Tender of arrears prior to sale to stop sale

Where a defaulter may tender payment of the arrear demanded after his property may have been distrained, and prior to the day fixed for sale, together with payment of interest, batta, and all necessary expenses attending distress, the distrainer shall receive the amount immediately upon the same being tendered, and shall forthwith release the property. In section 38 of the principal Act, after sub-section (3), the following sub-section shall be inserted, namely :--"(3-A) No sale shall be set aside by the Collector under sub-section (2) or sub-section (3) unless the purchaser has had a reasonable opportunity of making his representations.".
