Constitution of Tribunal and appeals thereto
The Sikkim Agriculture Land Ceiling and Reforms Act 1977(1) If any person is aggrieved by an order of the competent authority under Section 4 or sub-section (4) of Section 9 or Section 12, he may within thirty days from the date of the order prefer an appeal to the Tribunal to be constituted by the State Government. (2) Such Tribunal shall consist of a sole member who shall be not below the rank of a Deputy Secretary to the State Government. (3) The Tribunal may entertain an appeal after the expiry of the said period of thirty days if it is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time. (4) In deciding appeals, the Tribunal shall exercise all the powers which a Civil Court has and shall follow, as far as possible, the same procedure which a Civil Court follows in deciding appeals against decrees of an original court under the law relating to Civil Procedure.
