Constitution of an Authority

Statutory text
- (1) The Government shall constitute and Executing Authority, initially for a period of one year, consisting of three members, including the Chairperson, for the purposes of deciding the claims of ex-gratia amount as well as the settlement charge.
- (2) The chairperson shall be a serving or a retired senior Government servant, having knowledge of matters related to revenue administration.
- (3) The Chairperson and the members of the Authority shall hold office till the pleasure of the Government.
- (4) The Authority for the purpose of this Act shall have the same powers as are vested in a Civil Court under the Code of Civil Procedure, 1908 (Act 5 of 1908) to issue commission, to hold local inspection, to summon and enforce attendance of witnesses and to compel production of documents.
- (5) The proceedings before the Authority shall be deemed to be judicial proceedings, within the meaning of Section-193 and 228 of the Civil Procedure Code.
