The Quantum University Act, 2016
1. Short title and commencement
(1) This Act may be called the Quantum University Act, 2016. (2) It shall be deemed to have come into force on the date of notification released by the State Government.
2. Definitions
Unless the context otherwise requires, in this Act: (a) "Academic Council" means the Academic Council of the University; (b) "Authorities" means the Authorities of the University; (c) "Board of Management" means the Board of Management of the University; (d) "Governing Body" means the Governing Body of the University; (e) "Board of Studies" means the Board of Studies of the University; (f) "Examination Board" means the Examination Board of the University; (g) "Chancellor", "Vice-Chancellor", "Pro-Vice-Chancellor", "Registrar", "Controller of Examination" and "Finance Officer" means the Chancellor, Vice-Chancellor, Pro-Vice-Chancellor, Registrar, Controller of Examination and Finance Officer of the University respectively; (h) "Campus" means the Campus of the University; (i) "Constituent College" means a college or institution maintained and managed by the University; (j) "Career Academy Centre" means such centers which are established, recognized and maintained by the University within the State which are used for receiving audio-visual transmission, e-mail, internet, interactive communication, training, lectures, conducting seminars and workshops, providing advice, counseling and other assistance to students; (k) "Director" or "Principal/Dean" in relation to a Campus or Constituent College means the head of that Campus or Constituent College and where there is no Principal/Dean, any other person appointed to act as Principal/Dean; (l) "Distance education method" means the method of education within the institution which uses information technology and communication tools like multimedia, broadcasting, telecasting, online on internet, other interactive methods of telecommunication, e-mail, internet, computer, interactive communication, e-learning, correspondence course, seminar, contact programme or a combined use of two or more such media for teaching within the State; (m) "Deposit amount" means such amount taken from students by the University, which is refundable; (n) "Dean" means the Dean of the University; (o) "Department" means the Department (Academic Unit) of the University, in which study and research work is being carried on in one or more subjects; (p) "Employee" means employee hired by the University, and includes teachers and other employees of the University or any Constituent College; (q) "Finance Committee" means the Finance Committee of the University; (r) "Faculty" means the Faculty of the University; (s) "Fees" means such amount taken from students by the University which falls under fees and is not refundable; (t) "Government" means the Government of Uttarakhand; (u) "Hall" or "Hostel" means a unit of residence for students maintained and recognized by the University or Constituent College; (v) "LM Educational and Research Foundation" (Trust) means the Trust registered under the Trust Act, whose registered office is situated at 14/1, New Road, Dehradun - 248001; (w) "Promoting Trust" means the Trust registered under the Trust Act, "LM Educational and Research Foundation" (Trust) Dehradun Uttarakhand; (x) "Prescribed" means prescribed by the Statutes; (y) "Permanent Resident" means the resident of the State who has a valid proof of domicile/permanent resident according to the rules made by the State Government from time to time; (z) "Regional Centre" means such center, whose establishment or maintenance is done by the Board of Management for coordination, supervision of study centers situated in any region of the State and for the performance of other tasks assigned to such center; (aa) "State" means the State of Uttarakhand; (ab) "Statutes", "Rules" and "Ordinance" means the Statutes, Rules and Ordinance of the University; (ac) "Study Centre" means such center recognized by the University, whose establishment and maintenance within the State is done for the purpose of providing advice, counseling or other assistance to students; (ad) "Teacher" means Professor, Associate Professor, Assistant Professor/Lecturer and any other person, who is appointed for imparting education or for conducting research work in the University, or its any Campus or Constituent College according to the norms of University Grants Commission and includes Director of any Campus or Principal/Dean of Constituent College; (ae) "UGC" means the University Grants Commission established under the University Grants Commission Act, 1956; (af) "University" means the Quantum University proposed under this Act; (ag) "Body" means the Body of the University; (ah) "Visitor" means the Visitor of the University.
