appointed to prevent its use, or other appropriate measures may be taken. Any person who, after the issuance of such an order to close the premises, uses the premises in such a manner or permits its use shall be liable to penalty, which may extend to five hundred rupees per day, for each day following the issuance of the closure order during which the premises continues to be used in that manner or permission for such use is granted." (41) In sub-section (2) and (3) of Section 269, for the words "Magistrate", “fine” and “which may extend to five hundred rupees”, the words "Chief Municipal Officer", “penalty” and “of five thousand rupees” shall be substituted, respectively. (42) In sub-section (3) of Section 272, for the words “fine”, “which may extend to fifty rupees” and “which may extend to ten rupees”, the words “penalty”, “of one thousand rupees”, and “of five hundred rupees” shall be substituted, respectively. (43) For sub-section (4) of Section 272, the following sub-section shall be substituted, namely:- "(4) Upon the establishment of an offense under sub-section (3) in relation to any premises, the Chief Municipal Officer or any officer duly authorized by him (but not otherwise) shall issue an order to close such premises. Thereafter, the said premises shall be regulated in such manner that persons may be appointed to prevent its use or other appropriate measures may be taken." (44) In Section 278, the words “which may extend to fifty rupees” the words “of one thousand rupees” shall be substituted. (45) In sub-section (2) of Section 283, for the words “fine”, “which may extend to two hundred rupees” and “which may extend to forty rupees”, the words “penalty”, “of one thousand rupees”, and “of one hundred rupees” shall be substituted, respectively. (46) In sub-section (4) of Section 283, for the words “fine”, “which may extend to fifty rupees” and “which may extend to ten rupees”, the words “penalty”, “of five hundred rupees” and “of two hundred rupees” shall be substituted, respectively. (47) In sub-section (3) of Section 285, for the words “fine” and “which may extend to fifty rupees”, the words “penalty” and “of five hundred rupees” shall be substituted, respectively. (48) In sub-section (2) of Section 290, for the words “which may extend to five hundred rupees” and “not exceeding fifty rupees”, the words “of five thousand rupees” and “of one thousand rupees” shall be substituted, respectively. (49) In Section 291, for the words “Magistrate of the first class”, “fine” and “not exceeding twenty-five rupees”, the words “Chief Municipal Officer”, “penalty” and “of five thousand rupees” shall be substituted, respectively. - (2) On payment of the compounding amount as specified under sub-section
- (1) , the defaulting society/office bearer/ person shall be absolved of the said contravention under the aforementioned sections and shall not be liable for prosecution.” 3. In the Chhattisgarh Industrial Relations Act, 1960 (No. 27 of 1960) In the Chhattisgarh Industrial Relations Act, 1960 (No. 27 of 1960),
- (1) After Section 93, the following Section shall be added, namely:- "93-A. Composition of offence.-
- (1) On application by the accused, either before or after prosecution, a Gazetted Officer may compound offences punishable under Section 86,87,88,89,90,91,92 and 93, as specified by the State Government via notification, for an amount up to 50% of the maximum prescribed fine.
- (2) The provision contained in sub-section
- (1) shall not apply to-
- (a) the commission of an offence of a similar nature which has previously been compounded;
- (b) the commission of an offence of a similar nature for which the person has previously been convicted; if the person commits such offence for the second time or thereafter within a period of five years from the date of the previous compounding or conviction.
- (3) Officers authorized under sub-section
- (1) shall exercise their powers of compounding of such offence under the direction, control, and supervision of the State Government.
- (4) Every application for compounding of an offence shall be made in such form and manner as may be prescribed.
- (5) Where an offence has been compounded before the institution of prosecution, no prosecution shall be instituted against the offender in respect of such offence which has been so compounded.
- (6) Where an offence is compounded after the institution of prosecution, such compounding shall be brought to the notice of the court, where the prosecution is pending, in writing by the officer specified under sub-section (1). Upon such intimation of compounding of the offence, the person against whom the offence has been so compounded shall be discharged.
- (7) Any person who fails to comply with the order issued by the officer specified under sub-section
- (1) shall, in addition to any other penalty, be liable to pay an amount equivalent to twenty percent of the maximum fine prescribed for the said offence.
