The Bihar (in admission in Educational Institutions) Reservation (Amendment) Act, 2023

Short Title, extent and commencement. -

1. (1) This Act may be called "The Bihar (In admission in Educational Institutions) Reservation (Amendment) Act, 2023".
2. (2) It extends to the whole of the State of Bihar.
3. (3) It shall come into force with immediate effect.

Amendment of the Bihar (In admission in Educational Institutions) Reservation Act, 2003:-

1. (a) Section-2(1), 2

1. (2) and 2
2. (3) of the aforesaid Act will be substituted as follows: Regulation of Reservation of admission-
3. (1) In any educational Institutions fully or partially aided by the State

Government shall be regulated in the following manner, namely:-

1. (a) From open merit category - 35 %
2. (b) From reserved category - 65 %

1. (2) The vacancies for different categories of reserved candidates from amongst the 65% reserved category subject to other provisions of this Act shall be as follows :-
   • (a) Scheduled Castes - 20 %
   • (b) Scheduled Tribes - 02 %
   • (c) Extremely Backward Classes - 25 %
   • (d) Backward Classes - 18 % Total
     • • 65 %
2. (3) A reserved category candidate who is selected on the basis of his merit shall be counted against 35 % vacancies of open merit category and not against the reserved category vacancies.
   • (b) Section-2(2)(e) of the aforesaid Act will be deleted.
   • (c) Section-2(2)(4) of the aforesaid Act will be deleted.
   • (d) Section-2(6)(c) of the aforesaid Act will be deleted.
   • (e) In Section-3of the aforesaid Act mentioned "/Women of

Repeal and Savings -1 3. Repeal and Savings.— All Orders / Resolution / Circulars / Acts which are inconsistent with this amendment Act shall be deemed to be amended to this extent. Notwithstanding such repeal, any decision/action already taken under repealed provision shall be deemed to be validly made under present amending Act.
