Uttarakhand Sri Dev Suman Uttarakhand University Act, 2011
1. Short title, commencement and extent
(1) This Act may be called the "Sri Dev Suman Uttarakhand University" Act, 2011. (2) It shall come into force at once. (3) It shall extend to such parts of the State as the State Government may, by notification in the Gazette, appoint.
2. Definitions
In this Act, unless the context otherwise requires: (a) "Affiliated College" means an institution affiliated to the University in accordance with the provisions of this Act and the statutes made thereunder; (b) "Approved Institution" means an institution of higher education approved by the University/State Government; (c) "Autonomous College" means a college declared as such by the provisions of the University Grants Commission; (d) "College" means any college or institution affiliated to the University in accordance with this Act and the statutes made thereunder; (e) "Existing College" means such college or institution which is providing higher/professional education and is being managed and maintained by any university established in the State; (f) "Other Backward Classes of Citizens" means the Backward Classes of citizens specified in Schedule 1 of the Uttar Pradesh Public Services (Reservation for Scheduled Castes, Scheduled Tribes and Other Backward Classes) Act, 1994 (as applicable and modified) Order, 2001; (g) "Academic Council" means the Academic Council of the University; (h) "Chancellor" means the Chancellor of the University; (i) "Court" means the Court of the University; (j) "Director" means the head of the institution established by the University for the organization and conduct of teaching and research in any subject; (k) "Executive Council" means the Executive Council of the University; (l) "Finance Committee" means the Finance Committee of the University; (m) "Government" means the Government of Uttarakhand; (n) "Registrar" means the Registrar of the University; (o) "State" means the State of Uttarakhand; (p) "Statutes", "Ordinances", and "Regulations" means respectively the Statutes, Ordinances and Regulations of the University; (q) "University Grants Commission" means the University Grants Commission established under the University Grants Commission Act, 1956; (r) "Prescribed" means prescribed by Regulations; (s) "Principal" means the head of a college, by whatever name called, and includes, where there is no Principal, a person duly appointed to act as Principal, and in the absence of the Principal or Acting Principal, a Vice-Principal duly appointed as such; (t) "Regulation" means the Regulations of the University made under this Act; (u) "University" means the University established under Section 3 of this Act; (v) "Constituent College" means an institution maintained by the University or the State Government and declared as such under the Statutes; (w) "Maintenance Grant" means the grant-in-aid received by a college from the State Government from time to time by general or special order; (x) "Management" in relation to an affiliated or constituent college or self-financed institution means the managing committee or other body on which the responsibility for the management of the affairs of that college or institution lies, and which is recognized as such by the University; (y) "Officers of the University" means the officers mentioned in Section 8 of the Act; (z) "Property" in relation to an affiliated or associated college includes all movable and immovable property which belongs to the college or is given for the benefit of the college, whether fully or partially, including land, buildings (including hostels), workshops, libraries, laboratories, equipment, tools, furniture, stationery, stores, motor vehicles or other vehicles, if any, and all items related to the college such as cash in hand, bank deposits, investments and recorded loans and all rights and interests of such property, which are under the ownership, possession, authority or control of the college and includes account registers and all other records of any nature and all existing liabilities, obligations and legal encumbrances of the college, of whatever category they may be; (aa) "Registered Graduate" means a graduate of the University registered under the provisions of this Act and any Act repealed or superseded by it; (ab) "Self-financed institution" means such college or institutions which have been granted affiliation by the University in accordance with this Act, the Ordinances and Statutes made thereunder; (ac) "Teacher" means a person employed in an affiliated or associated college for the purpose of imparting teaching and/or for the guidance of research and extension work, and includes the Principal.
3. Establishment and incorporation of the University
(1) A University shall be established by the name of "Sri Dev Suman Uttarakhand University". (2) The University shall be a body corporate by the name specified in sub-section (1), and shall have perpetual succession and a common seal, and shall sue and be sued by its name. (3) The headquarters of the University shall be located at Badshahithaul, District-Tehri Garhwal, and it may establish its additional campuses at such other places as it deems necessary with the prior approval of the State Government.