- (8) No offence punishable under the provisions of this Act shall be compounded except in accordance with and subject to the provisions of this Section." 4. In the Chhattisgarh Excise Act, 1915 (No. 02 of 1915) In the Chhattisgarh Excise Act, 1915 (No. 02 of 1915),
- (1) In Section 36-A, for the words “imprisonment for a term which may extend to one year or with fine which shall not be less than five thousand rupees but which may extend to twenty five thousand rupees, or with both”, the words “penalty for the first offence which shall not be less than five thousand rupees” shall be substituted.
- (2) For sub-section
- (1) of Section 36-F, the following sub-section shall be substituted, namely:- “(1) Except at the premises licensed for consumption of alcohol, if anyone is found consuming alcohol or in intoxicated condition at public places like-educational institutions, hospitals, temples of worship, bus stand, railway station and public road etc., shall be punished with penalty for the first offence of two thousand rupees and in case of repeated offence with a penalty of five thousand.”
- (3) In sub-section
- (2) of Section 36-F, for the words “fine which shall not be less than ten thousand rupees but which may extend to twenty five thousand rupees and three months imprisonment”, the words “penalty for the first offence of ten thousand rupees, and in case of repeated offence with a fine of twenty five thousand rupees” shall be substituted.
- (4) For Section 39, the following Section shall be substituted, namely:- "39. Penalty for obstruction of authorized officers etc.- Whoever -
- (a) when called upon by any authorized officer to produce any license or to furnish any information or to submit any register, record, or document as required under this Act, intentionally refuses to do so, or obstructs such officer or any other authorized person in the discharge of their duties, shall be liable for penalty which may extend to twenty-five thousand rupees.
- (b) contravenes any rule made under this Act other than those made under Section 34 or Section 62, shall be liable for penalty which may extend to one lakh rupees.
- (c) obstructs, prevents, or hinders any authorized officer or person acting on their behalf in lawful exercise of any power conferred under this Act or the rules made thereunder, shall be liable for penalty which may extend to one lakh rupees: Provided that, in cases involving licenses operated by the State Government or by corporations wholly owned and controlled by the State Government, the employees appointed by the authorized agency/agencies in the prescribed manner shall be held liable for any unlawful acts.”
- (5) In sub-section
- (1) of Section 40, for the words “with imprisonment for a term which may extend to one year or with fine which shall not be less than five hundred rupees but which may extends to four thousand rupees, or with both”, the words “with penalty for the first offence of five thousand rupees and in case of repeated offence with a penalty of ten thousand rupees” shall be substituted.

- (1) In Section 24, for the words “with imprisonment which may extend to three months or with fine which may extend to an amount not exceeding three months' pay of such member, or with both, in addition to any departmental administrative action he may be subject to”, the words “with penalty for the first offence not exceeding 02 months' pay of such member, and in case of second offence, fine not exceeding 05 months' pay of such member and for repeated offence imprisonment which may extend to 03 months or with fine which may extend to an amount not exceeding 06 months' pay of such member, or with both, in addition to any departmental administrative action he may be subject to” shall be substituted.
- (2) In Section 48, for the words “shall be punishable with imprisonment for a term which may extend to three months, or with fine which may extend to five thousand rupees, or with both”, the words “for the first offence shall be liable for a penalty of ten thousand rupees and for the second offence shall be liable to fine of twenty thousand rupees or imprisonment for three months or with both” shall be substituted. 6. In the Chhattisgarh Cooperative Societies Act, 1960 (No. 17 of 1961) In the Chhattisgarh Cooperative Societies Act, 1960 (No. 17 of 1961),
- (1) For sub-section
- (2) of Section 59-A, the following sub-section shall be substituted, namely: - "(2) If any such person refuses to produce before the Registrar or any person authorized by him under sub-section
- (1) of Section 59 any book or papers which it is his duty under sub-section
- (1) to produce or to answer any question which is put to him by the Registrar or the person authorized by the Registrar in pursuance of sub-section (1), the Registrar or the person authorised by the Registrar may certify the refusal and the Registrar may, after hearing, any statement which may be offered in defense impose a penalty which shall not be less than twenty thousand rupees but which shall may extend to fifty thousand rupees to the defaulter."
