The Sikkim Prevention of Defacement of Property Act, 1988
The Sikkim Prevention of Defacement of Property Act, 1988 applies to the entire state of Sikkim to prevent the unauthorized disfigurement of public and private property. It penalizes anyone who defaces visible property—such as buildings, walls, fences, or trees—by writing, painting, or marking on them without permission, except to indicate the owner or occupier's details. Offenses are punishable by up to six months of imprisonment, a fine up to one thousand rupees, or both. The law also holds corporate leaders and beneficiaries liable unless proven ignorant of the act, empowers the government to erase defacements, and classifies these violations as cognizable offenses.