4. Exercise of powers in the territorial jurisdiction
(1) For the exercise of its powers under this Act, the jurisdiction of the University shall be in the Garhwal Division. (2) Every college or institution other than those providing higher/professional education existing on the date of commencement of this Act shall, from such date as may be notified by the State Government for this purpose, be deemed to be affiliated to the University established under Section 3, and shall no longer remain affiliated or associated with the Uttar Pradesh State University Act, 1973 (as applicable in Uttarakhand) currently (H.N.B. Garhwal University), hereinafter referred to as the 'Earlier University' in this section: Provided that any student receiving education in any college or institution other than the existing college on the date of commencement of this Act shall be entitled to continue and complete such education under the Earlier University, and he shall also be permitted to do so, and the Earlier University shall conduct the examination of such student in accordance with the procedure in force at the time in the University and shall confer the degree or any such other academic distinction upon him.
5. Power of the State Government to issue notification
The State Government may, by notification in the Gazette: (1) Reduce or increase the area or academic jurisdiction of the University. (2) In any notification under this section, provide for the amendment of the Schedule and those University Statutes, Ordinances and Regulations affected by such notification, as may be necessary to make the provisions of this Act effective, and thereafter the Schedule and the relevant Statutes, Ordinances and Regulations shall be amended accordingly. (3) Without prejudice to the generality of the provisions of sub-section (2), in any notification under this section, it may provide for the following matters; namely: (a) Provisions related to the representation of persons of various interests or categories in the authorities of the University affected by the said notification; (b) Provisions for the registered graduates of any then existing university to continue as registered graduates of the same university or to exercise the option of getting registered in a newly established university, provided that no person shall be a registered graduate of more than one university; (c) Such other supplemental, incidental and consequential provisions as the State Government may deem necessary from time to time.
6. University to be open to all classes and creeds
The University shall be open to all persons, regardless of their class, caste, gender or creed, but nothing in this section shall prevent the University or the Government from exercising their powers to prevent discrimination in respect of persons, persons of a particular background, caste or class, as has been approved by the Legislature: Provided that nothing in this section shall be deemed to prohibit the University from making special provisions for the admission of students belonging to the Scheduled Castes, Scheduled Tribes, Other Backward Classes and other persons, as may be determined by the Government.
7. Powers and duties of the University
The University shall have the following powers and duties; namely: (a) To make arrangements for teaching in such subjects as the University deems appropriate, and for the advancement and dissemination of knowledge in research and extension work, including advisory services: Provided that the fields of research and extension work shall be encouraged in such a manner that the functions of teaching are not transgressed due to the emphasis on higher education/knowledge; (b) To re-orient teaching, research and extension work, and to consult and cooperate with other universities and institutions, and to encourage entrepreneurship in such a manner as the University deems appropriate, which may include the establishment of inter/multi-disciplinary centres/departments to accelerate academic advancement and scientific research and to keep pace with new social demands; (c) To affiliate the University with national, international and other institutions for the expansion of educational possibilities, and to remain associated with them; (d) To work in the direction of moral character and capacity building of students with the intention of equipping them to enter the job market and to make them competitive, to encourage entrepreneurship among them, and to play a positive role as sensible citizens; (e) To institute chairs, degrees, diplomas and other academic distinctions; (f) To grant the privilege of affiliation or recognition to any college or self-financed institutions of various names, or to increase the privileges of any college already affiliated or recognized as the case may be, or to withdraw or reduce such privileges, and to provide guidance to and control the work of affiliated and associated colleges and self-financed institutions; (g) To conduct examinations for such persons (without discrimination of any gender, caste, creed or disability) who have studied any course, as per the conditions laid down in the statutes and ordinances, in the University campus, constituent or affiliated or associated college or self-financed institution, or have conducted research work under any institution recognized for this purpose by the University or under a distance education program, or who have achieved excellence in any field, and to confer degrees, diplomas and other academic distinctions; (h) To confer honorary degrees or other academic distinctions under the manner and conditions specified in the statutes; (i) To cooperate or collaborate with other universities, institutions and authorities in such manner and for such purposes as the University deems appropriate; (j) To institute such academic and other posts as required by the University after the permission of the State Government, and to appoint persons to such created posts after the approval of the State Government; (k) To determine the terms and conditions regarding the affiliation and recognition of colleges and self-financed institutions and to satisfy itself by inspections or otherwise from time to time that such...

