2. Amendment of Section 115
In section 115 of the Code of Civil Procedure, 1908 (hereinafter referred to as the principal Act), in sub-section (1), for the proviso, the following proviso shall be substituted, namely:— "Provided that the High Court shall not, under this section, vary or reverse any order made, or any order deciding an issue, in the course of a suit or other proceeding, except where the order, if it had been made in favour of the party applying for revision, would have finally disposed of the suit or other proceedings."
3. Amendment of Section 1 of Act No. V of 1908
In section 1 of the principal Act, in sub-section (1), for the words and brackets "Code of Civil Procedure, 1908", the words and brackets "Code of Civil Procedure, 1908 (as amended in its application to Uttaranchal)" shall be substituted. (1) This Act may be called the Code of Civil Procedure (Uttaranchal Amendment) Act, 2005. (2) It shall come into force on such date as the State Government may, by notification in the Gazette, appoint.
