Power to prohibit obstruction etc., in flood plain
The Uttarakhand Flood Plain Zoning Act(1) Where the State Government is satisfied that it is necessary to prohibit or restrict activities in the flood plains in the interest of public health, safety or property or in the interest of reducing inconvenience to the general public, the Government may, by notification in the Official Gazette, specify the area in which such prohibition or restriction is to be enforced and the nature and limit of such prohibition or restriction: [Note: Text truncated in original file provided] (1) Provided that no notification under this sub-section shall be issued after the expiry of 18 months from the date of publication of the notification issued under section 8. (2) Notwithstanding anything contained in any law, custom, agreement or instrument for the time being in force, the prohibitions or restrictions specified in such notification shall prevail upon the publication of the notification under sub-section (1). (3) No person shall commence any activity in the restricted or prohibited zone without the prior permission of the Flood Plain Zoning Authority: Provided that where a person applies for permission to commence any activity under this section to the Flood Plain Zoning Authority and the Flood Plain Zoning Authority does not inform the said person of the rejection of the applied permission within a period of 90 days from the date of receipt of such application, it shall be deemed that the Flood Plain Zoning Authority has granted the said permission.
