The Vexatious Litigation (Prevention) Act, 1949

General19492 sections

The Vexatious Litigation (Prevention) Act, 1949, is designed to curb the abuse of the legal system in the State of Tamil Nadu. It applies to individuals who habitually file baseless or harassing civil or criminal lawsuits without any legitimate justification. Under this law, the Advocate-General can apply to the High Court to restrain such chronic litigators. After giving the person a chance to present their case, the High Court can order that they cannot start any new legal proceedings in any court without first obtaining official permission from the High Court or a District and Sessions Judge. This law protects innocent people from legal harassment and prevents courts from wasting valuable time on frivolous disputes.