29. Constitution of Finance Committee
(1) (a) Vice-Chancellor; (b) Finance Secretary to the State Government or his representative, who shall not be below the rank of Joint Secretary; (c) Registrar; (d) One such person nominated by the Executive Council to represent the Executive Council, who possesses profound experience of financial matters. The person to be elected shall not be a member of the management committee of the university or any affiliated college, self-financed institute or associated college, or a person serving such a college; (e) A person nominated by the State Government, who is of repute in the field of finance or education; (f) Controller of Examinations; (g) Finance Officer, who shall also be the secretary of the committee. (2) The Finance Committee shall advise the Executive Council on matters related to the administration of the property and funds of the University. Keeping in view the income and resources of the University, it shall fix the limit of total recurring and non-recurring expenditure for the succeeding financial year and for any special reasons, it may revise such fixed expenditure limit during the financial year and such fixed limit shall be binding on the Executive Council: Provided that the provisions of this sub-section shall not apply to the powers vested in the Vice-Chancellor under sub-section (7) of section 12 and the additional expenses incurred shall be met by saving from other items of the budget. (3) The Finance Committee shall have such other powers and duties as may be conferred or imposed upon it by this Act or the Statutes. (4) Until such proposal with financial implications is recommended by the Finance Committee, the Executive Council shall not take a decision on it and if the Executive Council disagrees with the recommendations of the Finance Committee, it shall return the proposal to the Finance Committee with the reasons for disagreement and if the Executive Council again disagrees with the Finance Committee's recommendation, the matter shall be referred to the Government for decision, which shall be final.
30. Examination Committee
(1) There shall be an Examination Committee in the University which shall be constituted in the form as set out in the Statutes. (2) The committee, generally, shall supervise all examinations of the University, including moderation and tabulation, and shall perform the following other functions, viz: (a) To appoint examiners and moderators and to remove them if necessary; (b) To review the results of the examinations of the University from time to time and to submit a report in this regard to the Academic Council; (c) To make recommendations to the Academic Council for improvement in the examination system; (d) To review the list of examiners proposed by the Boards of Studies and provide them with a final form. (3) The Examination Committee may appoint as many sub-committees as it deems fit and in particular, may delegate the power to take action and make decisions in relation to cases related to the use of unfair means by examinees to one or more persons or sub-committees. (4) Notwithstanding anything contained in this Act, the Examination Committee or as the case may be, the sub-committee or any person to whom the Examination Committee has delegated its powers under sub-section (3) for this purpose, shall have the power to debar any examinee from further examinations of the University, if in its opinion, such examinee is guilty of using unfair means in any such examination.
31. Other Authorities
The constitution, powers and duties of other officers of the University shall be as prescribed.
