The Sikkim Land Tenancy Act, 2008 regulates the leasing and renting of land across the state of Sikkim. It applies to all landowners and prospective tenants within the state. Under this law, landowners can only rent out their property to individuals who hold a valid Sikkim Subject Certificate or Certificate of Identification, and all tenancy arrangements require official approval from the Department of Land Revenue and Disaster Management. Sub-tenancies are similarly restricted to eligible certificate holders. Unauthorized tenancies are automatically void, subjecting tenants to eviction and landowners to financial penalties. The legislation aims to protect local interests by ensuring land use rights remain strictly restricted to recognized local residents.
