The Shri Guru Ram Rai University Act, 2016
1. Short title and commencement
(1) This Act may be called the Shri Guru Ram Rai University Act, 2016. (2) It shall come into force on such date as the State Government may, by notification in the Official Gazette, appoint.
2. Definitions
Unless the context otherwise requires, in this Act: (a) "Authority" means the Authority of the University; (b) "Academic Council" means the Academic Council of the University; (c) "Body" means the Body of the University; (d) "Governing Body" means the Governing Body of the University; (e) "Management Board" means the Management Board of the University; (f) "Board of Courses" means the Board of Courses of the University; (g) "Examination Board" means the Examination Board of the University; (h) "Campus" means the campus of the University; (i) "Chancellor", "Vice-Chancellor", "Pro Vice-Chancellor", "Registrar", "Controller of Examination and Finance Officer" means respectively the "Chancellor", "Vice-Chancellor", "Pro Vice-Chancellor", "Registrar", "Controller of Examination" and "Finance Officer" of the University; (j) "Constituent College" means any college and institution maintained and managed by the University; (k) "Dean of Faculty" means the Dean of the Faculty of the University; (l) "Department" means the department (academic unit) of the University in which study and research work is being conducted in one or more subjects; (m) "Distance Education System" means the system of education within the State in which information technology and media, such as multimedia broadcasting, telecasting, online on internet, other interactive methods of telecommunication, e-mail, internet, computer, interactive talk, e-learning, correspondence courses, seminar, contact programs or any such two or more media are used collectively; (n) "Employee" means any employee appointed by the University and it includes teachers and other employees of the University or any of its constituent colleges; (o) "Faculty" means the faculty of the University; (p) "Finance Committee" means the Finance Committee of the University; (q) "Government" means the State Government of Uttarakhand; (r) "Head of Department" means the head of the department or center of the University; (s) "Permanent Resident" means such resident of the State who has a मूल निवास/स्थायी निवास (mool niwas/sthayi niwas) certificate as per the rules made by the State Government from time to time; (t) "Prescribed" means prescribed by the Statutes; (u) "Principal/Dean" means the Principal/Dean of the college of the University; (v) "Sponsoring Institution" means the society registered under the Societies Registration Act, 1860, the Shri Guru Ram Rai Education Mission Dehradun; (w) "Regional Center" means such center which has been established or maintained by the University for the purpose of coordination, supervision of study centers situated in any region and for the performance of other assigned tasks by the Management Board; (x) "State" means the State of Uttarakhand; (y) "Ordinance, Statutes and Regulations" means respectively the Ordinance, Statutes and Regulations of the University; (z) "Statutory Council" means the Statutory Council established by an Act of Parliament; (aa) "Study Center" means such center recognized by the University, which has been established and maintained for the purpose of providing advice, guidance or other assistance to students; (ab) "Teacher" means a Professor, Associate Professor, Assistant Professor/Lecturer or such other person who is appointed by the University or any constituent, as per the norms of Statutory Council, to impart teaching or to conduct research work, and it also includes the Principal/Dean of a constituent college; (ac) "UGC" means the University Grants Commission established under the University Grants Commission Act, 1956; (ad) "University" means the Shri Guru Ram Rai University proposed under this Act; (ae) "Chancellor" means the Chancellor of the University.
3. Proposal for establishment of the University
(1) The Sponsoring Institution, namely Shri Guru Ram Rai Education Mission, Dehradun, shall have the right to establish the Shri Guru Ram Rai University in accordance with the provisions of this Act. (2) An application including the proposal for the establishment of the University was submitted to the State Government by the Shri Guru Ram Rai Education Mission, Dehradun. The proposal in the submitted application provided the following details: (a) Full details of Shri Guru Ram Rai Education Mission, Dehradun with the objectives of the University; (b) Situation of the University, expansion and availability of land; (c) Nature and type of academic research programs to be conducted by the University in the next five years; (d) Nature of faculties, courses to be started and proposed research work; (e) Development of the University campus such as buildings, equipment and structural amenities; (f) Phased projection of capital expenditure for the next five years; (g) Item-wise recurring expenditure, financial sources and estimated expenditure for each student; (h) Plan to mobilize resources and its capital cost and ways to pay them; (i) Plan for the creation of internal funds from internal resources - fees to be charged from students, consultancy and expected revenue from other activities related to the objectives of the University; (j) Expenditure likely to be incurred by the institution, detailing the nature of fees charged, excluding from the fees for students of economically weaker sections in the form of concessions or exemptions, free-education and scholarships and differing rates for non-resident Indians and students from abroad, if any; (k) Period of specialization and experience in related subjects available in Shri Guru Ram Rai Education Mission, Dehradun and financial resources; (l) Method of selection of students for courses in the University; and (m) Situation of any such terms prior to the establishment of the University as may be required by the State Government.