3. Proposal for establishment of University
(1) The sponsoring institution, namely "LM Educational and Research Foundation" (Trust) Dehradun, shall have the right to establish "Quantum University" according to the provisions of this Act. (2) An application along with the proposal for the establishment of the University has been submitted by the sponsoring institution to the State Government, for which the following details have been submitted: (a) Objectives of the University including full details of the sponsoring institution; (b) Location, expansion and availability of land of the University; (c) Nature and type of academic and research programs to be run by the University in the next five years; (d) Nature of faculties, courses to be started and research work; (e) Development of the University campus such as buildings, furniture and structural amenities; (f) Phased budget estimate of capital expenditure for the next five years; (g) Item-wise recurring expenditure, financial sources and estimated expenditure per student; (h) Plan for mobilizing resources and their capital costs and methods of repayment; (i) Plan for creation from internal funds through internal resources - expected revenue from fees taken from students, counseling and other activities related to the objectives of the University; (j) Details of the nature of fees to be charged from students, extent of concessions or exemptions given to native students of the State, free education and scholarships and at different rates, if any, from Non-Resident Indians and foreign students; (k) Period of specialization and experience in related subjects available in the sponsoring institution and financial resources; (l) Method of selection of students for University courses; and (m) Status of fulfillment of such other conditions, if any, as required by the State Government, prior to the establishment of the University.
4. Establishment of University
(1) The State Government, after necessary investigation, is satisfied that the sponsoring institution has fulfilled all conditions and requirements and the private university in the name of "Quantum University" is established in the State of Uttarakhand. (2) The University shall be a body corporate by the name of "Quantum University" and shall have perpetual succession and a common seal and may sue and be sued by its name. (3) (a) The main campus of the University shall be situated in Tehsil Bhagwanpur, District Haridwar and its other campus or regional center, study center can be established at other places according to the procedures established by the University Grants Commission and other statutory bodies. After a period of five years, the University may establish its additional campus within the State with the prior permission of the State Government, provided that there will be no time limit for opening additional campus within the State above 1000 meters from sea level in hilly areas. (b) For starting other departments/subjects, if additional land is required, as required by regulatory bodies like University Grants Commission, All India Council for Technical Education, National Council for Teacher Education etc., the University can establish it either near the main campus, or in a separate (split) campus in District Haridwar or in any other area in Uttarakhand. (4) The Chancellor, Vice-Chancellor, Pro-Vice-Chancellor, Registrar and members of the Governing Body, Board of Management and Academic Council shall be able to constitute a regular body while working on the said posts in the University established in this manner and will be able to file suits in the name of the University and can be sued. (5) Upon the establishment of the University under sub-section (1), any land, movable and immovable properties acquired, constructed, arranged or created for the purpose of the University shall be transferred to and vested in the University, excluding the properties of the sponsoring institution. (6) The land, building, and all courses run by the various departments/faculty available with the University must be as per the cases of the concerned apex regulatory commission. (7) Infrastructure and other facilities in the main campus, campus or study center etc. of the University shall be in accordance with the standards of UGC and apex statutory regulatory institutions.
5. University not to be entitled to financial assistance
The University shall be self-financed and shall neither demand nor be entitled to any support, grant or any other financial assistance from any other body or corporation under the ownership or control of the State Government.
6. No power to affiliate any institution
The University may have constituent colleges, regional centers and career academy centers within the State of Uttarakhand, but it shall not have the power to grant affiliation to any other college or institution. The University may carry out collective research work and teaching work with other research institutions and other universities.
7. Objectives of the University
The objectives for which the University has been established are as follows: (a) To provide and arrange for study, teaching, testing and research work in technical education, higher education, medical and dental education, legal education, aviation education, social science, general science and other subjects and branches as the University may deem appropriate; (b) To establish and provide for the establishment of campuses and constituent colleges for technical education, higher education, medical and dental education, legal education, aviation education, social science, general science and other fields etc., and to establish and grant Certificate Courses, Diploma, Graduate and Post Graduate degree and Ph.D. degree as named by the University Grants Commission, but the University shall have the right to provide other such new Diploma and Certificate courses for the promotion of its objectives; (c) Establishment of constituent center in the State under continuing education for providing education through distance education system with the prior permission of the University Grants Commission and concerned regulatory bodies for the courses mentioned in sub-section (b) above; (d) To establish examination centers; (e) To grant degrees, diplomas, certificates and other academic distinctions on the basis of examinations or other systems; (f) To organize study seminars, sessions, workshops, academic programs, community development programs, publication, training programs and group study, etc., through the establishment of research and development centers for encouraging research and innovations in technical education, higher education, medical and dental education, legal education, aviation education, social science, general science and other fields by the University; (g) To contribute to the development of society through external study, extension programs and external regional activities; (h) To establish off-shore campus under the provisions and rules of the University Grants Commission; (i) To do all such acts as may be necessary, relevant and auxiliary for the achievement of all or any of the objectives of the University.
