Uttarakhand Fisheries and Fish Stocking Rules , 2003
1. Short title, Extent and commencement
(1) These rules may be called the Uttarakhand State Water Management, Fisheries and Fish Stocking Rules, 2003. (2) It extends to the whole of the State of Uttarakhand. (2) It shall come into force at once.
2. Definitions
(1) In these rules, unless there is anything otherwise required in the subject or context- (1) “Act” means the Uttarakhand Fisheries Act, 2003; (2) “Beat” shall have the meaning which is fixed in these rules as determined limited area for fishing ; (3) “Director” means Director, Fisheries Uttarakhand; (4) “Pond” means jheel, pond, Johad, Puddle etc.; (5) “Weighing centre” means the place fixed by the director or any person authorised on his behalf, where the caught fish are stocked; (6) “License” means the license issued to the executive Institution/ Units of Fishery department/ other related departments under these rules; (7) “Permit” means the permission of angling/ fishing issued by the competent institution/ person/ officer under these rules; (8) “Angling” means fish sports/ fishing; (9) “Appendix” means the appendix annexed with these rules; (10) “Trout waters” means such stretches of river or streams where trout fish is being developed; (11) “Mahseer waters” means such stretches of rivers or streams and jheels where mahseer fish is as main fish; (12) “General waters (hilly area)” means such stretches of river or streams of hilly area which is for snow trout and not main stretches for mahseer; (13) “Major carp waters (plain area)” means such stretches of river or streams and pond of plain area where the fisheries of Indian Major Carp species are as main fish; (14) “Year” means financial year; (15) “State” means State of Uttarakhand.
3. Declaration of waters other not being private waters
(1) The State Government shall, by notification, declare the following waters other than private waters, namely— (a) Rivers and streams; (b) Waters of jheels; (c) Johad, Puddle and pond (plain area) waters ; (d) Reservoir waters. (2) The State Government may, by notification, divide all rivers and streams which are flowing naturally, on the basis of compatibility and availability of geographical and fisheries species, namely— (a) Trout waters of rivers and stream; (b) Mahseer waters of rivers and stream; (c) Common waters (hilly area) of rivers and stream; (d) Major carp waters (plain area) of rivers and stream. (3) In small cold stream of fast flow to be supplied from glacier in trout waters, which are suitable for the fish of trout species, following areas shall be included, namely— (i) River Song, river Tons and its tributaries, the area within district Uttarkashi and Dehradun upstream Tyuni; (ii) River Pinder and its Tributaries upstream Karnaprayag, Nandakini river and its tributaries upstream Nandprayag, River Balkhila upstream Balkhila. River Birahi upstream Birahi and Kalpganga upstream Helang, the area within district of Chamoli; (iii) River Mandakini and its tributaries upstream Augstmuni, area within the district of Rudraprayag. (iv) River Asaiganga from Gangori to Dodital and River Bhagirathi and its tributaries upstream Gangori, area, within district Uttarkashi; (v) River Saryu and its tributaries upstream Kapkot within the area of district Bageshwar; (vi) River Purvi Ramganga and its tributaries upstream Tejam, area within district Pithoragarh; (vii) River Gori and its tributaries upstream Madkot, within the area of district Pithoragarh; and (viii) River Kali and its tributaries with river Dhaouli upstream Dharchula, area within the district Pithoragarh. (4) In small water streams of natural source medium flow in Mahaseer waters, which are suitable for the fish of Mahseer species, following area shall be included, namely— (i) River Yamuna and its tributaries from Barkot to Dakpatthar and Asan Bairraj and River Song, the area within district Dehradun; (ii) River Ganga and its Tributaries from Devprayag to Haridwar, the area within district Pauri, Tehri and Dehradun; (iii) River Nayaar and its tributaries, Khoh Nadi within district Pauri. Ramganga (w) and its tributaries from Nachni middle of Rameshwar, area within the district Pauri and Almora; (iv) River Ramganga (w) and its tributaries, river Kosi and its tributaries to Khairna bridge, within the area of district Almora; (v) River Kali and its tributaries from Thuligaad to Broom, area within the district Pithoragarh; (vi) River Ladhiya and its tributaries, river Lohawati and its tributaries and river Kali and its tributaries within the area of district