4. Establishment of the University
(1) The State Government, after necessary verification, is satisfied that the Shri Guru Ram Rai Education Mission, Dehradun has fulfilled all the standards, requirements and conditions for the establishment of the Shri Guru Ram Rai University. Therefore, the University known by the name Shri Guru Ram Rai University shall be established. (2) The University shall be a body corporate by the name of Shri Guru Ram Rai University and shall have perpetual succession and a common seal and shall sue and be sued by the said name. (3) (a) The headquarters of the University shall be situated at Dehradun, Uttarakhand. After the period of five years, the University may establish its second campus in the State, with the prior permission of the State Government, provided that there shall be no time limit for opening a second campus in hilly areas above 2500 feet. (b) For the purpose of starting other departments/subjects/faculties, if extra land is required as per the standards of constitutional bodies, the University may establish a split campus either adjacent to its main campus or within a radius of 25 (twenty five) km from the main campus. (4) Upon establishment of the University under sub-section (1), all land and other movable and immovable assets acquired, constructed, arranged or created by the University for the purpose of the University shall be transferred to and vested in the Shri Guru Ram Rai University. (5) Land, buildings and other assets acquired for the University shall not be used for any purpose other than that for which they were acquired. (6) For all courses conducted by various departments/faculties, it is necessary that the land and building available with the University be as per the standards of the concerned apex regulatory commission.
5. State not liable to provide financial assistance to the University under any statutory obligation
The University shall be self-financed and the State, under any statutory obligation, shall not be liable to provide any kind of grant to the University established in this manner: Provided that the University shall be entitled to receive any such grant which is being given under the terms of such grant under a special scheme run by the State Government or any other body or corporation owned or controlled by the State Government. This will not affect the self-financed status of the University.
6. No power to affiliate any institution
The University shall have constituent colleges, regional centers, study centers and training and research centers, but it shall not have the power to bestow the privilege of affiliation upon any other college/institution.
7. Objectives of the University
The objectives for which the University has been established are as follows: (a) To establish courses of study and research and to provide instruction and training in such branches of study as Medical Science, Dental Science, Nursing, Pharmacy, Paramedical and Allied Health Science, Science, Engineering and Technology, Biotechnology, Yoga Science, Management, Rural Development, Humanities, Law, and other branches of higher education as the University may deem fit; (b) To provide for the advancement and dissemination of knowledge obtained through research and experiential learning media through seminars, conferences, workshops, academic programs, community development programs, publications, training programs and study groups etc. in larger groups, for the benefit of mankind; (c) To contribute to the development of society through outreach, extension programs and external regional activities; (d) To do all such things as may be necessary, relevant and incidental to the attainment of all or any of the objectives of the University; (e) To provide for education in research and to establish continuing education programs; (f) To provide consultancy to industrial and other institutions.
8. Powers of the University
(1) The University shall have the following powers, that is to say: (a) To establish, maintain and recognize such regional centers and study centers as may be prescribed by the Statutes of the University from time to time; (b) To hold examinations for such persons and to institute and confer degrees or other academic distinctions upon those who have: (i) pursued a course of study in the University or any constituent college or under the Distance Education System and regional centers/study centers; or (ii) carried out research work in the University or any constituent college or under the Distance Education System; (c) To confer honorary degrees or other academic distinctions in the manner as mentioned in the Statutes and subject to the conditions; (d) To institute and confer fellowships, scholarships, and awards, studentship, certificate and other academic distinctions as per the Statutes; (e) To provide assistance to similar organizations or individuals; (f) To conduct refresher courses, orientation courses, workshops, seminars and other programs for teachers, instructors, other academic staff and students; (g) Such courses for degrees of Graduate, Postgraduate, Doctor of Philosophy, Doctor of Science and research work as prescribed by the University under the University Grants Commission, Medical Council of India, Dental Council of India, Nursing Council of India, Pharmacy Council of India, All India Council for Technical Education and other statutory councils shall be set by the University, but the University shall have the right to start its own courses in respect of granting diplomas, certificates etc. in its subjects; (h) To determine the standard of admission for the University or any constituent college, regional and study centers, through specific committees and with the approval of the Academic Council; (i) To make special provision on the basis of merit for admission to any course in the University or any constituent