8. Powers of the University
(1) The University shall have the following powers: (a) To provide for study, teaching, testing and research work, teaching arrangement in technical education, higher education, medical, para-medical and dental education, legal education, aviation education, social science, general science and other subjects and other fields, and to make provision for the advancement and dissemination of knowledge and research; (b) To perform all such other activities as may be necessary or feasible, to fulfill the objectives of the University; (c) To organize examinations for such persons and to confer degrees or other academic distinctions upon those who have: (1) studied a teaching course under the University or its campus or any constituent college or under distance education system at regional centers, study centers or career academy centers; or (2) conducted research work in the University or any constituent college, or under any distance education system; (d) To confer honorary degrees or other academic distinctions in the manner and under the conditions alleged in the statutes/provisions; (e) To institute and grant fellowships, scholarships and prizes, etc., according to the statutes; (f) To demand and receive such fees, deposits, bills and collect charges as may be prescribed by the Statutes or Rules, as the case may be; (g) To establish, maintain and grant recognition to such regional centers and study centers as may be determined by the manner specified in the Statutes of the University from time to time; (h) To provide for extracurricular activities other than education for students and employees; (i) To appoint staff, officers and employees of the University or its campus or constituent colleges, regional centers, study centers, research centers and career academy centers; (j) To receive donations and gifts of any kind for the purposes of the University with the prior permission of the sponsoring institution and to acquire, hold, manage, maintain and dispose of any movable and immovable property including trust and endowment properties; (k) To establish and maintain halls/hostels for the students of the University or its campus or any constituent college and to fix the places of residence; (l) To control residence, supervise and control discipline among all categories of employees and students and to specify the service conditions of such employees including a code of conduct; (m) To create academic, administrative and support staff and other necessary posts; (n) To cooperate and collaborate with institutions, organizations, universities, individuals, industries and institutions of India or abroad in such manner and for such purposes as the University may determine from time to time; (o) To provide for distance education system and such manner as to enable the distance education to be organized according to the academic programs of the University with the prior permission of the University Grants Commission and concerned regulatory institutions; (p) To organize and conduct refresher courses, orientation courses, workshops, seminars and other programs for teachers, instructors, text writers, evaluators and other academic staff; (q) To determine the standards for admission through special committees and with the approval of the Academic Council in the University, or its campus, or any constituent college, regional centers, study centers, research centers and career academy centers; (r) To make special provision for admission for Permanent Residents of Uttarakhand State on the basis of merit in any course in the University, or its campus, or any constituent college, regional centers, study centers, research centers and career academy centers; (s) To determine such courses for Graduate, Post Graduate, Doctor of Philosophy, Doctor of Science degrees and research work in technical education, higher education, medical and dental education, legal education, aviation education, social science, general science and other subjects by the University as fall under the University Grants Commission and other statutory councils, but the University shall have the right to start its own course in relation to giving Diploma, Certificate etc. in its subjects; (t) The academic activities of the University shall be clearly separate from the activities of the sponsoring institution; (u) To provide for preparing educational material including film cassettes, tapes, video cassettes, CD, DVD and other software etc.; (v) To grant recognition to the examinations or period of study (full or partial) of other university institutions and higher education centers as equivalent to the examinations or period of study of the University and to terminate the recognition granted to them at any time; (w) To borrow, collect, accept and obtain loans for the University on the security of the property of the University or without it with the approval of the Governing Body; (x) To enter into contract, execute it, modify it or terminate it; (y) To do all such other acts as may be necessary and possible to advance the objectives of the University, whether they are incidental to the aforesaid powers or not; (z) As a legal entity, to file suits and be sued in its name in any court, tribunal or authority through its authorized officer. (2) Notwithstanding anything contained in any law for the time being in force, and without prejudice to the provisions of sub-section (1), it shall be the duty of the University to take all such measures as it deems fit to promote the University and distance education systems and to set standards for teaching, evaluation and research of such systems, and for the execution of this task, the University shall have such powers as may be specified by the Statutes including the power to grant and distribute approvals to universities, colleges, regional centers, study centers, research centers and career academy centers, whether they have been granted special rights or not, or to any other university or higher education institution.
