BE it enacted by the Legislative Assembly of the National Capital Territory of Delh the Sixty-first Year of the Republic of India as follows:- " -i'R M7T f1TVJ DEL}iI GAZETTE : EX[RAORDINARY PART - I PRELIMINARY 1. Short title , extent and commencement . - (1) This Act may to called the Delhi Prevention of Touting and Malpractices- ag?instTourists Act, 2010. ( 2) It extends to the whole of the National Capital Territory of Delhi.
3. (3) It shall be deemed to have co me into force on the"lst dayof October, 2010. Definitions. - (1) In this Act, unless tfie context otherwise'requires, - ' T;7 Tzr IC (a) (f)
   • (b) "Delhi" means the National Capital territory of Delhi;
   • (c) "Government" means the Lt. Governor of the National Capital Territory of Delhi appointed-by the President under article 239 and designated as such under article 239AA of the Constitution;
   • (d) "malpractice" includes dishonesty, cheating, impersonation and obstruction in allowing free choice for shopping or stay or travel arrangements;
   • (e) "tourist" means any person or group of persons including pilgrims who visits or visit Delhi from any part of India or outside India; "C`ommissioner of Police " means the Commissioner of Delhi Police appointed tinder section 6 of the Delhi Police Act, 1978 (34 of 1973); "touting " includes enticing, misguiding or coercing for shopping, accommodation, transportation, sight-seeing or pestering for any particular premises, including the precincts thereof, any person, establishment, dealer or manufacturer for personal consideration; Explanation . - Whoever loiters around airports , railway stations, bus stands, markets or any other places frequented by tourists with the intention of offering any unsolicited service to the tourist or pestering or coercing him to -use any such service and exhibits such conduct so as to show such intention ( like following, arguing, 7^yJir_. 10 DELHIGAZETTE: EXTRAORDINARY
     • • communicating or otherwise drawing attention of tourists through words or gestures or placards or pamphlets thereby causing obstruction or annoyance to tourists or general public) and otherwise has no reasonable explanation for frequenting the said -place will be deemed to have committed the act of touting.
4. (2) Words and expressions used herein and not defined but defined in the Indian Penal Code, 1860 (45 of 1860) shall have the meani gs respectively assigned to them in the said Code.
