The Nagarsena Kanun Evam Niyam Adhiniyam, 1947

(1) This Act may be called the Nagarsena Kanun evam Niyam Adhiniyam, 1947. (2) It shall come into force on 15th May, 1947.

In this Act, unless there is anything repugnant in the subject or context: (1) "District Magistrate" shall mean the District Magistrate, and includes Additional District Magistrate, City Magistrate appointed by the Government. (2) "Nagarsena" includes any organization or group or body under any name which is organized, trained or equipped for the purpose of exercising physical force or for the purpose of such activities as may be specified by the Government.

(1) No person shall organize, manage or assist in the organization or management of any Nagarsena or part thereof, nor shall any person participate in the activities of such Nagarsena. (2) The Government may, if it considers necessary for the maintenance of public order and tranquility, by notification, prohibit the existence, formation or activity of any Nagarsena.

(1) Whoever contravenes the provisions of Section 3 shall be punished with imprisonment which may extend to six months, or with a fine, or with both. (2) Whoever manages, assists or participates in the activity after the prohibition order by the Government shall be punishable with imprisonment which may extend up to one year.

Any police officer not below the rank of Sub-Inspector may, if he has reason to believe that a Nagarsena is operating in contravention of this Act, enter and search any premises and seize any documents or articles related to such activity.

(1) The provisions of this Act shall be in addition to and not in derogation of any other law for the time being in force. (2) Nothing in this Act shall affect the right of any person to join any legal or peaceable organization.

(1) The Government may, by notification, make rules for carrying out the purposes of this Act. (2) Without prejudice to the generality of the foregoing power, such rules may provide for the procedure to be followed for the prohibition and control of Nagarsena, and for the adjudication of offenses under this Act.

(1) अत्र-दफा के प्रावधानों के तहत और इस कानून के नियमों के अधीन, नगरसेना के सदस्य को कोई वर्दी, बैज, या कोई विशेष पहचान का चिन्ह (जो सरकार द्वारा निर्धारित किया गया हो) दिया जाएगा। यह वर्दी, बैज, या चिन्ह नगरसेना के सदस्य के पद और कार्य का सूचक होगा।

नगरसेना के किसी भी सदस्य द्वारा, चाहे वह अधिकारी हो या कार्यवाहक सदस्य, अपने अधिकारों का प्रयोग करते समय नियमों का उल्लंघन करने पर, उसे समुचित जांच के बाद चेतावनी दी जाएगी या संबंधित सक्षम अधिकारी द्वारा उचित अनुशासनिक कार्यवाही की जाएगी। जो भी सदस्य अपने कर्तव्यों का सही निष्पादन नहीं करता है, उस पर दंडात्मक प्रावधान लागू होंगे।

No suit, prosecution or other legal proceeding shall lie against the Government or any officer for anything which is in good faith done or intended to be done in pursuance of this Act or any rules made thereunder, as defined in the Indian Penal Code (1860).

नगरसेना के किसी भी सदस्य की बर्खास्तगी या निलंबन तब तक प्रभावी नहीं होगा जब तक कि सरकार या सक्षम प्राधिकारी द्वारा विधिवत जांच न कर ली जाए। इसके अलावा, सेवा शर्तों और अनुशासन संबंधी नियमों के तहत सदस्य को स्पष्टीकरण का अवसर दिया जाना अनिवार्य है।

नगरसेना के किसी भी सदस्य के कर्तव्यों और अधिकारों का निर्धारण अधिनियम की धारा (6) के उप-बंधों के अनुसार किया जाएगा।

नगरसेना के किसी भी सदस्य के प्रशिक्षण की अवधि पूर्ण होने के पश्चात, उसे उसकी जिम्मेदारियों और सेवा के क्षेत्र के अनुसार तैनात किया जाएगा।

नगरसेना के किसी भी सदस्य के लिए निर्धारित वर्दी और पहचान चिन्ह का उपयोग करना अनिवार्य है, जिसका प्रावधान इस अधिनियम की धाराओं में किया गया है।

नगरसेना के किसी भी सदस्य की सेवा का विस्तार या अनुबंध, संबंधित सक्षम प्राधिकारी द्वारा समय-समय पर जारी आदेशों के अधीन होगा।

Nagarsena-Vidhan (Niyamavali) (1) Nagarsena ka koi bhi sadasya, kisi bhi vaqt aur kisi bhi sthan par, apne varg (class) ke anusar nirdharit poshaka (uniform) dharan kar sakega. (2) Nagarsena ka koi bhi sadasya, apna pahchan-patra (Identity Card) dharan karega aur adhikari dwara mange jane par use dikhayega. (3) Nagarsena ka pratyek sadasya, Nagarsena ke niyamon aur nirdeshon ka palan karega tatha apne adhikariyon ke adeshon ka anusaran karega.