9. University to be open to all classes, castes and gender
The University shall be open to all persons, irrespective of their class, caste or gender, for admission: Provided that nothing in this section shall be deemed to prevent the University from making special provisions for the admission of students of Uttarakhand: Provided further that notwithstanding anything contained in this section, it shall not be deemed that the University or any constituent college, regional centers, study centers, research centers and career academy centers are required to admit more students in any course than the number determined by the Statutes.
10. National Accreditation
The University shall obtain recognition from various National Accreditation Institutions.
11. Officers of the University
The following shall be the officers of the University: (a) Visitor; (b) Chancellor; (c) Vice-Chancellor; (d) Pro-Vice-Chancellor; (e) Registrar; (f) Dean of Faculty; (g) Finance Officer; and (h) Such other officers as may be declared by the Statutes to be the officers of the University.
12. Visitor
(1) The Governor of Uttarakhand shall be the Visitor of the University. (2) The Visitor, when present, shall preside over the University convocation organized for conferring degrees and diplomas. (3) The Visitor shall have the following powers: (a) To ask for any record, letter or information related to the functioning of the University; (b) Based on the information received by the Visitor, if he is satisfied that any order, proceeding or decision taken by any authority of the University is not in accordance with the Act, Ordinance, Statutes or Rules, then he may issue such directions as he deems proper in the interest of the University and the directions so issued shall be complied with by all concerned; (c) Approval of the Visitor shall be required for every proposal for conferring honorary degrees.
13. Chancellor
(1) The sponsoring institution (Promoting Trust) shall appoint one of its members or any other person unanimously from its members as Chancellor. (2) The Chancellor shall have such powers as conferred upon him by this Act or the Statutes made thereunder. (3) The Chancellor shall have the following powers: (a) Power to ask for any information or record; (b) Power to appoint the Vice-Chancellor; (c) Power to remove the Vice-Chancellor; (d) Such other powers as have been provided in this Act.
14. Vice-Chancellor
(1) The Vice-Chancellor shall be appointed by the Chancellor for a period of three years from a panel of three persons recommended by the committee constituted according to the provisions of sub-section (2) on such terms and conditions as may be prescribed by the Statutes. (2) The committee referred to in sub-section (1) shall consist of the following persons: (a) One member nominated by the Visitor; (b) One member nominated by the Chancellor; (c) Three members nominated by the Governing Body out of which one shall be nominated by the Governing Body as the convener of the committee. (3) The committee shall prepare a panel of three persons eligible for the post of Vice-Chancellor on the basis of merit and shall forward it to the Chancellor along with a brief description of the academic qualifications and other distinctions of each person. (4) The Vice-Chancellor shall be the principal executive, administrative and academic officer of the University, who shall exercise general supervision and control over the activities of the University and shall implement the decisions of the authorities of the University. (5) Where there is any such urgent matter other than the appointment of a teacher, in which it is necessary to take prompt action and regarding which action could not be taken by any empowered officer or authority or body of the University or under it as per this Act, then the Vice-Chancellor with the prior approval of the Chancellor may take such action as he deems fit. (6) The Vice-Chancellor shall exercise such other powers and perform such other duties as may be alleged by the Statutes or Rules. (7) The Chancellor shall have the power to remove the Vice-Chancellor after due investigation. The Chancellor, during the investigation, considering the gravity of the allegations, may suspend the Vice-Chancellor as he deems fit.
15. Pro-Vice-Chancellor
The Pro-Vice-Chancellor shall be appointed by the Vice-Chancellor with the prior approval of the Chancellor in such manner as may be prescribed in the Statutes and the Pro-Vice-Chancellor shall exercise such powers and perform such duties as may be prescribed by the Statutes.