college, regional center or study center for permanent residents of the State of Uttarakhand; (j) To create academic, administrative and supporting staff and other necessary posts; (k) To appoint teachers, officers and staff in the University or constituent college, regional centers or study centers; (l) To provide for the growth of distance and alternative education system; (m) To provide for the Distance Education System and such way, with the prior permission of the Distance Education Council, so that distance education can be organized according to the academic programs of the University; (n) To demand and receive such fees, bills, invoices and to collect charges as may be determined by the Statutes or Rules, as far as possible; (o) With the approval of the Management Board, to raise, collect, accept and receive funds for the purposes of the University with or without security of the property of the University; (p) With the prior permission of the Sponsoring Institution, to receive donations and gifts of any kind for the purposes of the University or any constituent college, regional centers or study centers, and to acquire, hold, manage, maintain and dispose of any movable and immovable property; (q) To make arrangements for extra-curricular activities for students and employees; (r) To institute and maintain hostels (halls) for the students of the University or any constituent college and to designate places of residence; (s) To control, supervise the accommodation, keep control over discipline among all classes of employees and students and to specify their service conditions including code of conduct; (t) To collaborate and cooperate with institutions, organizations, universities, particular persons, industries and enterprises of India or abroad in such manner and for such purposes as may be determined by the University from time to time; (u) To provide for the preparation of academic material through films, cassettes, tapes, video cassettes, CD, VCD and other software etc.; (v) To grant recognition to the examinations or period of study (full or partial) of other universities, institutions and centers of higher education as equivalent to the examinations or period of study of the University, and to terminate the recognition granted to them at any time; (w) To enter into contracts, to execute them, to modify them or to terminate them; (x) To clearly distinguish the academic activities of the University from the activities of the Sponsoring Institution; (y) As a legal entity, to sue and be sued in its own name through its authorized officer in any Court, Tribunal or authority; (z) To do all other such acts as are necessary and possible to promote the objectives of the University, whether they are incidental to the aforesaid powers or not. (2) Notwithstanding anything contained in any other law for the time being in force, and without affecting the provisions of sub-section (1), it shall be the duty of the University to take all such measures as it deems fit to promote the University and distance education systems, and to determine the teaching, evaluation and research standards of such systems, and for the performance of this task, universities, constituent colleges, regional centers, study centers and research centers shall have the power, whether they have been granted privileges or not, or any other university or higher education institution, along with the power to allocate and distribute grants, as may be specified by the Statutes.
9. University to be open to all classes, castes and gender
The University shall be open for admission to all persons, irrespective of their class, caste or gender: Provided that nothing in this section shall be deemed to restrict the University from making special provisions for the admission of students of Uttarakhand: Provided further that nothing in this section shall be deemed to require the University or any constituent college, regional center or study center to admit more students than the number determined by the Statutes in any course.
10. National Accreditation
The University shall obtain recognition from various national accreditation bodies.
11. Officers of the University
The following shall be the officers of the University: (a) Chancellor; (b) Pro-Chancellor; (c) Vice-Chancellor; (d) Pro-Vice-Chancellor; (e) Registrar; (f) Dean of Faculty; (g) Finance Officer; and (h) Such other officers as may be declared by the Statutes to be the officers of the University.
12. Chancellor
(1) The Governor of Uttarakhand shall be the Chancellor of the University. (2) The Chancellor, when present, shall preside over the Convocation of the University organized for the purpose of conferring degrees and diplomas. (3) The Chancellor shall have the following powers, that is to say: (a) To call for any paper or information related to the University; (b) On the basis of the information received by the Chancellor, if he is satisfied that any order, proceeding or decision taken by any authority of the University is not in accordance with the Act, Statutes or Rules, then he may issue such directions as he deems fit in the interest of the University and all concerned shall be bound to comply with the directions so issued. (4) Every proposal to confer an honorary degree shall be subject to the approval of the Chancellor.
13. Pro-Chancellor
(1) The Pro-Chancellor shall be appointed by the Sponsoring Institution from amongst such persons, with the prior consent of the Chancellor, who shall be a member of the Sponsoring Institution: Provided that the Sponsoring Institution may also appoint a Pro-Chancellor from among persons other than the Sponsoring Institution members. (2) The Pro-Chancellor shall have such powers as may be conferred upon him by this Act or the Statutes made thereunder. (3) The Pro-Chancellor shall be the Chairperson of the Governing Body.