Champawat, and (vii) River Saryu and its tributaries between Sheraghat to Pancheshwar and river Gomati and its tributaries, area within district Bageshwar. (5) In general waters (hilly area) where large rivers of long bridges with slow flow are included which are suitable for snow trout species fishery, following waters are included— (i) Tons and its tributaries from Tyuni to Dakpatthar, area within the district Dehradun; (ii) River Bhagirathi and its tributaries from Gangori to Dharasu, district Uttarkashi and from Tehri Bandh to Devprayag, area within district Tehri; (iii)River Bhilangna and its tributaries upstream Pilakhi, area within Tehri district; (iv) River Yamuna and its tributaries from Barkot to Damta, district Uttarkashi from Damta to Yamuna bridge, district tehri and downstream Dehradun and Yamuna bridge in Dehradun, area within the range of State of Uttarakhand; (v) River Ganga from Devprayag to Rishikesh, district Tehri and Pauri, from Rishikesh to Haridwar, district Dehradun and Pauri and downstream Haridwar within the range of State of Uttarakhand; (vi) River Alaknanda and its tributaries from Devprayag to Khankra, district Tehri and Pauri, from Khankra to Ghultir district Rudrapryag and upstream Ghultir, area within district Chamoli; (vii) River Mandakini and its tributaries from Rudraprayag to Agustmuni, area within district Rudraprayag; (viii) River Wholly Ramganga (w) and its tributaries, area within district Chamoli, Pauri, Almora and Nainital; (ix) River Kosi and its tributaries upstream Kherna bridge, area within district Nainital and Almora; (x) River Saryu and its tributaries from Kapkot to Seraghat, area within district Almora, Bageshwar and Pithoragarh; (xi) River Ramganga (E) and its tributaries between Nachni to Tejam area within district Pithoragarh; (xii) River Kali and its tributaries, area within district Pithoragarh between Jhoolaghat to Dharchula; and (xiii) River Gori and its tributaries, area in the range of district Pithoragarh between Jouljivi to Madkot. (6) In the major carp water (plain area) of rivers and streams, following waters shall be included— (i) River Ganga and its tributaries within the range of district Haridwar and other rivers in the limit of State of Uttarakhand; (ii) River Shardha within the range of district Udham Sing Nagar and other rivers within the extent of State. Note:- Details of important rivers and their tributaries of the Uttarakhand are mentioned in the Appendix- I.
4. Waters of Jheel
(a) The state Government may divide such waters where the fisheries is available naturally and area of which place is more than 0.2 hectare and located in 1000 to 4000 meter A.S.L. as follows- (i) All those pond or natural waters, which are located at the height of more than 1500 metre ASL and wherein trout fish are available or may enrich, protect and develop the fish of trout species in future. (ii) All those pond or natural waters which are located at the height of less than 1500 meter ASL and wherein Mahseer fish are available or may enrich, protect and develop the fish of Mahseer species in future. (iii) All those Natural waters or pond, which are located at the height or pond, which are located the height of not less than 1000 meter ASL and wherein fish are available or may be produced. Note: Details of important pond /(Jheels of Uttarakhand are mentioned in Appendix-II (b) (i) Such waters of plain area where fisheries are available and area of which place is more than 0.20 hect. (ii) Such reservoir in which fish are available or may be produced includes all artificial waters prepared on river system which are used in several work or proposed for future. Note: (i) Details of important reservoir of Uttarakhand are mentioned in Appendix III. Note: (ii) In Addition to the reservoir mention in abovesaid Rules 3 (i), (a) (b), (c) and (d) of these Rules, these Rules shall applicable to all such reservoir in the state of Uttarakhand which are not mentioned above but they are not private waters.
5. Fixation of waters and appointment of Nodal Authority
The State Government may issue the order to keep the right of ownership in situ on rivers and streams, Jheels, pond, reservoir in the forest department, Gram Panchayat, Gram Samaj, Irrigation department, Local bodies; Provided that the State Government may appoint the Nodal authority for the execution of the affairs of enrichment, protection of fisheries, fisheries development, management, fisheries and fish stocking in such waters. Such Authority shall perform the said affairs under the relevant provisions of these Rules.
