The Andhra Pradesh Abolition of the Posts of Village Assistants Act, 1991
1. Short title and commencement
(1) This Act may be called the Andhra Pradesh Abolition of the Posts of Village Assistants Act, 1991. (2) It shall be deemed to have come into force on the 5th day of November, 1990.
2. Definitions
In this Act, unless the context otherwise requires,— (a) "Government" means the State Government of Andhra Pradesh; (b) "Village Assistant" means a person appointed as such under the Andhra Pradesh Village Revenue Officers Service Rules, 1989 or prior to the commencement of the said rules, by whatever name called, to assist the village administration.
3. Abolition of the posts of Village Assistants
Notwithstanding anything contained in any judgment, decree or order of any court, tribunal or other authority, the posts of Village Assistants in the State of Andhra Pradesh, by whatever name called, shall stand abolished with effect on and from the 5th day of November, 1990.
4. Consequences of abolition of posts of Village Assistants
Consequences of abolition of posts of Village Assistants:- On and from the appointed day,-
- (a) every person holding a post of Village Assistant and serving as such immediately before the said day shall be deemed to have been relieved of his post;
- (b) the services of every such person shall stand terminated;
- (c) every such person shall be entitled to be paid such ex-gratia amount as may be prescribed by the Government having regard to the length of service of such person:
5. Provided that the ex-gratia amount payable under this clause shall not exceed such amount as may be prescribed by the Government in this behalf.
Rules Rules
- (1) The Government may, by notification, make rules for carrying out all or any of the purposes of this Act.
- (2) Every rule made under this Act shall immediately after it is made, be laid before the Legislative Assembly of the State if it is in session and if it is not in session, in the session immediately following for a total period of fourteen days which may be comprised in one session or in two successive sessions, and if before the expiration of the session in which it is so laid or the session immediately following, the Legislative Assembly agrees in making any modification in the rule or in the annulment of the rule, the rule shall from the date of notification of such modification or annulment have effect only in such modified form or shall stand annulled as the case may be so however that any such modification or annulment shall be without prejudice to the validity of anything previously done under that rule.
6. Power to remove difficulties
Power to remove difficulties If any difficulty arises in giving effect to the provisions of this Act, the Government may, by order published in the Andhra Pradesh Gazette, make such provisions not inconsistent with the purposes of this Act, as appear to them to be necessary or expedient for removing the difficulty.
