  1. 0. Preamble
  2. 2. In this Act, unless there is anything repugnant in the subject or context-
  3. 3. ESTABLISHMENT OF MARKETS
  4. 4. Subject to the notification made under Section 3 and after considering such
  5. 5. Subject to the provision made in sections 3 and 4, the State Government may, by
  6. 7. (1) In a State, there may be-
  7. 8. (1)
  8. 9. The State Government may designate and notify any existing market yard established
  9. 10. Provided further that out of such annual tonnage or such annual value, 30 per cent may arrive from not less than two other States.
  10. 11. (1) Subject to such terms and conditions and fee, as may be prescribed, the Director
  11. 12. Provided further that the State Government in public interest may from time to time, by notification, put ceiling on the rate of collection of user charge.
  12. 14. CONSTITUTION OF MARKET COMMITTEE
  13. 17. ( 1) The Market Committee shall be constituted, for a delineated market area
  14. 18. Government/ Administration or the Director.
  15. 19. ( 1) _ Every person -
  16. 20. Committee or constituency as the case may be
  17. 22. A Member of the Market Committee other than ex officio Member may resign from Resignation

  19. 25. (1) On election of the Chairperson or Vice-chairperson, as the case may be, the
  20. 26. ( 1) Where the Director/Managing Director is satisfied that the books and records
  21. 27. (1) Save as provided under Section 14(1 ), the State Government may, by notification,
  22. 28. The Secretary functioning as Chief Executive Officer of the Market Committee shall be
  23. 29. (1) The Executive Committee for MNI shall consist of -
  24. 30. The Members of the executive committee shall hold the office during the pleasure of Term of office
  25. 32. 33. The Vice -Chairperson of the Market Committee shall-
  26. 33. The Vice -Chairperson of the Market Committee shall-
  27. 34. The Market Committee shall meet for the transaction of its business at least once in Meeting etc. of
  28. 35. Provided that the Market Committee may, in special circumstances meet at any time and at any place in the delineated market area, as may be prescribed.
  29. 36. ( 1) Subject to the provisions of this Act, it shall be the duty of the Market Committee-
  30. 37. Subject to such conditions and restrictions as may be prescribed, the Market Committee
  31. 38. (1) The Market Committee may, with the previous sanction of the Director/
  32. 39. (1) The Market Committee may accept from any person who has committed or is
  33. 41. Any officer or servant of the Market Committee, empowered by the State Government
  34. 42. (1) Only electronic weighing instruments which also satisfy the requirements of
  35. 43. (1) Every contract or agreement entered into by a Market Committee for the purchase, Mode of making

  49. 59. REGULATION OF TRADING
  50. 60. (1) Except in the commercial transaction between two traders, any other person
  51. 61. ( 1) The Market Committee shall levy and collect market fee from buyer in respect of Levy of market

  56. 67. (1) Notwithstanding anything contained in thisAct, the State Government may allow
  57. 68. Authority of the State for taking further appropriate action against the contravener.

  59. 70. (1)
  60. 71. Subject to the provisions of section 13, the Licensing Authority, who has issued the
  61. 72. Any dispute arising between/among licensees for private market yard, farmer-consumer
  62. 73. (1) Any person aggrieved by the order of the Director or the Of.icer authorized by him,
  63. 75. (1) No Civil Court shall have jurisdiction to settle, decide or deal with an question or to
  64. 76. ( 1) Every Market Committee shall prepare and pass the budget of its income and Prepartation
  65. 77. Public Works Department of the state Government or Board or any other agency authorized by the state Government for this purpose.
  66. 78. Subject to the provisions of section 77, the Market Committee in order to discharge
  67. 79. The State Government shall, for coordinating and undertaking the activities relating to Establishment
  68. 80. The Board shall be a body corporate having perpetual succession and common seal Incorporation
  69. 82. Agricultural Marketing Board.
  70. 83. (1) The Board shall have a Managing Director who shall be appointed by the State
  71. 84. (1) The term of office of the non-official Members of the Board shall be for five years. Term of Officer of
  72. 85. The tenure of an official Member of the Board shall come to an end as soon as he Term
  73. 88. The person nominated shall hold such office so for the un-expired term of his predecessor.
  74. 89. No person shall be a Member of the Board who-
  75. 90. The Board may appoint sub-committees consisting of three or more of its Members
  76. 91. The State Government shall exercise superintendence and control over the Board and
  77. 92. Provided that the Board shall be constituted within six months from the date of its suspension.

  81. 96. The Managing Director shall:
  82. 97. (1) The Board shall meet for the transaction of its business at least once in every
  83. 98. The Chairperson of the Board shall exercise such powers as may be prescribed. Powers of Chairperson of Board
  84. 99. The State Government may, by notification, appoint any Officer to exercise or perform
  85. 100. (1)
  86. 101. Committee, if so required.
  87. 102. (1) The Director, to discharge such duties and perform such functions as assigned
  88. 103. Any person who contravenes any provision of this Act, or of any Rule or Bye-laws
  89. 104. Whenever any person is convicted of any offence punishable under this Act, the
  90. 105. No court shall take cognizance of any offence punishable under this Act or any
  91. 106. (1) On his own motion, the Managing Director or any Officer authorized by him, or
  92. 107. (1) The Director in consultation with State Government; may remove Vice-Chairperson
  93. 108. 108, the following consequences shall ensue: ·
  94. 109. Upon publication of. the notification superseding a Market Committee under section
  95. 110. Market Committee or Chairperson, as the case may be.
  96. 111. Provided that no order of supersession shall be passed unless the State Government has given to the Board a reasonable opportunity of being heard in respect of the allegations against it.
  97. 112. (1) If it appears to the Director, that it is necessary or expedient in the interest of
  98. 113. (1) The Managing Director may, on his own motion, or on report or complaints
  99. 114. (1) The Director/ Managing Director may, on his own motion, or on an application
  100. 115. (1) If in the course of enquiry or inspection under section 106 or in the course of
  101. 116. Provided that no notification shall be issued under this section without schdule.
  102. 117. (1) The State Government may give directions to the Board and Market Committees.
  103. 118. Any sum due to a Market Committee or the Board on account of any charge, costs,
  104. 119. The Chairperson, the Vice-Chairperson.the Members, Secretary, other Officers and
  105. 120. ( 1) The state Government may delegate to the any Officer of the Government not
  106. 121. No suit, prosecution or legal proceedings in respect of anything done in good faith or
  107. 122. Notwithstanding anything contained in any section of this Act, no suit shall be
  108. 123. (1) It shall be the duty of every Local Authority to give all the necessary information
  109. 124. No act done or proceeding taken under this Act by the Board, by a Market Committee
  110. 127. REPEAL AND SAVINGS