6. Determining the area of water reservoir for
(1) The State government may divide the rivers, streams, jheels and reservoir etc of hilly area and plain area with a view to
7. Constitution of committee for beat allocation
The state Government may constitute a committee for the allocation of beat in trout and Mahseer waters of rivers and streams, general waters (hilly area) of rivers and streams, jheels of trout and Mahseer waters and general Jheel (hilly area), which consist the following:- (1) Head of Department of the beat allocation department/Director- Chairman (2) Officer of the level of joint director/deputy director of said department,- Member Secretary; (3) District magistrate of concerned district or representative nominated by them,- Member; (4) Representative of the body mentioned under Rule 5,- Member
8. Procedure of beat allocation
(1) The details of the beats to be allocated shall be submitted to the beat allocation committee by the District lever fisheries officers through Director, fisheries after the discussion with the departments Concerned with the water reservoir, which shall invite tender for this purpose. (2) The directions regarding tender shall be determined by the concerned departmental secretary of the State Government (the department which is proceeding beat allocation) with the consent of Fisheries department (if fisheries department is not allocating the beats). (3) Other Procedure of tender shall be followed according to the Uttarakhand Procurement Rules, 2008 . (4) The term of contract of beat shall be of five years and term shall be calculated by including the duration till the next 30th June. (5) It shall be necessary to submit the consent letter for the consent of condition of the tender, security amount and certificate regarding the background of the institution and status certification given by the District Magistrate of concerned district along with the tender by the tenderer unit participating in the tenders. The tender of the concerned tenderer shall not be opened and also not considered the tender on not submitting such certificates. (6) The order and license regarding the consent of contract of fishery management and fisheries evacuation of water reservoir shall be issued by the head of department of the concerned department on the basis of recommendation of the committee provided in rule 7 after the approval of the State Government (Concerned department). (7) Licence for the contract of fishery management, Fishing and fish evacuation of concerned water reservoir to the executive institutions /persons shall be issued in the prescribed form (As per annexed in appendix IV).
9. Right of Beat Allocation
The State government may constitute a committee in the chairmanship of Director, fisheries for the beat allocation in existing rivers in the plain area, which consist the following:- (1) Departmental officer of the rank below than Director, fishery and Joint Director/deputy director, fishery- member Secretary; (2) District magistrate of concerned district/ their representative –Member. (3) Representative of other concerned department like irrigation, forest, Revenue, Panchayat, Nagar Palika etc, autonomous institution- Member
10. Beat Allocation in the rivers of plain area and procedure of Beat Allocation
(1) Beat shall be allocated in the rivers of plain area with the tender system. (2) The detail of the beat to be allocated shall be submitted to the beat allocation committee by the district level fisheries officers through Director, Fisheries after the discussion with the department concerned with the water reservoir which shall invite tender for this purpose. (3) The directions regarding tender shall be determined by the department secretary of the state government, (4) Other procedure of tender shall be followed according to the Uttarakhand Procurement Rules, 2008. (5) The term of contract of beat shall be of five years and term shall be calculated including the duration till next 30th June. (6) Tenderer or Participant in tender for consent on terms and condition shall present consent letter, security amount and character certificate conferred by concerned District magistrate (except Uttarakhand State Fisheries Development agency if participate in tender) and status certificate with the tender. (7) On the basis of recommendation of committee provided in rule 7, Order and license regarding permission of contract of fishing and fisheries managements of body shall be issued by Director fishery after prior approval of state Government. (8) License for contract of fisheries management, fishing and fish evacuation shall be issued to concerned working institution/ person in Prescribed form (according to annexed appendix 4) .