14. Vice-Chancellor
(1) The Vice-Chancellor shall be appointed for a term of three years from the panel of three persons recommended by the committee constituted under the provisions of sub-section (2), on such terms and conditions as may be prescribed by the Statutes. (2) The committee referred to in sub-section (1) shall consist of the following persons, that is to say: (a) One member nominated by the Chancellor; (b) One member nominated by the Pro-Chancellor; (c) Principal Secretary/Secretary in the Higher Education Department of the State Government; (d) Three members nominated by the Governing Body, out of which one shall be nominated by the Governing Body as a convener. (3) The committee shall prepare a panel of three suitable persons to hold the post of Vice-Chancellor on the basis of merit and shall forward it to the Pro-Chancellor along with a brief description indicating the academic qualifications and other achievements of each such person. (4) The Vice-Chancellor shall be the principal executive and academic officer of the University who shall have general supervision and control over the activities of the University and shall implement the decisions of the authorities of the University. (5) Where there is any such urgent matter other than the appointment of a teacher, in which immediate action is required and in respect of which immediate action cannot be taken by any empowered officer or authority or any other body of the University under this Act, the Vice-Chancellor may take such action as he deems fit with the prior approval of the Pro-Chancellor. (6) The Vice-Chancellor shall exercise such other powers and perform such other duties as may be prescribed by the Statutes. (7) The Pro-Chancellor shall have the right to remove the Vice-Chancellor after proper investigation. The Pro-Chancellor, keeping in view the severity of the allegations during the investigation, may suspend the Vice-Chancellor as he deems fit.
15. Pro-Vice-Chancellor
The Pro-Vice-Chancellor shall be appointed by the Vice-Chancellor with the prior approval of the Pro-Chancellor in such manner, and shall exercise such powers and perform such duties as may be prescribed by the Statutes or assigned by the Vice-Chancellor.
16. Registrar
(1) The Registrar shall be appointed by the Pro-Chancellor in such manner and on such terms and conditions as may be prescribed by the Statutes. (2) The Registrar shall execute and sign all contracts on behalf of the University. (3) The Registrar shall be responsible for the proper custody of the records and the common seal of the University and shall be bound to place before the Pro-Chancellor, Vice-Chancellor or any other authority, all such information and documents as may be necessary for the performance of their work. (4) The Registrar shall have the power to authenticate the records on behalf of the University and shall exercise such other powers and perform such other duties as may be prescribed by the Statutes or required by the Pro-Chancellor or Vice-Chancellor from time to time. (5) The Registrar shall be the ex-officio Secretary of the Governing Body and the Academic Council.
17. Dean of Faculty
The Deans of Faculties shall be appointed by the Vice-Chancellor in such manner and shall exercise such powers or perform such duties as may be prescribed by the Statutes.
18. Finance Officer
The Finance Officer shall be appointed by the Pro-Chancellor in such manner and shall exercise such powers or perform such duties as may be prescribed by the Statutes.
19. Other officers
The manner of appointment, terms and conditions of service and powers and duties of other officers of the University shall be such as may be prescribed by the Statutes.
20. Authorities of the University
The following shall be the authorities of the University, that is to say: (a) Governing Body; (b) Management Board; (c) Academic Council; (d) Finance Committee; and (e) Such other authorities as may be declared by the Statutes to be the authorities of the University.
21. Governing Body and its powers
(1) The Governing Body shall consist of: (a) Pro-Chancellor - Chairperson; (b) Vice-Chancellor - Member-Secretary; (c) Three academicians nominated by the Chancellor; (d) Principal Secretary/Secretary in the Higher Education Department of the State Government; (e) Five members nominated by the Sponsoring Institution; (f) One member nominated by the University Grants Commission; (g) Three members nominated by the Pro-Chancellor. (2) The Governing Body shall be the main administrative body of the University and shall have the following powers, that is to say: (a) Determination of policies to be followed by the University; (b) Appointment of statutory auditors of the University; (c) Review of decisions of other authorities of the University if they are not in accordance with the provisions of this Act or Statutes or Rules; (d) Approval of the budget, annual report and annual accounts of the University; (e) Making of new or additional Statutes or Rules, or amendment or repeal of the earlier Statutes or Rules; (f) Giving a decision regarding voluntary winding up of the University; (g) Opening, closing, operating and managing the accounts of the University; (h) Approval of proposals for submission to the State Government; and (i) Making such decisions and measures as are found desirable for effective conduct of the objectives of the University. (3) The Governing Body shall hold at least three meetings in a year at such time and place as the Pro-Chancellor may deem fit.