16. Registrar
(1) The Registrar shall be appointed by the Chancellor in such manner and on such terms and conditions as may be prescribed. (2) The Registrar shall enter into all contracts on behalf of the University and shall sign them. (3) The Registrar shall have the power to authenticate the records on behalf of the University and shall exercise such other powers and perform such other duties as may be prescribed by the Statutes, or as may be required by the Chancellor or Vice-Chancellor from time to time. (4) The Registrar shall be responsible for the due custody of the records and common seal of the University and shall be bound to present all such information and documents before the Chancellor, Vice-Chancellor or any other appropriate authority as may be necessary for the performance of their duties.
17. Dean of Faculty
Deans of Faculty shall be appointed by the Vice-Chancellor with the prior approval of the Chancellor in such manner as prescribed by the Statutes and he shall exercise such powers and perform such duties as may be prescribed by the Statutes.
18. Finance Officer
The Finance Officer shall be appointed by the Chancellor in such manner and shall exercise such powers and perform such duties as may be prescribed by the Statutes.
19. Other Officers
The manner of appointment, terms and conditions of service and powers and duties of other officers of the University shall be as prescribed by the Statutes.
20. Authorities of the University
The following shall be the authorities of the University: (a) Governing Body; (b) Board of Management; (c) Academic Council; (d) Finance Committee; and (e) Such other authorities as may be declared by the Statutes to be the authorities of the University.
21. Governing Body and its powers
(1) The Governing Body shall consist of the following: (a) Chancellor - Chairperson; (b) One member shall be nominated from the members of the sponsoring institution as Co-Chairperson; (c) Vice-Chancellor - Member Secretary; (d) One educationist nominated by the Visitor; (e) Principal Secretary/Secretary from the Higher Education Department of the State Government; (f) Five members nominated by the sponsoring institution; (g) Two members nominated by the sponsoring institution from the officers of reputed higher education institutions. (2) The Governing Body shall be the principal administrative body of the University and shall have the following powers: (a) Determination of policies to be followed by the University; (b) Review of the decisions of other authorities of the University, if they are not in accordance with the provisions of this Act or Statutes or Rules; (c) Approval of the budget and annual report of the University; (d) Making new or additional Statutes or amendment or repeal of earlier Statutes or Rules; (e) To decide regarding the voluntary winding up of the University; (f) Approval of proposals to be submitted to the State Government; (g) To take such decisions and measures as are found desirable for the effective performance of the objectives of the University; (h) Appointment of statutory auditors of the University; and (i) Opening, closing, operating and managing all accounts of the University. (3) The Governing Body shall meet at least twice in a year at such time and place as the Chairperson of the Governing Body deems fit.
22. Board of Management
(1) The Board of Management shall consist of the following members: (a) Vice-Chancellor - Chairperson; (b) Pro-Vice-Chancellor (if any); (c) One officer nominated by the Chancellor; (d) Five members nominated by the sponsoring institution; (e) Two teachers nominated by the Chancellor on a rotational basis; (f) Two Deans nominated by the Chancellor on a rotational basis; (g) Registrar - Non-member Secretary. (2) The powers and duties of the Board of Management shall be as prescribed by the Statutes.
23. Academic Council
(1) The Academic Council shall consist of the following members: (a) Vice-Chancellor - Chairperson; (b) Registrar - Secretary; (c) Such other members as may be prescribed by the Statutes. (2) The Academic Council shall be the principal academic body of the University and shall, subject to the Rules and Statutes made under this Act, coordinate and exercise general supervision over the academic policies of the University.

(2) The annual account of the University shall be audited by auditors, who are a member of the Institute of Chartered Accountants of India (I.C.A.I.), every year. (3) A copy of the annual accounts and the Balance sheet together with the audit report shall be submitted to the Board of Governors well before 31 December following close of the Financial Year in 31 March each year. (4) The annual accounts, the Balance sheet and the audit report shall be considered by the Board of Governors at its meeting and the Board of Governors shall forward the same to the Visitor and the State Government along with its observations thereon before the 31st December each year.