11. Minimum Terms and condition for allocation of beat in rivers of plain area
(1) Term of contract of rivers of plain area shall be five year which shall be calculated by including duration of next 1st July to 30th June. In first year this duration shall commence on date of permission and shall be deemed to finish on 30th June. Every year increment of 10 percent shall be accented in approved tender amount and shall be paid according by Tenders. (2) After approval of highest bid/tender, it is compulsory to the tenderer/committee to execute the contract within maximum of two week. (3) Tenderer shall pay the stamp duty Payable under provision of
12. Directions regarding fish sports/ fishing by Angling and the net of two inch or large dimension
(1) Permit by the body prescribed in rule 5 shall be issued on the specified form (under annexed Appendix V). (2) The permit to be issued shall be invariable/ non transferrable. (3) The validity of Angling permit to be issued as above shall be for one day. (4) In the abovesaid permit the permission of fish sport/ fishing by angling shall be permissible from sunrise to sunset. (5) Number of the fish caught from Angling / fishing by the body prescribed in rule 5 and details of the income acquired from the issued Angling/ fishing permit shall be maintained separately for each day. (6) (i) If beat allocation is issued by the Fishery Department for fish sport/ fishing by angling or from the net of two inch or large size dimension, then 80 percent of the acquired income from the beat fee shall have to deposit in the account head of the relevant department receipt of State Government of fishery department and 20 percent, in the account head of relevant departmental receipt of State Government of the department of ownership of waters as a royalty of the waters. (ii) If the beat is issued by the department with the ownership of related waters, 80 percent of the acquired income from beat fee shall have to deposit in the account head of the relevant department receipts of the State Government of the department with ownership of water and 20 percent, in the account of relevant department receipts of the State Government of fishery department as the cost of fish seed. (iii) If the beat is allocated by the tourism department, 20 percent of the earned income from the beat fee shall have to deposit in the account head of relevant department receipts of State Government of fishery department as the cost of fish seed and remaining 80 percent shall be distributed between the tourism department and the department with the ownership of waters in the ratio which has been determined by the tourism department and department with the ownership of waters with mutual consent. Accordingly the said amount shall also have to deposit in the relevant departmental receipts. (7) It is necessary to every license holder/ permit holder to show the license/ permit on the demand of person authorised in sub section (1) of section 8 of the Act. Any person shall be liable for the punishment under the provision of Section 5 of the said Act on fishing without permission by any method. (8) Beat allocator department/ Officer or territorial offices of fisheries department shall authorise to cancel the permit/ license of the permit/ license holder on the violation of Act or any provision or part thereof made thereunder. (9) Fisheries/ catching the trout/ Mahseer fish, more than four in a day, by the permit/ license holder, shall be prohibited. (10) It shall required by the anglers and their associates to maintain complete tranquility, minimum activity and minimum interfare in the environment. (11) During angling in water reservoir under control of forest department, on violation of various Acts or rules made thereunder applicable in the state by the angler/ anglers the prescribed body may immediately ban/ cancel such angling but if beat has been allocated by any other department except the fishery department or forest department, in such case fishery or forest department shall forward the recommendation of cancellation of the licence to the concerned department by which the beat allocation license has been issued. Proceeding of cancellation of the beat allocation licence may be done accordingly. (12) The fishing shall be prohibited completely during the breeding season mentioned appendix 6(1) and appendix 6(2) of in these rules in all water reservoirs mentioned in sub-rule 11; Provided that in local melas related to the fishing/fish sports in the state like. Maud mela which held in district Tehri/Dehradun/ Uttarkashi etc, the water reservoir within the range of meles shall keep free from the prohibited area with a view to the rights of local peoples; Provided further that Scheduled tribes and other traditional forest dwellers shall be permissible for the exemption for fishing for their own use with their traditional methods under Scheduled Tribes and other Tradition Forest. Dwellers (Recognition of Forest Rights) Act, 2006.
13. Directions by institutions regarding fishing through the tenders in water
(1) In any water, right of experimental fishing for research and exploration of fisheries resources at any time by any method shall be reserved for Director, fisheries or any officer authorized by him. (2) The right to cancel the licence and contract issued to any institution or person shall be vested on the Director, Fishery on the violation of Act and provisions or any part of it made thereunder. (3) It is necessary to every license holder/ permit holder to show license/ permit on demand of any person authorised in sub-section (1) of Section 8. (4) Beat wise allocated waters shall be given for fishing on the basis of bidding. (5) For beat wise bidding of purview, minimum amount shall be determined by the Director, Fishery with the consent of State Government. (6) Fishing of Mahseer of weight of less than 400 gram and fish of other species of weight of less than 250 gram under fishing shall be completely restricted. (7) Fishing with the net, one kilometer in the direction of the drift and one kilometer in the opposite direction of the drift of general waters from the interflow of Mahseer waters, shall be completely restricted. (8) Institution shall be permitted to use the net of minimum two inch dimension for fishing. (9) If the net of the small dimension from the determined minimum measurement is used by the institution, the contract of that institution shall be cancelled and legal proceeding against them shall be initiated. (10) In the allocated purview, there shall not permitted any kind of fishing in addition to the condition determined for fishing. (11) If, during fishing in the water reservoir under control of forest department, various Act and rules made thereunder are being violated, the concerned division forest officer may ban the fishing immediately and the recommendation of cancellation of the license of contract issued to the institution/ person shall be forwarded to the Director, Fisheries by the concerned divisional officer.