- (2) In sub-section
- (2) of Section 73, for the word "fine", "up to two hundred rupees" and “five”, the words "penalty", "two thousand rupees" and “five hundred” shall be substituted, respectively.
- (3) In Chapter IX, for the existing heading of the Chapter, the following heading shall be substituted, namely: - "OFFENCES, IRREGULARITIES, PUNISHMENTS AND PENALTIES".
- (4) For Section 74, the following Section shall be substituted, namely: - "74. Offences. - It shall be an offence under this Act, if, -
- (a) a Board of Directors or an officer or member thereof wilfully makes a false report or furnishes false information or dishonestly fails to maintain accounts or dishonestly maintains false accounts; or
- (b) any officer of a society wilfully recommends or sanctions for his own personal use or benefit or for the use or benefit of a person in whom he is interested loan in the name of any other person; or
- (c) an officer or any member destroys, mutilates, alters, falsifies or secretes or is privy to the destruction, mutilation, alteration, falsification or secreting of any books, papers or securities, or makes or is privy to the making of any false or fraudulent entry in any register, book of account or document belonging to the society; or
- (d) a member fraudulently disposes of property over which the society has a prior claim or a member or officer or employee or any person disposes of his property by sale, transfer, mortgage, gift or otherwise with the fraudulent intention of evading the dues of the society; or
- (e) whoever, before, during or after the election of members of the Board of Directors or office bearers adopts any corrupt practice; or
- (f) an officer wilfully fails to hand over custody of books, records, cash, security and other property belonging to the society of which he is an officer, to a person appointed under Section 53 or 70. Explanation-For the purposes of this section an officer or a member referred to in this Section shall include past officer or past member, as the case may be."
- (5) After Section 74, the following Section shall be inserted, namely: - "74-A. Irregularities.-It shall be an Irregularity under this Act, if,-
- (a) any person collecting share money for a society information does not deposit the same in the Chhattisgarh State Co-operative Bank Limited, a Central Co-operative Bank, an Urban Co-operative Bank or a Postal Savings Bank, within fourteen days of its receipt: or
- (b) a person collecting the share money for a society information makes use of the funds so raised for conducting any business or trading in the name of a society to be registered or otherwise; or
- (c) an officer or a member who is in possession of information, books and records, wilfully fails to furnish such information or produce such books and papers or does not give assistance to a person appointed or authorised by the Registrar under Section 53, 58, 59, 60, 67 and 70; or
- (d) any employer and other director, manager, secretary or other officer or agent acting on behalf of such employer who, without sufficient cause, fails to comply with provisions of sub-section
- (2) of Section 42; or
- (e) any person acquires or abets in the acquisition of any property which is subject to a charge under sub-section
- (1) of Section 40; or
- (f) an officer or member of a society or any person does any act in contravention of the rules; or
- (g) any person wilfully or without any reasonable excuse disobeying any summons, requisition or lawful written order issued under the provisions of the Act; or
- (h) any employer who without sufficient cause, fails to pay to a Co-operative society the amount deducted by him from its employee within a period of fourteen days from the date on which such deduction is made. Explanation-For the purposes of this section an officer or a member referred to in this section shall include past officer or past member, as the case may be."
- (6) For Section 75, the following Section shall be substituted, namely: - "75. Punishment for offences.-Every Board of Directors, officer or past officer or member or past member or an employee or past employee of a society or any other person shall, without prejudice to any action that may be taken against him under any law for the time being in force, be liable to be punished with fine which shall not be less than twenty thousand rupees but which may extend to fifty thousand rupees provided that he is convicted of any offence mentioned in Section 74."
- (7) After Section 75, the following Section shall be added, namely: - "75-A. Penalties for Irregularities.-Every Board of Directors, officer or past officer or member or past member or an employee or past employee of a society or any other person shall, without prejudice to any action that may be taken against him under any law for the time being in force, be liable to be penalized by the Registrar with a penalty not exceeding Rs. 25 thousand for any irregularity mentioned in Section 74-A.” 7. In the Chhattisgarh Municipalities Act, 1961 (No. 37 of 1961) In the Chhattisgarh Municipalities Act, 1961 (No. 37 of 1961),
