The Sikkim Legislative Assembly Members Removal of Disqualifications Act 1978
This Act ensures that holding certain official positions or offices of profit under the Indian or Sikkim government does not disqualify a person from being elected to or serving as a member of the Sikkim Legislative Assembly. It explicitly lists protected roles, including government ministers, military reservists, Home Guard officers, and leaders or members of various state commissions, university bodies, public corporations, and co-operative societies. Additionally, holding positions in statutory or non-statutory bodies where the individual receives only basic compensatory allowances or housing is permitted. This law enables individuals serving in key public and administrative bodies to participate in state governance without forfeiting legislative eligibility.