22. Management Board
(1) The Management Board shall consist of: (a) Vice-Chancellor - Chairperson; (b) Pro-Vice-Chancellor, if any; (c) Five members nominated by the Sponsoring Institution; (d) Two Deans of Faculties nominated by the Pro-Chancellor on a rotational basis; (e) Principal Secretary/Secretary in the Higher Education Department of the State Government; (f) Two Principals nominated by the Vice-Chancellor on a rotational basis; (g) Registrar - Non-member Secretary. (2) The powers and functions of the Management Board shall be such as may be prescribed by the Statutes.
23. Academic Council
(1) The Academic Council shall consist of: (a) Vice-Chancellor - Chairperson; (b) Registrar - Secretary; (c) Such other members as may be prescribed in the Statutes. (2) The Academic Council shall be the principal academic body of the University and, subject to the Statutes and Rules made under this Act, shall establish coordination in the academic policies of the University and shall exercise general supervision over them. (3) The powers and functions of the Academic Council shall be such as may be prescribed by the Statutes.
24. Finance Committee
(1) The Finance Committee shall consist of: (a) Vice-Chancellor - Chairperson; (b) Finance Officer - Secretary; (c) Principal Secretary/Secretary in the Finance Department of the State Government; (d) Three members nominated by the Pro-Chancellor. (2) The Finance Committee shall be the principal financial body of the University which shall look after the financial matters and shall establish coordination in financial matters of the University and exercise general supervision over them, subject to the Statutes and Rules made under this Act. (3) The powers and functions of the Finance Committee shall be such as may be prescribed by the Statutes.
25. Other authorities
The constitution, powers and functions of other authorities of the University shall be such as may be prescribed by the Statutes.
26. Proceedings not to be invalid due to vacancy
No act or proceeding of any authority of the University shall be invalid merely by reason of any vacancy or defect in the constitution of the authority.
27. Statutes
Subject to the provisions of this Act, the Statutes may provide for all or any of the subjects related to the University and employees, which are as follows: (a) Procedure for performance of work of the University authorities and constitution of such units which have not been specified in this Act; (b) Operation of the Permanent Endowment Fund and Development Fund; (c) Appointment of the Pro-Chancellor and his powers and functions; (d) Rules and conditions of appointment of the Vice-Chancellor, Registrar and Finance Officer, their powers and functions; (e) Policy and service conditions for appointment of other officers, teachers and employees of the University; (f) Resolution of disputes between the University and its officers, teachers, employees and students; (g) Disciplinary action against employees of the University; (h) Disciplinary action against students of the University; (i) Creation, abolition and restructuring of departments and faculties; (j) Manner of collaboration of other universities and higher education institutions; (k) Conferring honorary degrees; (l) Providing free education and scholarships; (m) Number of seats in various courses, process of admission of students in such courses, which also includes the provision of reservation for the students of Uttarakhand; (n) Instituting fellowships, scholarships, studentships, free education, medals and awards; (o) Creation and abolition of posts; (p) Other matters as may be prescribed.
28. How the Statutes shall be made
(1) The first Statutes made by the Governing Body shall be submitted for the approval of the State Government, which may give its approval within three months from the date of receipt of the Statutes, with or without modification. (2) Where the State Government fails to take any decision regarding the approval of the Statutes in the period specified under sub-section (1), it shall be deemed that the State Government has approved the Statutes.
29. Power to amend the Statutes
The Governing Body may, with the prior approval of the State Government, make new or additional Statutes or amend or repeal the Statutes.
30. Rules
Subject to the provisions of this Act, the Rules may provide for all or any of the following subjects: (a) Admission of students in the University, their enrollment and continuance as such;

35. Right to Appeal

8.(1). Powers of the University
(v) To recognize examinations of, or periods of study (whether in full or in part) of other Universities, Institutions or other places of higher learning as equivalent to examinations or periods of study in the University and to withdraw such recognition at any time; (w) To enter into, carry out, amend or cancel contracts; (x) To clearly set apart the academic activities of the University from the activities of the Society; (y) To sue or be sued in its own name as a legal entity in any Court of Law, Tribunal or Authority through its authorized officer; (z) To do all such other acts or things whether incidental to the powers aforesaid or not, as may be necessary or feasible in furtherance of the objectives of the University. (2) Notwithstanding anything contained in any other law for the time being in force, but without prejudice to the provisions of sub-section(1) ,it shall be the duty of the University to take such steps as it may deem fit for the promotion of the University and distance education systems and for the determination of standards of teaching, evaluation and research in such system, and for the purpose of performing this function, the University shall have such, powers, including the power to allocate and disburse grant to its own Constituent Colleges, Regional Centres and Study Centres whether admitted to its privileges or not, or to any other University or institution of higher learning, as may be specified in the Statues.