32. Inspection/Visit
(1) The State Government shall have the right to cause an inspection of examinations, teaching and other work in any college and self-financed institute, including its buildings, libraries, laboratories, workshops and equipment, by such person or persons as it may direct or to inquire into any matter related to the administration or finance of the University or colleges, institutes or self-financed institutes affiliated to or associated with it. (2) Where the State Government decides to have any inspection or inquiry conducted under sub-section (1), it shall inform the management system of the college and a representative appointed by the management system and if the management system fails to appoint a representative, the Principal of the college may be present at the time of such inspection or inquiry and he shall have the right to be heard on behalf of the management system, but no law practitioner on behalf of the college/institute shall be present or appear at the time of such inspection or inquiry. (3) The person or persons appointed to conduct the inspection or inquiry under sub-section (1) shall, for the purpose of taking evidence on oath and compelling the attendance of witnesses and the production of documents and material objects, while considering any suit under the Code of Civil Procedure, 1908, have all the powers of a civil court and such person or persons shall be deemed to be a civil court within the meaning of sections 345 and 346 of the Code of Criminal Procedure, 1973, and any proceedings before him or them shall be deemed to be judicial proceedings. (4) The State Government may inform the management system of the college of the result of such inspection or inquiry and it shall immediately comply with the instructions regarding the action to be taken. (5) The State Government shall inform the Vice-Chancellor about the information given to the management system under sub-section (4) and the Vice-Chancellor shall inform the Executive Council about the view of the State Government and the advice to be given by the State Government regarding the action to be taken thereon. (6) Thereafter, the Vice-Chancellor shall submit a report of the action taken or to be taken by the Executive Council within such time as the State Government may determine. (7) If the authorities of the University do not take action to the satisfaction of the State Government within a reasonable time, the State Government, after considering any explanation that the University authorities may submit, may give such directions as it deems fit and the University authorities shall be bound by such directions.
33. Affiliation
(1) The Executive Council, with the prior approval of the Chancellor, may grant the privilege of affiliation to a college that fulfills such conditions of affiliation as may be prescribed, or may extend, withdraw or reduce the privileges of an already affiliated college. (2) It shall be lawful for a college to make arrangements to receive assistance in teaching or research work from any other college or university situated in the same local area. (3) Except as otherwise provided by this Act, the management system of a college shall be independent in managing the affairs of the college and shall be responsible for its maintenance and upkeep, and its Principal shall be responsible for maintaining discipline among its students and for the supervision and control over its staff. (4) Every college shall submit such reports, returns, and other particulars as the Executive Council or the Vice-Chancellor may require. (5) The Executive Council shall cause an inspection of each college to be conducted from time to time at intervals not exceeding five years by one or more persons authorized by it in this behalf, and the inspection report shall be sent to the Executive Council. (6) The Executive Council may give instructions to any college inspected in this manner for taking such action within such period as may be specified, as it may deem necessary. (7) The privilege of affiliation of any such college which fails to comply with any instruction of the Executive Council under sub-section (6) or fails to fulfill the conditions of affiliation, may be withdrawn or reduced in accordance with the provisions of the Regulations with the prior approval of the State Government, after obtaining a report on that matter from the management system of the college. (8) Notwithstanding anything contained in sub-sections (2) and (7), if the management system of any college fails to fulfill the conditions of affiliation, the State Government may, after obtaining a report from the management system and the Vice-Chancellor, withdraw or reduce the privilege of affiliation.
34. Disqualification for Membership of Management System
Any person shall be disqualified for being elected or remaining a member of the management system of any college, other than a college maintained by the State Government or local authority, if he or his relative accepts any remuneration for any work done in such college or on its behalf, or accepts any contract for the supply of goods to such college or for the execution of any work on its behalf.
