The Tripura Prevention of Defacement of Property Act, 1976
1. Short title, extent and application
(1) This Act may be called the Tripura Prevention of Defacemen1 of Property Act, 1976. (2) It extends to the whole of Tripura. (3) It shall apply in the first instance to Muncipal limits of Agartala town, but the State Government mdy, from time to time by notification in the Official Gazette, apply it to such other local area or arcas as may be specified in the notification.
2. Definitions
In this Act, unless thc context otherwise rcquires - (a) "defncemenl" includes impairing or interfering with the appearance or beauty, danvvging. disfiguring, spoiling or injuring in any other way whatsoever and the word "deface" shall be construed accortlingly ; (b) "property" includes any building, hut. structure. wall, tree, fcnce, post, pole or any other erection ; (c) "wriling" includes decoration, lettering, ornarnentatioh. erc., produced by stencil.
3. Penalty for defacement of property
(1) Whoever dcfaces any propcrty in public vicw by writing or marking with ink, chalk, paint or any other n~aterial, except Tor the purposc of indicating the name and address of tllc owner or occupier of such property, shall be punishable with imprisonment for n tern1 which nlay extend to six rnontlis or with fine which may extend to one thousand rupees or with both. (2) Whcrc any orfence eomlnitted under sub-sccrion (1) is Tor the benefit oTsb~ne other person or a company or othcr hcdy corporate or an associarion of persons (whcthcr incorporated or not ), then, such othcr person and every presidcnt, chairman. director, partncr. manager, secretary, agent or any other officer or person conccrned with the management rhcrcoF, as the cnsc lnay be, shall, unless he proves that thc offence was committed without his knowledge or consent, bc dcc~ned to be guilty ol such offcnce.
4. Offence to be cognizable
An offence punishable under this Act shnll be cognizable.
5. Power to erase writing, etc.
Without prejudice to the provisions of section 3, it sllall be compctcnt for the State Government to take such stcps as may be necessary for erasing any writing, freeing any defacemen1 or removing any mark from nny property.
6. Act to over-ride other laws
The provisions of this Act shall have effect notwithstanding any thing to the contrary contained in my other inw for the time being in o[hcr laws in force.