14. Enrichment of fisheries
(1) The body prescribed under rule 5 shall take the following steps for the enrichment of fisheries in cooperation of fisheries department-- (a) stocking of fish seed in the rivers and streams/ jheel/ pond/ waters as per their necessity; (b) stocking of fish seed in their adapted waters, by producing the fish seed in abundant quantity in the hatchery of departmental ownership; (c) after monsoon on decreasing the water level, stocking of small fish in the main stream by catching them, which are steeped in their river basin; (d) stocking of fish seed for reestablishment of water biological balance of the waters effected after the construction of dams on continuous flow rivers. (2) Such institution shall be liable for the promotion and protection of fisheries in the allocate beat wise purview to whom such beat shall allocate and for the promotion and protection of fisheries in rivers and jheels/ pond of trout and Mahseer waters, river and jheels/ pond of general waters (hilly area), the department owned the reservoir and the department issuing permit of angling/ fishing in the said area, with the cooperation of fisheries department, shall be liable. (3) In the allocated beat wise purview of person/ institutions, fish finger for fish seed stocking shall make available from the hatchery of departmental ownership on fix rates. (4) In the beat wise purview, the right to determine the species and quantity of seed shall be reserved for the Director, Fishery.
15. Directions regarding the restrictions regarding fish protection and fishing
Subject to the provision of the Act, the following restrictions shall be followed by the prescribed body for the fish protection— (1) Dynamiting, toxic chemicals and plant, electric current etc destructive experiments, in the water reservoir of fisheries shall be completely restricted but in view of bio diversity and environment, variation in the flow of stream shall be permitted to the same extent whereby the flow was not effected adversely. (2) Illegal methods of fishing shall be prohibited completely for saving the big fish along with their innumerable eggs and small fish from destruction. (3) The State Government may, from time to time, issue comprehensive direction to prohibit the invalid methods of illegal fishing for eliminating the adverse effect held on the water biological balance of river and streams. (4) The fishery department shall ensure to communicate the importance of the protection of important fish species like trout and Mahseer in the rivers and stream by ensuring the participants of department owned the water, institutions and local people. (5) Catching any fish of the weight of less than the following weight under fishing from angling and other fix methods shall be prohibited--- (i) Rainbow trout- weight of less than 300 grm (ii) Brown trout- weight of less than 300 grm (iii) Snow trout - weight of less than 250 grm (iv) Common carp- weight of less than 300 grm (v) Mahseer - weight of less than 400 grm (vi) Catla- weight of less than 500 grm (vii) Rohu- weight of less than 500 grm (viii) Nain- weight of less than 400 grm (ix) Silver carp - weight of less than 500 grm (x) Gras carp- weight of less than 500 grm (xi) Cania- weight of less than 300 grm Note- In addition to the abovesaid mentioned fish species, catching, destructing or selling of fish of other species of the weight less than 500 grm in plain area and of the weight less than 250 grm for hilly area shall be prohibited. (6) Fish caught of less than the specified weight under fishing from angling and other fix methods shall leave back in same water reservoir. (7) The concerned departments, while permitting to remove sand,
18. Business of fish, its transport and export from any territory.
(1) Director, fisheries may, from time to time, determine the due method regarding this part. (2) For obtaining the facilities related to the determined sites and its transport of transport/selling centre of fish, consent/Non objection shall also have to obtain from such local bodies by the fish seller/businessman with due method.
19. Apparatus of catching fish, confiscate /remove box/ bag of fish and fish
(1) The office bearer mentioned in appendix VII shall be empowered to seize or remove or confiscate the apparatus established or used for catching the fish contrary to the rules. (2) The office bearer mentioned in appendix VII shall also be empowered to forfeit all fish and box/ bag caught by any apparatus. (3) The office bearer, mentioned in appendix VII, may take required action under the provision of the Act against the concerned person for such offence in violation of aforesaid sub rules. (4) If the fish forfeited in sub rule (2)is alive, it shall be put in the reservoir on the same place immediately by the office bearer mentioned in appendix VIII and if fish is dead, after weighing it in the nearest weighing centre and selling on the prevalent rates, the acquired amount shall be deposited in the treasury.