35. Statutes
(1) Subject to the provisions of this Act, provision may be made in the Statutes for all or any of the following matters, viz: (a) The constitution, powers and duties of the authorities and other bodies of the University, the qualifications and disqualifications for membership of such authorities, the qualifications and disqualifications for membership of other bodies of such authorities, the appointment and removal from office of its members and other matters connected therewith; (b) The appointment, powers and duties of the officers of the University; (c) The appointment, terms and conditions of service of the employees of the University and their powers and duties; (d) The terms and conditions subject to which institutions may be associated with the University; (e) The administration of the University, the establishment and abolition of colleges and institutions, the granting and withdrawal of affiliation to colleges, the award of fellowships and scholarships, and other similar work of the institutions, the granting of degrees and other academic distinctions, and the granting of certificates and diplomas; (f) The procedure for conducting the meetings of the authorities of the University; (g) Any other matter of the University which is necessary for the proper and effective management and conduct of the work of the University and for which provision is to be or can be made by this Act or by the Statutes. (2) The first Statutes shall be made by the State Government by notification in the Gazette. (3) The Executive Council may from time to time make new or additional Statutes or amend or repeal the Statutes in the manner prescribed in the proviso to this section: Provided that the Executive Council shall not make any Statute or hold any amendment thereto by the Executive Council affecting the status, powers or constitution of any existing authority of the University until such authority has been given an opportunity to express its opinion on the proposal and such expressed opinion shall be in writing and shall be considered by the Executive Council: Provided further that the Executive Council shall make any Statute affecting the discipline of students and the standards of instructions, education and examination only after consultation with the Academic Council, and not otherwise. (4) The approval of the Chancellor shall be required for every new Statute or addition to or repeal of the Statutes, who may grant permission or withhold permission or return the Statute with amendment for the consideration of the Executive Council. (5) No new Statute or amendment or repeal of an existing Statute shall be valid until the Chancellor grants approval thereto. (6) Notwithstanding anything contained in the preceding sub-sections, the State Government, in the interest of the State or National Education Policy or on the basis of the advice/recommendations of the University Grants Commission, may, with the approval of the Chancellor, make new or additional Statutes or amend or repeal the Statutes already in force.
36. First Ordinances
(1) Subject to the provisions of this Act and the Statutes, the First Ordinances may provide for all or any of the following matters, namely: (a) the admission of students, the admission of research students, and the courses of study and the fees therefor, the qualifications pertaining to the award of degrees, diplomas, certificates and other academic distinctions, fellowships, awards and the like; (b) the conduct of examinations, including the terms of office and the appointment of examiners and the conditions of residence of students and their general discipline; (c) the management of colleges and the superintendence of colleges admitted to or maintained by the University; (d) any other matter which by this Act or the Statutes is to be or may be provided for by the Ordinances. (2) The First Ordinances shall be made by the Vice-Chancellor with the prior approval of the Government and the Ordinances so made may be amended, repealed or added to at any time by the Executive Council in the manner prescribed by the Statutes.
37. Regulations
The University may make regulations for the conduct of the business of the University and the committees appointed by it, not inconsistent with this Act, the Statutes and the Ordinances for matters which by this Act, the Statutes or the Ordinances are to be provided for, in the manner prescribed by the Statutes.
38. Annual Report
(1) The annual report of the University shall be prepared under the direction of the Executive Council, which shall include, among other matters, the steps taken by the University towards the fulfilment of its objects. (2) The annual report so prepared shall be submitted to the Chancellor on or before such date as may be prescribed.
39. Accounts and Audit
(1) The annual accounts and balance-sheet of the University shall be prepared under the directions of the Executive Council and shall, at least once in every year and at intervals of not more than fifteen months, be audited by the Director, Local Fund Audit, Uttarakhand or such person or persons as the State Government may authorize in this behalf. (2) A copy of the annual accounts and the balance-sheet together with the audit report thereon shall be submitted to the State Government annually before 30th September along with the observations of the Executive Council, if any. (3) The observations of the State Government on the annual accounts shall be brought to the notice of the Executive Council. The views of the Executive Council on such observations, if any, shall be submitted to the State Government.
40. Surcharge
(1) Whenever the State Government receives any complaint regarding loss, waste or misapplication of any money or property of the University, or the State Government itself deems it appropriate, it may direct a special audit of the University by the Director, Local Fund Audit, Uttarakhand or any officer subordinate to him. (2) Upon receipt of the special audit report, the State Government, after issuing a notice to the officer of the University whose neglect or conduct contributed to the loss, waste or misapplication referred to in sub-section (1), shall require him to explain his actions within the time fixed by the State Government in this behalf. (3) After considering the audit report and the response of the officer referred to in sub-section (2), the State Government may arrive at an appropriate decision in this behalf. (4) If the State Government is of the opinion that the officer should be held liable for the payment of the surcharge determined by the State Government, then the surcharge shall be recovered as arrears of land revenue or in such other manner as may be directed by the State Government.
