The State Govt. aircrafts - Use and Control Rules, 2000
1. Short title and commencement
(1) These rules may be called the 'Rajasthan State Government Aircrafts (Use and Control) Rules, 2000'. (2) They shall come into force at once.
2. Definitions
In these rules, unless the context otherwise requires,— (a) 'Aircraft' means any aircraft owned or maintained by the State Government for the use of VIPs or otherwise; (b) 'Competent Authority' means the officer or authority authorized by the Government to sanction the use of the aircraft; (c) 'Government' means the Government of Rajasthan; (d) 'State' means the State of Rajasthan; (e) 'VIP' means the Governor, Chief Minister, Ministers, State Ministers, Deputy Ministers, Parliamentary Secretaries or such other dignitaries as may be specified by the Government from time to time.
3. Use of Aircraft
(1) The aircraft shall primarily be used for the performance of official duties by the VIPs. (2) The request for the use of the aircraft shall be made to the Competent Authority in the prescribed form. (3) The Competent Authority shall consider the availability of the aircraft, the urgency of the official work, and the security requirements before granting permission for the use of the aircraft. (4) The priority for the use of the aircraft shall be determined by the order of precedence of the dignitaries. (5) In case of emergency, the Chief Minister may authorize the use of the aircraft for non-official purposes on payment of prescribed charges. (6) The aircraft shall not be used for any political purpose. (7) The logbook of the aircraft shall be maintained and signed by the pilot in command after every flight and shall be submitted to the Competent Authority for review. (8) Any misuse of the aircraft shall be viewed seriously and shall be subject to recovery of costs and disciplinary action. (9) The maintenance and operation of the aircraft shall be in accordance with the standards prescribed by the Director General of Civil Aviation. (10) The Government may, from time to time, frame guidelines for the allocation and use of the aircraft.
4. Powers vest in the Government
(1) The Government reserves the right to cancel or reschedule any flight of the aircraft at any time if public interest so requires. (2) The Government may, by order, waive any charges or modify any condition prescribed under these rules in exceptional circumstances.
5. Repeal and Savings
The Rajasthan State Government Aircrafts (Use and Control) Rules, 1989 are hereby repealed. Provided that any action taken or order issued under the said rules so repealed shall be deemed to have been taken or issued under these rules.