20. Ban of stocking fish seed of prohibited fishery species Tilopiya, Bighead, Thai Mongur etc.
No person shall be allowed to stock the fish seed of Tilopiya species, Big head and foreign Thai Mongur in the pond, puddle, jheel, water, river and streams. Any person violating this rules shall be liable for the punishment provided under section 5 of the Act.
21. Fishing of the fish specified in Schedule 2 part-II (a) of the Wildlife Protection act, 1972 shall be prohibited
Fishing of the following fish specified in part II (a) of Schedule 2 of Section 9 of Wild Life Protection Act, 1972 shall be prohibited-- (1) Timi Grah (Rhynocodone Typus) (2) Grah and Prithika (i) Anoxipristis Kuspideta, (ii) Cachirhinus hamiodone, (iii) Glifius Gajatix, (iv) Glifius Glifius, (v) Himantura Flucea- Taryalas, (vi) Pristis Mycrodone, (vii) Pristis Jinstrone, (viii) Rihancobatus Diyedencita, (ix) Yurozimnus esperigus. (3) Grah and prithika (all elesmobranchy eye) Ashwamin (all Sighethediun) (4) Bheem groupesmin (Apnsefelus Lasiyo letus)
22. To keep the fishing craft and gears in the extent of specified area
No person shall keep the fishing craft and gears within the periphery of three kilometer of the specified waters, which are not private, in his jurisdiction. Office bearer appointed by the State Government shall empowered for confiscation of such fishing craft and gears for the proceeding against such person.
23. Right of Appeal
If it appears to the aggrieved party (permit holder of angling/ fishing or institution/ person who has been given the license/ contract of fishing) that the proper proceeding has not been made in his/ its matter, in such case he shall be entitled to appeal before State Government against the order given by lower rank officer within maximum one month from the date of issuing it. The decision given by the State Government regarding the matter in questioned shall be final and binding.
24. Power to remove difficulty
If any difficulty arises in giving effect to the provisions of these rules, the State Government may, by order which is not inconsistent with the provision of Act and these rules, remove the difficulty.
Appendix V (2). Necessary directions and conditions for the permit holder regarding the permission of Angling and fishing from the net
Necessary directions and conditions for the permit holder regarding the permission of Angling and fishing from the net of two inch or larger dimension should be printed on the back page of permit-- 1- Permit shall be permissible under the powers of the provisions of the Uttarakhand Fisheries Act, 2003. 2- Permit shall be non transferable/ non convertible. 3- The permit holder shall not convert (change) the place, for which the permit related to the permission of Angling and fishing by the net of two inch or larger dimension was issued by the permit issuing institution/ officer of department unless the permission is granted by the permit issuing institution. 4- The permit issuing Institution/ officer of department may deny to issue such permit to renew the said permit. If it/ he is satisfied that it is not appropriate in public interest to issue/ renew such permit. 5- It is obligation of the permit holder to show the permit to the person authorised by see 8(1) of the Uttarakhand Fisheries Act, 2003. 6- The permission of Fishing of any kind in addition to angling in the allocated purview in other water reservoir (except than the artificial water reservoir) of hilly area other than the general waters , hilly area and general jheel hilly area where the fishing is permitted also by the net of two inch or larger dimension along with Angling. 7- Fishing is permissible by the Angling from sun rise to sun set. 8- The permit holder shall not catch or kill or sale any fish of weight less than the weight marked in front of the fishery mentioned species wise in the following table: 1 Rainbow trout Weight of less than 300 gram 2 Brown trout Weight of less than 300 gram 3 Snow Trout Weight of less than 250 gram 4 Common carp Weight of less than 300 gram 5 Mahseer Weight of less than 400 gram 6 Catla Weight of less than 500 gram 7 Rohu Weight of less than 500 gram 8 Nain Weight of less than 400 gram 9 Silver Carp Weight of less than 500 gram 10 Grass Carp Weight of less than 500 gram 11 Cania fish Weight of less than 300 gram Note- In addition to the above said mentioned fishery species catching, killing or selling of other fishery species of the fish of the weight less than 500 gm in plain areas and the fish of weight less than 250 grm in hilly areas are prohibited.