41. Mode of appointment of officers and members of authorities
(1) Except where otherwise expressly provided by this Act or the Statutes, the members of officers and authorities shall be chosen in a manner other than by election as far as possible. (2) If provision is made for any appointment by rotation or seniority or according to other qualifications in this Act or the Statutes, the manner of determining such rotation, seniority, and other qualifications shall be such as may be prescribed.
42. Filling of casual vacancies
(1) Any casual vacancy among the members (other than ex-officio members) of any authority or body of the University shall be filled in the same manner as the member whose vacancy is to be filled was chosen, and the person filling the vacancy shall be a member of such authority or body for the residue of the term for which the person whose place he fills would have remained a member. (2) Any person who is a member of any authority of the University as a representative of another body, whether that body is of the University or external, shall continue to be a member of such authority as long as he remains a representative of such body.
43. Proceedings not to be invalidated by vacancies, etc.
No act or proceeding of any authority or body or committee of the University shall be invalid merely by reason of: (a) any vacancy or defect in the constitution thereof; or (b) any person having taken part in the proceedings who was not entitled so to do; or (c) any defect in the election, nomination or appointment of a person acting as a member thereof; or (d) any irregularity in its proceedings not affecting the merits of the case.
44. Removal from membership of the University
The Executive Council may, by a two-thirds majority of the members present and voting, remove any person from the membership of any authority or other body of the University on the ground that such person has been convicted of an offence involving moral turpitude or on the ground that he is guilty of scandalous conduct or has behaved in a manner unbecoming of a member of the University, and may on the same grounds withdraw any degree, diploma or certificate conferred or granted by the University.
45. Reference to the Chancellor
If any question arises as to whether any person has been duly elected or appointed as, or is entitled to be, a member of any authority or other body of the University, or whether any decision of any authority or officer of the University (including any question as to the validity of a regulation) is in conformity with this Act or the regulations made thereunder, the matter shall be referred to the Chancellor and the decision of the Chancellor thereon shall be final.
46. Bar of suit
No suit shall be instituted or no other legal proceedings shall be taken against the State Government or the University or any officer, authority or body in respect of any act done or purported to be done in pursuance of this Act or the regulations made thereunder.
47. Mode of proof of University record
(1) A copy of any receipt, application, notice, order, proceeding or resolution of any authority or committee of the University or any entry in a register duly maintained in the possession of the University, if certified by the Registrar, shall be received as prima facie evidence of such receipt, application, notice, order, proceeding, resolution, document or entry in the register, and shall be admitted as evidence of the matters and transactions therein recorded in the same manner as if the original had been produced. (2) No officer or servant of the University shall, in any legal proceeding to which the University is not a party, be required to produce any document, register or other record of the University, or to appear as a witness to prove the contents of such record, by certified copy under sub-section (1), unless so ordered by the Court for special reasons.
48. Right of appeal
Notwithstanding anything contained in this Act, every employee or student of the University or constituent college or affiliated college shall have the right to appeal to the Executive Council within the specified time against any decision of the University or affiliated college, and thereupon the Executive Council may confirm, modify or change the decision against which the appeal has been made.
49. Power to remove difficulties
(1) The State Government may, for the purpose of removing any difficulty, by notified order, direct that the provisions of this Act shall take effect in such period as it may deem necessary or expedient, whether in the form of modifications, additions or gains, as it deems fit. (2) No order under sub-section (1) shall be made after the expiration of a period of two years from the date of commencement of this Act. (3) Every order made under sub-section (1) shall be laid before the State Legislative Assembly. (4) No order under sub-section (1) shall be challenged in any court on the ground that the difficulty referred to in sub-section (1) did not exist or was not required to be removed.
